MINUTES OF A REGULAR MEETING OF THE CHARTER REVIEW COMMITTEE NOVEMBER 19, 1991 November 19, 1991 Council Conference Room 6:00 p.m. ---------------------~------------------------------------------- MEMBERS PRESENT: Bob Campbell, Jack Blakely, Sharon Reid, Ted Hillock, and John Dorso MEMBERS ABSENT: Susan Fuller (excused) and Vickie Turner (unexcused) STAFF PRESENT: Assistant City Attorney Rudolf The meeting was called to order by Chairperson Campbell at 6:03 p. m. The roll was called and all members were present except Members Fuller and Turner, Member Fuller having been excused by action of the committee at the previous meeting. MSUC (Blakely/Reid) to approve the minutes of the October 15, 1991. There were no comments from members of the public. . Agenda Item 4: The Committee thanked staff for providing the strike-out/underline version of the existing campaign contribution ordinance of the City (Chapter 2.52 of the Chula Vista Municipal Code). Those items shown as strike-out were items in the form of the ordinance when it was forwarded from the Charter Review Committee to the Council for approval, and those items underlined show new matter added by the Council subsequent to its receipt of the Charter Review Committee version of the ordinance. There were several questions of staff regarding the interpretation of the existing ordinance. Mr. Hillock inquired as to why the ordinance accumulated contributions of employees of business entities for the purposes of potential disclosure and disqualification, but did not similarly require attribution of contributions by members of non-profit organizations, such as the Sierra Club. Mr. Rudolf clarified that the Political Reform Act was intended to disclose and prevent financial interests adversely affecting the outcome of the pUblic's business, and that mere membership alone in an unincorporated association or non-profit corporation where neither the organization nor the individual member had an actual financial interest would require disclosure or disqualification, in the same way as the Political Reform Act deems public employees salary and fringe benefits to not be a "source of income" for the purposes of disclosure and disqualification. . Members Reid and Blakely indicated a potential interest in adding a provision similar to that currently provided in Section 2.52.105 . . . Charter Review Committee Minutes November 19, 1991 Page 2 with regard to notice of expenditure of personal funds in excess of $5,000, with regard to "independent expenditures" which are otherwise unregulated by the law, in response to the issues raised by Mayor Nader when the Council referred the ordinance in its entirely to the Committee for review. The Committee determined to cancel its December meeting, requests staff to provide a draft provision addressing the concerns of Members Reid and Blakely to be considered at the January meeting, and asked that the topic of Charter amendment to address the issue of a runoff election in the event no candidate received 51% of the vote also be placed on the agenda for the January meeting for consideration. There being no further business, the meeting was adjourned at 7:05 p.m. The next Committee meeting will be January 21, 1992 unless the Chair directs notice of the December meeting be given at least a week in advance, in the event he determines that meeting should take place.
