HomeMy WebLinkAboutPlanning Comm min 1971/03/22 MINUTES OF A REGULAR ADJOURNED MEETING OF THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA March 22, 1971 The regular adjourned meeting of the City Planning Commission of Chula Vista, California was held on the above date beginning at 7:00 p.m. with the following members present: Rice, Adams, Stewart, Chandler, Hillson, James and Macevicz. Also present: Senior Planner Williams and City Attorney Lindberg. Chairman Rice led the pledge of allegiance to the flag, followed by a moment of silent prayer. APPROVAL OF MINUTES MSUC (Chandler-Hillson) Minutes of the meeting of March 15, 1971, be approved as mailed. PUBLIC HEARING - CONDITIONAL USE PERMIT- 375 Broadway - Operate Used Car Lot - L. C. Motors (Luis D. Cisneros) Senior Planner Williams indicated on a plat the location of the lot at the northeast corner of Parkway and Broadway for which the applicant is requesting a conditional use permit for used automobile sales. The property is zoned C-T. Mr. Williams indicated the surrounding land use, which includes various commercial enterprises on Broadway and residential use to the east. He further commented that the adjacent lot, which is shown on the map as a used car lot, is presently vacant. Mr. Williams pointed out that this portion of Broadway has undergone considerable redevelopment in the past several years and some is nearing completion at the present time. The staff favors encouraging redevelopment of this portion of Broadway in a more restrictive commercial character with the heavier uses encouraged to develop toward the north and south ends of Broadway; however, some of the heavier uses that do not require expensive construction could be utilized as an interim use for a specified period of time. The staff, therefore, recommends approval of this request subject to review at three year intervals to determine the compatibility of this use with adjoining uses in the area, as well as condt.tions for the improvement and landscaping of the lot. This being the time and place as advertised, the public hearing was opened. Mr. Brown, Manager of L. C. Motors, 2204 National Avenue, National City, remarked that due to urban renewal they are required to move from that location where they have been in business for over a year and a half. Mr. Brown asked if the required improvements would have to be installed before they could occupy the lot or if there would be a time allowance for completion of the improvements. Mr. Williams advised that since these are a condition for the use, the improvements would have to be made before the lot is occupied. -2- 3/22/71 Saburo Muraoka, 1436 First Avenue, owner of the property, spoke of improvements he is currently making on other property which precludes improving this lot at the present time. He indicated that within a year or so he would like to develop this lot for professional office use. He, therefore, does not wish to spend money on improvements to the lot which would be removed in the future, and felt that permanent paving would be too costly for the one year lease which he is considering for this lot. Roy Muraoka, 103 Quintard, advised that he is the owner of the adjacent lot to the east, and questioned the necessity of constructing a 6' masonry wall between the two lots. He pointed out.that if the lot on the corner, owned by his father, is developed for commercial office use, it will probably be necessary to utilize his lot for parking facilities. He requested that the wall not be required. Chairman Rice pointed out that the lot to which Roy Muraoka referred is presently zoned for residential use, and to utilize it for another purpose, would require a zone change, or some action by the Planning Commission. He pointed out that the zoning wall between commercial and residential use is an ordinance requirement and could not be waived in view of future development which might possibly take place. Mr. Muraoka commented that the adjacent lot to the north does not have a masonry wall. He was advised that in case of redevelopment of the property, such a wall would be required. Senior Planner Williams reported that one letter in opposition to this application was received from Mr. Gayle Fick of the Rose Arbor Mobile Lodge, who contended that a used car lot is not compatible with other uses in the area nor in keeping with the general character of the area. As no one else wished to speak, for or against, the public hearing was closed. Member Adams expressed his feeling that if the conditional use permit is granted, it should be reviewed each year after the first three years. Member Stewart expressed concurrence with the conditions required but pointed out that requiring permanent paving and a masonry wall places a financial burden on the owner or lessee for a transitory type of use. Mr. Muraoka confirmed that he is not interested in teasing the property for three years and is offering only a one year lease. In view of the owners comments, the Commission felt that development under the required conditions would not be feasible. MSC (Adams-James) The application for a conditional use permit to operate a used car lot at 375 Broadway be denied. The motion carried by the following vote: AYES: Members Adams, James, Hillson and Rice NOES: Members Macevicz, Stewart and Chandler ABSENT: None Chairman Rice advised the applicant of his right of appeal to the City Council within ten days. -3- 3/22/71 SUBDIVISION - Chula Vista Gardens Unit #7 - Final Map