SPECIAL MEETING OF THE CIVIL SERVICE COMMISSION
CITY OF CHULA VISTA
Thursday, March 7, 1991

3. HEARING OF THE APPEAL OF A DISCIPLINARY ACTION Samuel Roller,
Asst. Engineer II (reduction in pay from Assistant Engineer
II, 'E' step to Assistant Engineer II, 'B' step)

Ms. Schulman requested that all members of the audience
who are going to be witnesses be excluded from hearing
the testimony of others, and she asked if they could wait
outside. The Commission agreed to this request.
· Progressive Discipline and Discipline Policy Number 2.09
were introduced as evidence.
· Ms. Fritsch handed out exhibits to commissioners and
stated that a witness will testify about each document
and its relevance. "The exhibits are to assist in the
testimony and are not meant to be read in their entirety
at this time by the Commission."
COUNSEL'S (REPRESENTING THE APPOINTING AUTHORITY) REQUEST:
· That the commission uphold the discipline that has been
imposed by the Department of Public Works on Mr. Roller
which is a 15% reduction in pay.
COUNSEL'S (REPRESENTING THE APPELLANT) ARGUMENT:
We do not believe the City can proceed with its
substantive evidence because it has failed to
procedurally follow its own rules that it has adopted.
Therefore, we think that the City has the burden of
proving that its rules were not conformed with and that
Mr. Roller should be reinstated to his position.

and testified.

Exhibit 4A was brought into evidence (three page hand written
document that Elizabeth Chopp wrote entitled "Meetings--Other
Times Noted". This document was being maintained by Ms. Chopp
separate from his personnel file.)
THE COMMISSION AGREED THAT A SUPERVISOR IS PERMITTED TO MAINTAIN A
DOCUMENTATION OF AN EMPLOYEE'S WORK PERFORMANCE IN THE DEPARTMENTAL
OFFICE AND THAT THEY DO NOT HAVE TO BE A PART OF THE OFFICIAL
PERSONNEL FILE OF THAT INDIVIDUAL.
The meeting was adjourned to a future date (to be determined) for
the continuation of this hearing.
