Return to the Article April 29, 2010 Still on Probation By Ruben Navanette SAN DIEGO -- It's a common case of mistaken identity -- and a running joke among upper middle-class Latinos. There are many stories, but here's just one. A Mexican-American friend of mine who is a corporate executive was mowing his lawn in an affluent and predominantly white neighborhood. He was unshaven and dressed in work clothes when a passerby complimented him on the landscaping job and asked for a business card. "What's the name of your company?" he asked. My friend smiled_and responded: tlSprint." Welcome to the club. You're not really Latino until you've been mistaken for the valet, the gardener, the nanny, etc. That's the gag. It's good for a laugh. Yet being profiled by your neighbor is one thing, and being singled out by law enforcement is another. And so no one is amused by what is unfolding in the Grand Canyon state. Arizona Senate Bill I 070 is ghastly legislation signed into law by Gov. Jan Brewer because she lacked the courage to stop the madness. It specifies: "For any lawf~l contact made by a law enforcement official... where reasonable suspicion exists that the person is an alien who is unlawfully present in the United States, a reasonable attempt shall be made, when pra~ticable, to determine the immigration status of the person." I I Note the clever word choice. In order 10 get the ball rolling, 'an officer need only establish "lawful contact." Misguided defenders of the legislation are desperately attempting to portray the law as consistent with how things have been done for years. They say that "lawful contact" means that the officer must have already pulled over a motorist or questioned him about a crime or infraction. The inference is that only people who break the law need worry about being asked for documents to prove they have the legal right to be in the United States. ' This is not so. Proponents spent months touting the bill because, they said, change is: necessary. And now that it's a law, they want to convince us that nothing has changed. Then why pass a law in the first place? Also, "lawful contact" is simply the opposite of "unlawful contact." A police officer passing someone on the street and saying "Good morning" is lawful contact. And from that point, it's game on. What do you suppose the chances are that people with blond hair, fair skin and blue eyes will raise reasonablc suspicions? Conversely, how many native-born Latinos will be hassled, inconvenienced and unlawfully detained? This law is a reality check for all Latinos. It's a helpful reminder that -- as hard as we work, as much as we accomplish and progress -- we are, by virtue of skin color or accent or Spanish surname, still on probation as far as some people are concerned. And we will be for life. Even as a Mexican-American who was born in the United States with a family whose roots in this country can be traced to the 19th century, to some of my countrymen I'm just one step removed from an illegal immigrant who arrived herc from Mexico last week. Some readers even marvel at how wclll've learned English since arriving here. I suppose they mean from my native Central California. We might be Rhodes scholars, federal judges, governors, FBI agents or Medal of Honor recipients and yet we're just one short phrase away from being put in our place and forced to prove that we belong here. The phrase: "reasonahle suspicion." This law is also a different sort of reality check for everyone else. It clears up a mystery. Many Americans have long been baffled by the fact that Latinos who have the right to be in the United States - - whether they are native-born citizens or here legally -- will often interfere with efforts to harass, round up and remove illegal immigrants. Some of them want to know: "What's this to you?" Others -~ in a tune familiar to American Jews -- accuse the obstructionists of having "divided loyalties." StiJJ others assume it's simply because these Latinos must have "relatives who are illegal." Now you know the real reason. Look at Arizona. To some people, we're all the same. Fine. In that case, this isn't some someone else's fight. This is ours. The notion that the first thing to do is "secure the border" between the United States and Mexico n and only then worry about comprehensive immigration reform n falls somewhere between hopeful fantasy and cynical cop-out. It's a good sound bite but would be a ridiculous policy. There has been much sound and fury about Mexico's rampant drug violence spilling over into the United States n much of it wrong, at least as far as Arizona is concerned, Sen. John McCain, who should know better, said recently that failure to secure the border "has led to violence n the worst I have ever seen." Gov. Jan Brewer said she signed the state's outrageous new law because of "border-related violence and crime due to illegal 'immigration." But law enforcement Fact-based analysis is increasingly out of fashion, however, and so the border-first hallucination has become popular among politicians and pundits reacting to Arizona's new "breathing while Latino" law. The measure, which has sparked angry protests nationwide, orders police to act on "reasonable suspicion" in identifying, arresting and jailing undocumented immigrants. Anyone who thinks such extremism could be quelled if the federal government would just "secure the border" really ought to visit Arizona and take a look. Undocumented migrants already find ways to overcome daunting and potentially deadly obstacles, and it would take a lot more than rhetoric to make the border truly "secure." Roy Bermudez, assistant police chief of the border city of No gales, told the Arizona Republic that "we have not, thank God, witnessed any spillover violence from Mexico." The newspaper reported -- citing figures from FBI crime reports and local police agencies -- that crime rates along the border have been "essentially flat for the past decade." Violent crime is down statewide, as it is nationally. It should be pointed out there wouldn't be any drug-related violence along either side of the border if Americans would curb their insatiable demand for illegal drugs. It also bears noting that the Mexican drug cartels procure their assault weapons on the U.S. side of the border, where just about anyone with a pulse can buy a gun. An attempt to design a high-tech "virtual" fence using sensors and cameras has not gone welL The equipment has not becn able to discern people from wildlife. And even if there were a system that could alert authorities whenever an illegal immigrant had stepped onto U.S. soil, how would authorities find him or her in the vast wilderness? Still, it's hard to argue, in principle, against making every effort to lock down the border. The problems come in figuring out how to translate principle into practice. It would be possible to build a 2,000- mile-long Berlin Wall, complete with watchtowers. But it would be stupid and counterproductive. Phoenix Mayor Phil Gordon, who is seeking approvallo sue the state to overturn the new law, told me on Monday that the only solution is comprehensive reform that provides a path to citizenship for undocumented immigrants already settled here, a legal way for temporary workers to come and go, and increased quotas for Mexicans who want to immigrate permanently. The answer is not a bigger wall. And the answer surely is not Arizona's shameful new law, which, Gordon said, "doesn't do one thing but make our city less safe."