Senior Planner Williams commented that consideration of this final map was placed on the agenda at the request of the developer; however, one of the conditions specified in approval of the tentative map was that prior to the submission of the final subdivision map, the applicant shall submit to staff plot plans for development of Lots No. 210, 213, 217 and 226, and any necessary variance applications. These plans have been submitted and approved with the exception of lot 217 which will require that a variance be approved prior to construction. A variance application has been submitted but since this requires a public hearing which must be advertised at least ten days in advance, it will be considered by the Commission on April 5th. The staff recommends that no action be taken on the final map until the applicant has received approval for the variance requested. Mr. Jerry Linton, 3852 Jewell, San Diego, representing American Housing Guild, the developer, pointed out that the resolution approving the tentative map stated that prior to approval of the final map any necessary variance application must be submitted. Since the application has been submitted, and the developer is anxious to have the final map recorded in order that development may begin, he requested that approval of the map not be held up pending action on the variance. Chairman Rice expressed the opinion that the Commission would want to be sure they would agree with the variance request; otherwise, there is a possibility that the subdivisionmapmight have to be modified. He maintained it is reasonable to delay approval of the final map until the hearing concerning the variance has been held. MSUC (Chandler-Macevicz) No action be taken on the final map for Chula Vista Gardens Unit #7 until approval has been given on the necessary variance. Request for approval of Home Occupation - 2169 Cuyamaca Avenue - Donald and Lorraine Patterson Senior Planner Williams reported that the applicant is requesting approval of a Home Occupation License to operate a print shop in his garage at 1269 Cuyamaca; some mechanical equipment will be used but this will be hand operated and will not be over the limit of one horsepower. Although Home Occupation Licenses may be approved or denied by the staff, it was felt this item warranted Planning Commission consideration. As long as no power equipment is utilized, there are no customers coming to the site, and there is no other nuisance created, the staff can find no objection and recommends approval of the Home Occupation L~cense. Don Patterson, 1269 Cuyamaca Avenue, advised that he wishes to start this printing work on a part time basis prior to his retirement from the Navy in November, 1972, in order that it may be a full time business after that date. He stated that the equipment he now uses is hand operated and any equipment he might purchase in the future would be stored until he had adequate facilities. His work is letter press printing and he would not plan to go into offset printing. All work would be picked up and delivered and there would be no signs on the property. On a question from Member Adams, Mr. Patterson confirmed that the press is run by an electric motor but it is hand fed. The equipment used is a C & P 8 x 12 printing press. Mr. Patterson stated that he has used large aluminum plates to insulate his garage. He also stated he has had no complaints from his neighbors on the use of this equipment as a hobby. -4- 3/22/71 Member Stewart suggested that this operation should be reviewed six months - after Mr. Pattersons' retirement as it should not be permitted as a full time business operated in his home. MSUC (Macevicz-Hillson) Approval of the request for Home Occupation License at 1269 Cuyamaca Avenue subject to review in April, 1973, and to the condition that no other printing equipment than the 8 x 12 Chandler and Price press shall be installed. ORAL COMMUNICATIONS S.D.G.& E. Tour Member Chandler commented that the Planning Commission should go on record that it was an excellent tour of the SDG&E facilities and very worthwhile. He reported that the water was clean and full of fish at the outfall. Chairman Rice agreed that it was a very interesting and educational tour and he felt this company is definitelymakingprogress at making the area compatible wi th the city. City Attorney Lindberg added the comment that it is very difficult for members of a commission to have a real understanding of problems without going into the field to have a personal examination of the situation. He felt the City should also make it understood that the press and public are always welcome on such inspection tours. Undergroundin9 of electric lines at 248 Bay Boulevard Wayne Grizzell, representing Harding Campbell, spoke concerning the existing temporary electrical service for the wrecking yard, and requested that the undergrounding of this service be deferred for the length of this lease. He pointed out that other businesses in the area are serviced by overhead lines, and he felt Mr. Campbell should not be required to place the service underground until his property is redeveloped following the widening of Interstate 5. City Attorney Lindberg advised that a deferral or waiver of undergrounding electrical lines is a matter for City Council consideration. He suggested that Mr. Grizzell come to the Civic Center and discuss this with staff members. ADJOURNMENT Chairman Rice adjourned the meeting at 8:05 p.m. Respectfully submitted, Helen S.
