[ 13 ] CHULA VISTA CITY COUNCIL MEETING OF: January 8, 1974 ITEM TITLE: Resolution - Releasing an Uncontrolled Embankment Agreement for Property Located at 1261 Third Avenue in the City of Chula Vista INITIATED BY: Director of Public Works/City Engineer k- BACKGROUND In 1972 Bart Corporation and County Properties, 780 Kettner Blvd. San Diego, CA, were the owners of property located at 1261 Third Avenue in the City of Chula Vista. They applied for an Uncontrolled Embankment Permit for said property on September 5, 1972. In accordance with Ordinance 1163, Section 29.2.23, their application was accompanied by an agreement for land development for uncontrolled embankment between the City and themselves. The Grading Permit was approved on September 6, 1972 (Permit 72-20G) and Council approved the agreement on October 3, 1972 by Resolution No. 6619. Edbro California Handyman 106, Inc., the new owners of said property were granted a Grading Permit on January 9, 1973 (Permit 73-1G) for grading of their property. Inter-City Soils Inc., soils engineers for the job, have submitted a final soils report for this property. Per their report, the uncontrolled embankment created in 1972 was removed and properly compacted in accordance with their recommendations listed in the preliminary soils report for this property .(dated September 24, 1971 and a supplemental report dated October 26, 1972). It is requested that the City Council approve a resolution releasing said uncontrolled embankment agreement, since the uncontrolled embankment has been removed and recompacted in a manner approved by the City Engineer and has been certified by the soils engineer in accordance with Section 29.204 of the City Code. Upon approval of this resolution, the City Clerk shall record it at the office of the County Recorder. A transparency is available for Council viewing.
