A. BACKGROUND
At the August 14, 1985 Planning Commission meeting, the Commission continued
this item in order to: (1) obtain further information regarding potential
acoustical effects and (2) have staff provide additional data on standards for
private school operation.
An acoustical analysis for the project is underway but has not yet been
completed and it is anticipated that development standards for private schools
will be discussed at the September 18 Planning Commission workshop.
B. RECOMMENDATION
Continue this public hearing until the meeting of October 9, 1985.

2. Public Hearing: EIR-85-3 EastLake Otay WAter District - Improvements
· Draft Environmental Impact Report
A. BACKGROUND
This document is a supplemental EIR to the Master EIR on the EastLake
project. Because it is supplemental to a City prepared document, the City has
assumed the lead role in the preparation of the document even though the City
will have no project approval role. If the Otay District were to prepare a
separate EIR for the project, it would be much more lengthy and it would
duplicate information already available. This process was agreed to through
discussions with the City Attorney's office, Council for the Otay Water
District, and the State Resources Agency under secretary for CEQA.
Once a Final EIR is prepared, the Commission will be asked to certify that it
was prepared in accordance with CEQA and the Board of Directors of the Otay
Water District that they have reviewed and considered the information in the
final EIR.
The proposed improvements for the Water District's pressure zones would be
sized to allow ultimate service to approximately 8,670 acres, including 3,073
acres located in EastLake. The portion of the project area located in
EastLake I has been annexed into OWD Improvement District 22; however, an
additional 1805 acres located in the portion of EastLake reserved for future
development and 4,600 acres located outside of EastLake could be served by
ID-22 and would need to be annexed into the Improvement District before
service could be obtained.
B. RECOMMENDATION
1. If there are no written or verbal comments which need to be msponded to,
close the public hearing and certify that EIR-85-3 has been prepared in
compliance with the California Environmental Quality Act of 1979, the
State CEQA Guidelines and the Environmental Review Procedures of the City
of Chula Vista.
2. If it is necessary to respond to any comments close the public hearing and
schedule consideration of the Final EIR for September 25, 1985.
C. PROJECT DESCRIPTION
The project consists of the installation and relocation of various
transmission mains, the construction and expansion of pump stations, the
expansion and construction of water reservoirs and the provision of a
reclaimed water main. A more detailed description is provided in Section II
of the EIR.

D. ENVIRONMENTAL ANALYSIS
The environmental impacts of the proposed project are summarized below.
Mitigation measures as listed are required to reduce potential significant
impacts to a level of insignificance. More detailed discussions of impacts
and mitigation measures for each issue are contained in Section III of this
report.
1. Visual Quality:. The majority of the proposed water improvement projects
do not have the potential to create adverse visual impacts since they will
either be pipelines placed underground or hidden from public view in the
Otay Water District Reuse Area (Project No. 4, reservoirs). However,
Project Nos. 3, 6, 9, lO and ll could potentially result in visual impacts
to future and existing development if specific design measures are not
incorporated into final project plans. Reservoirs (Project Nos. 6 and 10)
would need to be painted a natural color and extensively landscaped in
order to blend them into the environmental and screen them from views.
Pump station (Project Nos. 3, 9 and ll) would need to be enclosed in
structures which blend with the surrounding architectural theme. The
above mentioned measures, if implemented, would mitigate potential visual
impacts of the proposed projects.
2. Noise: The proposed pump stations (Project Nos. 3, 9 and ll) could
pote-~ially result in noise impacts on the surrounding community if
measures are not implemented to attenuate noise generated by the pumps.
Project Nos. 3 and 9 involve the construction of pump stations which will
be surrounded by urbanized property. These pump stations will be designed
to attenuate noise to no higher than 45 dB(A) CNEL, by utilizing mufflers
integrated into the pump design and block pumphouses. Thus, City of Chula
Vista noise standards would be met. Expansion of the Central Area Pump
Station (Project No. ll) will involve modification of piping and expansion
of the pumping capacity. Currently, no plans have been developed for
these modifications; therefore, potential noise impacts cannot be
determined. However, mitigation measures should be incorporated into
future design plans to ensure compliance with City of Chula Vista noise
standards.
3. Construction: Construction impacts as a result of project implementation
will be minimal and will not result in significant impacts to the existing
land uses and natural environment. Dust levels, which would be relatively
low, would be controlled by watering as required by development standards.
Noise levels from construction equipment could affect existing residents
adjacent to Projects Nos. 6 and 9 in the Southwest College Estates
community. However, the construction noise would be short tem in nature
and would not constitute a significant impact. Required measures, such as
limited work hours (7 a.m. to 6 p.m.) and equipment muffling, would reduce
levels of nuisance noise.
Traffic disruptions and detours would occur where water mains are
constructed below existing roadway surfaces. These disruptions and
detours would affect Rancho Janal Road, between Proctor Valley Road and

