SPECIAL MEETING OF THE CIVIL SERVICE COMMISSION City of Chula Vista MINUTES Wednesday, May 8, 1991 4:30 p.m. Council Conference Room City Hall Building 1. CALL THE ROLL Commissioners Jimenez Crouse X , Berry X X , Vogel , Boerner X X Public Others Present Samuel Roller, Appellant Ruth Fritsch, Counsel representing the Appointing Authority Clifford Swanson, Deputy Director of Works/City Engineer (Appointing Authority) Melody Kessler, Assistant Director of Personnel 2. CONTINUATION OF APPEAL OF DISCIPLINARY ACTION HEARING Assistant Engineer II. Mr. Roller's attorney, Elizabeth Schulman, was dismissed by Mr. Roller and therefore was not in attendance. Mr. Roller asked for a closed hearing. MSUC (Vogel/Boerner) 5-0 to continue in a closed session. Everyone but the department representative, Mr. cliff Swanson, was asked to wait outside. It was agreed that this is a continuation of the hearing of March 7, 1991 appealing the disciplinary action of a 15% reduction in pay. Any documents dated later than January 18, 1991, the date the discipline was imposed in this case, are completely irrelevant. Ms. Fritsch submitted a document to the Commission entitled "Meetings - Other Times Noted" dated March 22. samir NUhaily, Associate civil Engineer, was called by Ms. Fritsch as a witness. He was sworn in and testified. The Commission took a recess from 6:07 p.m. to 6:15 p.m. and another from 6:20 p.m. to 7:00 p.m. Shale Hanson, Associate Civil Engineer/Design Section, was called by Mr. Roller as a witness. He was sworn in and testified. . . . George Varshock, Assistant Engineer II, was called by Mr. Roller as a witness. He was sworn in and testified. Jack Gechter, Survey Party Chief, was called by Mr. Roller as a witness. He was sworn in and testified. Clifford Swanson, Deputy Director of Public Works/city Engineer, was called by Ms. Fritsch as a witness. He was sworn in and testified. Samuel Roller was sworn in and testified. Open discussion by the Commission ensued. MSUC (Crouse/Berry) 5-0 to deny the appeal of the disciplinary action. 3. CHAIR'S COMMENTS - None 4. COMMISSIONERS' COMMENTS - Commissioner Boerner commented that he did not feel it was fair to Mr. Roller that he should receive two performance evaluations on the same day. "He should have received the evaluation for the period ending August 31st much sooner so that he might have been alerted earlier to some of the short comings that others saw in him." 5.
