ClIT OF ~CHULA VISTA JUNE 22, 2010, Item 'J ITEM TITLE: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING $26,318 FROM THE CALIFORNIA DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL AND AMENDING THE FISCAL YEAR 2010/2011 ADOPTED BUDGET BY APPROPRIATING SAID FUNDS TO THE POLICE GRANT FUND SUBMITTED BY: REVIEWED BY: CITY MANAGE 4/5THS VOTE: YES [I] NO D SUMMARY The Police Department has recently received notice of a grant award in the amount of $26,318 from the Califomia Department of Alcoholic Beverage Control (ABC). This one- year project will target ABC licensees that continually violate ABC and city regulations, particularly those that allow narcotics activity on their premises. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION That council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable 5-1 JUNE 22, 2010, Item~ Page 2 of2 DISCUSSION The Police Department has been awarded $26,318 from the California Department of Alcoholic Beverage Control (ABC) for a one-year project period of 7/1/2010 to 6/30/2011. The Department will pro actively target ABC problem establishments based on intelligence gathered by the Special Investigations Unit (SIU) and ABC operations, commtmity partners, and data from calls for service and reports. Using this intelligence, CVPD will concentrate resources on those establishments that consistently violate ABC laws and license conditions. Grant funds will be used to implement a combination of ABC enforcement strategies and coordinate training for both ABC licensees and patrol officers. In addition to targeting problem establishments, SIU will coordinate LEAD (Licensee Education on Alcohol and Drugs) courses, conduct trainings and briefings for sworn personnel regarding ABC law and enforcement activity, and organize media announcements of ABC grant activity and impacts in the commooity. The Department will use grant funds for overtime to combat areas with high crime and violent and disorder calls associated with ABC licensed establishments. To accomplish the goal of targeting chronic problem establishments and those that operate in violation of their license, CVPD will use a multi-agency approach to conduct enforcement operations, train licensees and sworn personnel, and involve the community with media releases and public input. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule foood in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. CURRENT YEAR FISCAL IMPACT Approval of this resolution will result in the amendment of the fiscal year 2010/2011 adopted budget of the Police Grant Fund by appropriating $22,322 for overtime costs, $1,496 for operating expenses, and $2,500 for mandatory conference travel. The funding from the California Department of Alcoholic Beverage Control will completely offset these costs, resulting in no net impact to the General Food. ONGOING FISCAL IMPACT This is a one-year grant and approval of this resolution will not have an ongoing fiscal impact. The Police Department Special Investigations Unit will conduct ABC enforcement strategies and provide training and resources for officers, businesses, and the public; and WHEREAS, the Police Department has been awarded grant funds by ABC in previous years and has a history of success working with ABC and other law enforcement agencies at the local and state levels; and WHEREAS, the fiscal year 2010/2011 Police Grant Fund budget will be amended to add $22,322 for overtime costs, $1,496 for operating expenses, and $2,500 for mandatory conference travel. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept $26,318 from the California D~partment of Alcoholic Beverage Control and amend the fiscal year 2010/2011 Police Grant Fund budget by appropriating $22,322 to the Personnel Services category, and $3,996 to the Supplies and Services category.
