September 26, 1988 Council Conference Room 7:00 p.m. . . ------------------------------------------------------------------- Members Present: Chai rman Campbell. Members Mary Frances Click, John Dorso, Sharon Reid, Carlos Batara (arrived at 7:27 p.m.) Susan Fuller, Jack Blakely Members Absent: Staff Present: City Attorney Tom Harron The Chairman called the meeting to order at 7:15 p.m. MSUC (Reid/Dorso) to approve the minutes of the meeting of September 12, 1988. DISCUSSION OF CAMPAIGN CONTRIBUTION ORDINANCE Member Reid noted that the word "City" was sometimes capitalized and sometimes not capitalized and asked that it be consistent throughout. Member Reid questioned the meaning of the last line in Subsection D of Section 2.52.010 which talks about indirect costs to the public when special interests incur campaign relaten expenses. Harron speculated that this might refer to a concern similar to the one being expressed now that insurance company money spent on the "No Fault" initiative will result in higher rates. Rei d then moved that the sentence be del eted because it is not consistent with the reasons of the Charter Review Committee in recommending the ordinance which aimed primarily at equalizing influence. Member Reid then asked questions about some of the definitional sections. Member Reid then compared the sections on contribution limitations with transfer limitations. Member Cl ick asked whether anyone else besides the City Council was elected in the City in that Section 2.52.040 purports to apply to other City elections. City Attorney Harron stated that there are no other elective positions although when the Montgomery annexation was voted on, the voters also voted for the original members of the Advisory Committee. City Attorney Harron answered that the City Clerk normally reviews campaign statements as they are submitted. If she finds some error from her review, she will bring it to the candidate's attention for correction. Typically, the Finance Director will not look at this material unless a question comes up and he is asked to do so. . . . .-, ( ( Charter Review Minutes September 26, 1988 Page Two Member Batara asked with regard to Section 2.52.120 B whether this section should be broadened to prohibit a Councilmember from using campaign funds raised for the City Council position for a campaign for Mayor. City Attorney Harron stated that the Committee could change the section to do this, but the way it is presently worded was intended to allow Council members and the Mayor to use their campaign funds to run for reelection or to run for the May 0 r ISO f f ice. MSUC (Reid/Dorso) moved that the ordinance be accepted \'lith the changes suggested by members Reid and Batara of the Committee. The Committee next discussed the timing for bringing this to the City Council. There was a desire to bring it to the Council in the middle of October so that it would receive some press coverage in proximity to the election, but would also give the City Council enough time to continue it for a week if it felt that some changes were needed.