Otay Lakes Road, and Proctor Valley Road east of Rancho Janal Road.
However, these detours would have a very low potential for causing traffic
congestion or hazards due to the few cars that utilize the dirt roads.
the majority of the pipeline construction would be completed before
traffic would increase in EastLake due to buildout. No significant
impacts are anticipated from the temporary road alignments which would
last for 2 to 3 months.
4. Paleontology: There is a potential for encountering paleontological
resources in'certain areas of the site underlain by the Otay Formation.
Where trenching for pipelines would occur in areas cut by previous grading
activities and where reservoir and pump construction would require cutting
into the Otay Formation (Project Nos. 6 and 9), it is recommended that a
qualified paleontologist monitor initial grading and trenching activities
in order to avoid potential adverse impacts to subsurface resources.
5. Growth Inducement: A large portion of the proposed water system
improvements would serve property which is zoned, planned and approved for
development. However the provision and planning of water facilities to
accommodate surrounding areas will make future development of these areas
more feasible. The significance of this impact can only be defined in the
context of growth inducing impacts of the approved developments. The
water improvements are being provided as a result of project approvals.
Prudent planning requires that these system improvements be sized to
accommodate future development in order to avoid costly resizing of the
proposed system. The proposed water improvements will contribute
cumulatively, along withthe extension of other public services associated
with approved projects, to induce growth in the area; however, the
proposed project alone does not constitute a significant growth inducing
impact.

3. PUBLIC HEARING: PCS-86-1 - Consideration of tentative subdivision map
for EastLake Area R-13 (Villa Martinique) Chula Vista
Tract 86-1 - Barratt San Diego
A. BACKGROUND
The applicant has submitted a tentative subdivision map known as EastLake
Area R-13 (Villa Martinique), Chula Vista Tract 86-1 in order to develop a
25-1ot condominium project consisting of 232 units on 11.48 acres.
EIR-81-3 EastLake Master Environmental Impact Report and EIR-84-1 EastLake
I Sectional Planning Area SPA Plan have been prepared and address
environmental impacts of the proposed project.
B. RECOMMENDATION
l. Certify that EIR-81-3 and EIR-84-1 have been prepared in accordance
with CEQA (California Environmental Quality Act of 1970) and that the
Planning Commission has reviewed the information contained in each
EIR prior to making a decision on the project.
2. Based on the findings contained in Section "E" of this report, adopt
a motion recommending that the City Council approve the tentative
subdivision map for EastLake Area 13 (Villa Martinique), Chula Vista
Tract 86-1, subject to the following conditions:
a. Development of the lots shall comply with the plan conditionally
approved by the Design Review Committee (PCM-86-2).
b. The developer shall be responsible for the design and
construction of the loop street connecting the two access points
to accommodate a 15-mile per hour speed limit.
c. The structural section of all driveways, outside the public
right-of-way, shall be designed to meet flexible pavement
structural design criteria based on "R" values and a minimum
traffic index of 4 or, if Portland cement concrete, shall be
5-1/2" thick. All on-site paving including parking areas except
within carports will be inspected by the Engineering
Department. The design of the structural section shall be
reviewed and approved by the Director of Public Works/City
Engineer. Private drive construction is subject to review and
inspection fees.
d. The developer shall be responsible for the construction of two
alley-type driveways in accordance with City standards. A
construction permit is required to be obtained prior to approval
of Final Map.

e. The developer shall be responsible for the construction of the
public sewer system in accordance with City Standards. A
lO-foot wide sewer easement over said sewer lines shall be
granted to the City on the Final Map.
f. The developer shall be responsible for the construction of the
entrance to private street "A" to provide for a minimum of 15
feet driveway width on both sides of the proposed center island
curbs.
g. The developer shall be responsible for the relocation of the two
fire hydrants shown as existing adjacent to both entrances to at
least 5 feet away from the point of curb returns.
h. The developer shall enter into an agreement with the City
wherein developer agrees to the following:
(1) Pay his fair share of the cost of public improvements to be
provided under the "Public Financing Plan," Phasing Plan
and Development Agreement as needed for access.
(2) Not protest the establishment of a Facilities Benefit
Assessment District. Said District will allow the
developer to anticipate future reimbursement by other
benefitting parties.
i. The following shall be included as notes on the Final Map:
{1) Prior to the issuance of any building permits for
development within EastLake I, the following must occur:
(a) The City's requirements for schools must be satisfied.
(b) Needed off-site water improvements must be satisfied.
(c) Off-site roadway needs, as identified in the Public
Facility Financing Plan, must be guaranteed by a
financial mechanism such as a Facilities Benefit
Assessment or other appropriate financing technique.
(d) A purchasing agency concept to be implemented to
finance the reserve fund discussed in the Development
Agreement and Public Facilities Financing Plan.
(2) All lots created by this subdivision shall be placed under
the control of a single homeowners association, and shall
be subject to precise plan approval-thus precluding any
modifications thereto without prior City approval.
The developer shall include in the CC&Rs provision for
maintenance of private streets and parking areas.

