CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA
November 2, 1970
The regular meeting of the City Planning Commission of Chula Vista, California,
was held on the above date beginning at 7 p.m. in the Council Chamber, Civic
Center, 276 Fourth Avenue, Chula Vista, with the following members present:
Rice, Stewart, Adams, Chandler, Macevicz, Hillson and James. Also present:
Director of Planning Warren, Associate Planner Lee, City Attorney Lindberg,
and City Engineer Gesley.
APPROVAL OF MINUTES
MSUC (Adams-Macevicz) Minutes of the meeting of October 19, 1970 be approved
as mailed.
PUBLIC HEARING - Rezoning - Tidelands Area - North of G Street to City Limits,
from mean high tide line to Interstate 5 , from "I" General
Industrial to interim A Agriculture - Commission initiated
Director of Planning Warren reported the receipt of a letter from the attorneys
for the Santa Fe Railway Co. requesting a postponement of the hearing for four
weeks to allow them time for preparation of their presentation.
City Attorney Lindberg advised that attorneys for both the railroad and Sam
- Vener, lessee of the property in this area, had contacted his office and
requested a continuance of the hearing.
MSUC (Adams-Chandler) The Public hearing concerning the rezoning of Tidelands
Area be deferred to the meeting of December 7, 1970.
PUBLIC HEARING - a. CONDITIONAL USE PERMIT - 215 Third Avenue - Locate
residential use in C-B zone - Ellis E. & Ina M. Huff
b. VARIANCE - 215 Third Avenue - Residential use on ~round
floor of structure in C-B zone - Ellis E. & Ina Huff
Associate Planner Lee pointed out the loc~tion on the east side of Third
Avenue and the adjacent uses which consist of retail stores on Third Avenue
and parking lots to the rear front}ng on Church Avenue. Mr. Lee also displayed
a plot plan of the property locating the existing garage structure which the
applicant requests permission to convert into an apartment unit for a caretaker,
and also to add an addition to the existing nonconforming residential structure
to serve as an employee lounge. This structure is used by a 24-hour answering
service.
Mr. Lee explained that residential use may be allowed in the C-B zone subject
to a conditional use permit, and the variance application was filed to locate
this use on the ground floor in this zone, also to reduce the side yard setback
from 5' to 0 for this residential use. The Fire Department recommends denial
of the variance.

Mr. Lee commented that the Downtown Association has asked that generally this
type of use should be abated as expediently as feasible, and in his opinion,
granting this request would perpetuate a nonconforming use. The staff feels
the conditional use permit could be allowed, but not the variance request.
This being the time and place as advertised, the public hearing was opened.
No one was present who wished to speak either for or against the request.
MSUC (Stewart-Chandler) This public hearing relating to conditional use permit
and variance requests be continued to the meeting of November 16, 1970, and
the staff be directed to urge the applicant to attend this meeting.
PUBLIC HEARING - Request for modification of conditions of variance - 621 L Street
Addition to building and construction of new building in R3
zone (M-1 variance) - Imperial Truck Lines, Inc.
Director of Planning Warren pointed out the location of the existing dock
building on which it is proposed to construct a 50' x 24' addition and the
location at the northeast corner of the property for a new 40' x 48' wash and
service building. He contended that approval of this request would be perpetu-
ating a nonconforming use in an R-3 zone and the staff therefore recommends that
this request be denied. The staff further recommends that the applicant apply
for rezoning of the property to I-L if he desired to expand the use which has
been permitted since 1950.
This being the time and place as advertised, the public hearing was opened.
Mr. Z. H. Hurt, Terminal Manager for Imperial Truck Lines, stated the addition
to the dock building is requested in an attempt to get storage out of the yard
area behind the building, thus lessening the noise from activity in that area.
He also pointed out the wash and service building will be located adjacent to
the eastern property line and will be enclosed on three sides, with only the
south side open. Washing the trucks is presently done at the end of the dock
building and Mr. Hurt felt that enclosing this operation should lessen the
noise.
Stella Gambowski, 871 Riverlawn, asked if there would be an increase in the
number of trucks coming into this terminal with this addition. She expressed
opposition to anything that would create a lot of noise as they have been
fighting this for years.
Herbert Young, 873 Riverlawn, expressed opposition not only because of the
noise disturbance but because the vapors from the washing operation would be
harmful to adjacent property and to the health of the residents.
When questioned about the washing operation, Mr. Hurt confirmed that only soap
is used and no acid or chemicals, also that a steam cleaner is presently used
and would be used inside the proposed building.
No one else wishing to speak, for or against, the public hearing was closed.

