Conference Room No.1 5:00 p.m. MEMBERS PRESENT: Chairman Contreras, Board Members Gingerich, McArthur, Reynolds and Arnold MEMBERS ABSENT: Vice-Chairman Leonard and Board Member Nash CI1Y STAFF PRESENT: Director of Building and Housing Larsen, Assistant Director of Building and Housing Remp, Administrative Secretary Uybungco and Chief Plans Examiner Saucedo CALL MEETING TO ORDER: Chairman Contreras called the meeting to order at 5:07 p.m. ROLL CALL: Members present constituted a quorum 1. APPROVAL OF MINUTES: MSUC Arnold/McArthur (5-0) to approve the minutes of September 17, 1990 - Motion carries with revision on page 2, Item #3A (see attached). 2. NEW BUSINESS: A. Eastlake Greens Golf Clubhouse - Handicap Accessibility The following concerns were addressed: (1) Shower facilities do not accommodate the handicapped/physically disabled; and, (2) Access to dining spaces at terrace is insufficient. Director of Building and Housing Larsen informed Mr. Dennis Durfee, representative for this project, that no action may be taken at this meeting. A formal application must be submitted for consideration to modify the California Administrative Code, Title 24 requirements. However, upon receiving the application, staff will notify Chairman Contreras and he will contact the Board members and get a quorum for a special meeting if necessary. Mr. Durfee will provide copies of material for each member for review and consideration before the meeting. Board of Appeals & Advisors -2- October 8,1990 . B. Application for Code Modification - 4065 Bermuda Dunes Place Applicant requested approval of modification from existing Ordinance of 5' high fence requirement. A 4' high fence is currently erect at the rear of the property, with 5' high fencing surrounding the front and sides of the yard. The Board approved a similar appeal in 1986. MSUC Reynolds/Gingerich (4-1) to approve the application for modification. C. California Administrative Code, Title 24 - Energy Requirements for Residential and Commercial (Presentation by Chief Plans Examiner Saucedo) Item moved to after Item #2E D. . E. Presentation informational packet is on file in the Department of Building and Housing. Ordinance Revision - 1988 Uniform Building Code, Section 304( d) - Expiration of Plan Review - Department Policy Statement Staff requested this item be moved to the November meeting. Staff has been requested to contact the water districts for their comments. Departmental Policy and Council Agenda Statement is not ready at this point. Ordinance Revision - 1988 Uniform Building Code - Language Clarification Staff informed the Board that this language clarification recommendation came about from the motel project on Broadway. The City Attorney advised staff that the appeals was not complete because City Council did not hear the case. Board Member Reynolds stated that the striking of "The decision of the Board is final" would make the Board of Appeals not the final body to rule. The City Council would be the final body ruling. This revision could make for a political issue and not a technical issue. Director of Building and Housing Larsen recommended that since this item is not in the essence of time, staff will seek the City Attorney's opinion and recommendation and bring forth the information to the Board at the November meeting. 3. DIRECTOR'S COMMENTS/REPORT: . A. Expressed appreciation for the presentation by Chief Plans Examiner Saucedo. B. Will discuss Code Change Process (reduction of guardrail spacing) and will present summary of events of the 68th Annual Code Development and Education Conference of the International Conference of Building Officials at the November meeting. . . .