k. The public streets abutting the project and the project's
internal private street system shall be paved prior to City
Council consideration of the Tentative Map.
Project Setting
The project site is identified as a multiple family lot {R-13) within the
EastLake Shores neighborhood of EastLake I Planned Community. The relatively
level site which is situated above the level of adjacent streets is located
east of the beach club and lake and across "C" Street. Adjacent proposed land
uses consist of a gas and electric transmission line easement to the east,
multiple family units (10 du's per acre) to the north, "C" Street and "D"
Street to the west and south respectively.
Planned Community District Regulations
Development standards for the property are contained in the EastLake I Planned
Community District Regulations. Many of the standards for the site in
question such as lot coverage and setbacks are listed as SP which means that
the issues are to be addressed at the site plan level. In this regard the
Design Review Committee on August 15, 1985, conditionally approved the site
plan and elevations for the project.
Project Description
The project involves the creation of 25 condominium lots served by a series of
private streets. The main access will be provided from "C" Street, with
secondary access from "D" Street. A total of 232 condominium units contained
in 48 two-story structures {130 two-bedroom and 102 one-bedroom or studio)
would be constructed on the lots and would be served by 232 covered and 182
uncovered parking spaces. A common recreation area with swimming pool and
recreation building is proposed along private street "A".
D. ANALYSIS
As noted above, the Design Review Committee conditionally approved the site
plan and elevations for the project on August 15, 1985. Conditions of
approval included the requirement that tot lot facilities be provided at a
minimum of two locations within the project, and that the CC&Rs contain a
provision prohibiting recreational vehicles from parking within the project.
The project complies with all of the City's standards for condominium
developments including storage and parking.
The applicant has not as yet submitted names for the public streets abutting
the project nor for the project's internal private street system. With the
concurrence of the Commission, we believe it would be appropriate in this case
to allow the map to go forward with the understanding that the streets will be
named prior to City Council consideration of the tentative map.

E. FINDINGS
Pursuant to Section 66473.5 of the Subdivision Map Act, the tentative
subdivision map for EastLake Area R-13 {Villa Martinique), Chula Vista Tract
86-1, is found to be in conformance with the various elements of the City's
General Plan based on the following:
1. The site is physically suitable for the residential development and
the proposal conforms to the adopted SPA plan and all standards
established by the City for such projects within EastLake.
2. The design of the subdivision will not affect the existing
improvements -- streets, sewers, etc. -- which have been designed in
conformance with the EastLake SPA plan to avoid any serious problems.
3. The project is in substantial conformance with the Chula Vista
General Plan Elements as follows:
a. Land Use - The EastLake SPA Plan designates the area for 15-25
dwelling units per acre, the project density of 20 dwelling
units per acre is within this range.
b. Circulation - The private streets proposed meet the internal
circulation needs of the project.
c. Housing - The project will provide higher density attached
housing and thus broaden the choice of housing types within the
EastLake I community.
d. Conservation - The project is located on a site which has
already been graded for development.
e. Park and Recreation, Open Space The project conform to the
EastLake SPA Plan which will result in the retention of over 100
acres of natural open space and approximately 150 acres in total
open space plus nearly 24 acres of park land.
f. Seismic Safety - The closest identified fault in the area is the
La Nacion Fault located over 2 miles to the west.
g. Safety - The site will be within an acceptable response time of
fire and police services.
h. Noise - The units will be required to meet the requirements of
the Uniform Building Code as regards to acceptable interior
noise levels.
i. Scenic Highway The project does not contain a designated
scenic route.

j. Bicycle Routes The streets within the project are not
designated bike routes but will accommodate bicycles. A bicycle
lane is being provided on the public loop street abutting the
subject subdivision.
k. Public Buildings - No public buildings are planned for the site.
4. Pursuant to Section 66412.2 of the Subdivision Map Act, the
Commission certifies that it has considered the effect of this
approval on the housing needs of the region and has balanced those
needs against the public service needs of the residents of the City
and the available fiscal and environmental resources.
