OF ENG CITY MANAGER ASSISTANT CITY ANAGER =,.--r- 4/5THS VOTE: YES D NO ~ SUMMARY On April 14,2010, the Director of Public Works received twelve (12) sealed bids for the "Safe Routes to School- Otay/Rice Elementary Schools CIP No. TF361, Federal Project No. SRTSL- 5203 (024)" Project. As part of the Federal Safe Routes to School (SRTS) Program, the work is intended to provide safer street crossings and consists of the reconstruction of the intersections of Albany Avenue with Montgomery and Zenith Streets, the installation of enhanced crosswalk improvements (including curb extensions directly in front of each school), pedestrian ramps, advanced warning traffic signals, and signage. The proposed action would award the contract to PTM General Engineering Services, Inc. and authorize the expenditure of available funds for completion of construction. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class I categorical exemption pursuant to Section 15301 (c) [Existing Facilities] of the State CEQA Guidelines. Additionally, the Environmental Review Coordinator has also reviewed the proposed project for compliance with the National Environmental Policy Act (NEPA) and has determined that the project qualifies for a Categorical Exclusion pursuant to Title 40, Part 1508.4 of the Code of Federal Regulations as implemented by the U.S. Department of Transportation Federal Highway Administration. DISCUSSION One of the primary purposes of the Federal Safe Routes to School (SRTS) Program is to provide safer street crossings along school pedestrian routes. The "Safe Routes to School - Otay/Rice Elementary Schools" project consists of the reconstruction of the intersections of Albany A venue with Montgomery and Zenith Streets, the installation of enhanced crosswalk improvements (including curb extensions directly in front of each school), pedestrian ramps, advanced warning traffic signals, and signage. On April 14, 2010, the Director of Public Works received twelve (12) sealed bids. The following table summarizes the bids received: CONTRACTOR BID AMOUNT 1. New Century Construction, Inc. - Lakeside, CA $337,406.20 10. RMV Construction, Inc. ~ San Diego, CA $339,912.55 11. MJC Construction, Inc. - Bonita, CA $347,571.00 12. ABC Construction Company, Inc. - San Diego, CA $406,637.00 The low bid submitted by PTM General Engineering Services, Inc. is $167,376 below the Engineer's estimate of $395,404, or approximately 42%; much of this difference can be attributed to the high degree of competition currently within the construction market. PTM General Engineering Services, Inc. has not yet performed work in the City of Chula Vista. However, staff verification of references revealed that their performance on other agencies' projects has been satisfactory. The Contractor's License No. 891265 is current and active. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority C'Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $18,962. Approval of tonight's resolution would increase the Director of Public Works' authority to approve change orders, as necessary, 7-2 5/11/10, ItemL Page 3 of 3 up to the contingency amount of $45,606, an increase of $26,644 over Policy No. 574-0l. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Disclosure Statement Attached is a copy of the contractor's Disclosure Statement as Attachment I. Wage Statement The sources of funding for this project are a grant from the Federal Safe Routes To School (SRTS) Program and Transnet. Contractors bidding this project are required to pay prevailing wages to persons employed by them for the work under this project. Disadvantaged businesses were encouraged to bid by sending "Notice to Contractors" to various trade publications. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. FISCAL IMPACT A breakdown ofthe project costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $228,028 B. Contingencies (20%) $45,606 C. Staff Time & Testing Costs $42,200 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $315,834 Sufficient funds are available in the TF361 project account to complete construction. ON-GOING FISCAL IMPACT Upon completion of the project, the improvements will reqUire only routine City Street maintenance. ATTACHMENTS I. However, staff has contacted the Project Engineer for the last three construction projects that this contractor has performed for local agencies and has found that PTM General Engineering Services, Inc. has performed the work satisfactorily; and WHEREAS, staff has reviewed the low bid and recommends awarding the contract to PTM General Engineering Services, Inc. of Riverside, California. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award the contract for the "Safe Routes to School-Otay/Rice Elementary School Project CIP No. TF36l, Federal Project No. SRTSL-5203(024)" to PTM General Engineering Services, Inc in the amount 01'$228,028.00. BE IT FURTHER RESOLVED, that the City Council of the City of Chula Vista does hereby waive Council Policy 574-01 and authorize the Director of Public Works to approve change orders, as necessary, up to the contingency amount of $45,606 and expend all available funds in the project.