Members Stewart, Chandler and Adams expressed concurrence with the staff's
recommendation that this use should not be perpetuated.
Member Hillson supported the applicant's request pointing out the trucking
company was located there prior to development of the area, and most success-
ful operations may require expansion or modification on their activities.
He felt the improvements proposed would enhance the area, and the Commission
should not be against business which the city needs.
Chairman Rice concurred in part but felt this particular buisness has outgrown
the present location, and this proposal represents an expansion. He pointed
out the adjacent area is not ready for redevelopment to other than residential
use.
MSC (Adams-Macevicz) Application for modification of conditions of variance
PCV-70-34 to allow addition to existing building and construction
of new building be denied.
The motion carried by the following vote:
AYES: Members Adams, Macevicz, Stewart, Rice, Chandler, and James.
NOES: Member Hillson
Absent: None
Vacation of public right-of-way - Portion of East Oneida Street - Saratoga
Development Corp.
Associate Planner Lee pointed out the location of a small triangular section
of right-of-way of East Oneida Street at the intersection of Neptune Drive
for which the applicant is requesting a vacation in order to eliminate a
jog in the right-of-way lime; also a portion of the drainage easement in view
of a new drainage easement further south. Public Works Department and the
Planning Staff recommend approval of the requested vacations.
MSUC (Chandler-Macevicz) Recommend to City Council approval of vacation
PCM-70-20 of public right-of-way of a portion of East Oneida
Street and a portion of a drain easement.
Request for approval of move-in and waiver of undergrounding utility service -
700 block of E Street - Chula Vista Visitors and Convention Bureau
Director of Planning Warren pointed out the location of the property adjacent
to San Diego & Arizona Eastern railway easement, just east of Interstate #5,
where the applicant is requesting permission to move a 12' x 20' building and
also a waiver of the requirement for undergrounding of public utility service.
Mr. Warren exhibited pictures of the small building proposed to be moved in
and advised the staff feels this would be compatible with other buildings
in the area and would recommend approval subject to two conditions that would
be imposed in any site plan approval.
With reference to the request for waiver of the requirement for undergrounding
public utility service, Mr. Warren pointed out the adjacent area is developed
commercially and served with overhead service and since this building location

is for a limited time of two years requiring underground utilities might be
an unjustified hardship. He suggested that if the building is to be
permanently located here, utility service should be underground.
Chairman Rice called on Mrs. Phyliss Foster of the Chula Vista Visitors and
Convention Bureau who confirmed that this would be a temporary use until
they have funds to build a permanent facility. Two years is their projection
for the use of the temporary building.
MSUC (Macevicz-Chandler) Recommend to the City Council the ~pproval of the
move-in requested by Chula Vista Visitors and Convention Bureau and grant a
waiver of the requirement for underground utility service.
Request for approval of plans for move-in of dwellin~ at 4140 Calle La Mirada
Director of Planning Warren displayed an architectural rendering of the front
elevation of a house proposed to be moved onto the lot at 4140 Calle La Mirada
which depicted board and batten siding, ornamental rock and shake shingle roof.
He felt this structure would not be compatible with adjacent dwellings, if
painted a suitable color.
Mr. Frederick Tindall, 1413 Lantana, confirmed the plans as shown in the drawing
and advised a light brown paint had been selected for the exterior.
MSUC (Stewart-Macevicz) Approval of architectural plans for dwelling to be
moved to 4140 Calle La Mirada.
DIRECTOR'S REPORT
Director of Planning Warren requested a workshop meeting for Monday night,
November 9, to discuss proposed changes to the Zoning Ordinance.
MSUC (Stewart-James) A Planning Commission Workshop meeting be scheduled for
November 9, 1970, 7 p.m. at the Civic Center.
Director of Planning Warren called upon the City Attorney for a report on
some of the problems that have come up with the L.A.F.C.
City Attorney Lindberg reported that the Local Agency Formation Commission
has attempted to usurp the planning function and activities of the County,
even to the point that they had recommended the detachment of a portion of
the northern part of the City of San Diego to be placed in the Loma Vista Fire
District for the purpose of providing that service, and then whatever other
services might be needed would be provided by special district or through
contact with the City. He reported, however, that at a meeting on this
date the L.A.F.C. moved to dismiss the Reorganization Committee they had
appointed and to file the matter of detachment and to request that the City
Council of San Diego take whatever action it deemed appropriate for either
detachment or providing services.
Mr. Lindberg spoke further on the need for the adoption of standards,
priorities and procedures to govern the work of the L.A.F.C.

The Commission felt this need should be brought to the attention of the
local Assemblyman with a request that he initiate legislation that would
provide proper guidance to the Local Agency Formation Commission.
MSUC (Macevicz-Hillson) The Director of Planning be requested to write a
letter on behalf of the Planning Commission to the appropriate leaders in
Sacremento requesting that necessary legislation be initiated.
WRITTEN COMMUNICATIONS
Director of Planning Warren reported the receipt of a letter from the
Downtown Association of Chula Vista concerning residences in the business
section of Third Avenue between E Street and G Street and soliciting the
assistance of the Planning Department to find a way for the removal of
these houses and their replacement by commercial buildings. Mr. Warren
suggested this matter should be discussed at a workshop meeting prior to
action by the Commission or the Planning Department.
ORAL COMMUNICATIONS
Member Macevicz suggested that Planning Commission meetings be opened with
the pledge of allegiance to the flag and a moment of silence.
City Attorney Lindberg confirmed this would be in order.
Director of Planning Warren stated if it is the Commission's desire, that
will be added to the agenda of Commission meetings.
Chairman Rice adjourned the meeting at 8:25 p.m. to the workshop meeting
of November 9 and regular meetings of November 16 and 23.
