HomeMy WebLinkAboutPlanning Commission Minutes 2009/04/08MINUTES OF THE PLANNING COMMISSION OF THE CITY OF CHULA VISTA Council Chambers 6:00 p.m. 276 Fourth Avenue April 8, 2009 Chula Vista, California CALL TO ORDER: ROLL CALL /MOTIONS TO EXCUSE: Members Present: Members Absent: INTRODUCTORY REMARKS ORAL COMMUNICATIONS: Tripp, Felber, Spethman, Vinson, Thompson Clayton, Moctezuma Read into the record by Chair Tripp 6:07:35 PM Carl Higgins, representing Underground Technologies gave a presentation on plastic manholes and stated that plastic manholes are superior to concrete manholes because they don't leak, corrode, are less expensive than concrete and have approximately a 100-year life expectancy. He indicated he would be giving this same presentation before the City Council. CONSENT AGENDA: None. 1. Public Hearing: GPA 04-02; Consideration of an amendment to the City of Chula Vista's General Plan to change the land use designation on 46 acres from Limited Industrial to 39.3 acres of Residential Medium High (11-18 du/ac?) and 6.7 acres of Open Space. Applicant: ACI Sunbow, LLC. 6:17:50 PM Staff recommends public hearing be continued to a date certain on May 13, 2009. MSC (Vinson/Spethman) (5-0-0-2) to continue public hearing to a date certain on May 73, 2009. Motion carried. 2. Public Hearing: Consideration of the following applications filed by Efrain Mascareno for a one-story 1,857 square-foot office building located at 440 Fourth Avenue. a. PCZ 09-01; Rezone application to change the zone from Multi-Family Residential to Commercial Office. Minutes of the Planning Commission -2- April 8, 2009 b. ZAV 09-03; A Variance application requesting approval of a 10-foot encroachment for the office building into the required rear setback. Chair Tripp asked for clarification as to why this item was delivered to the Commission in two segments on separate days and stated that if any Commissioner felt they didn't have sufficient time to adequately review the materials, he would entertain a motion to continue the item or move forward with hearing the item tonight. MSC (TrippNinson) (5-0-0-2) that the Planning Commission hear this item tonight. Motion carried. Background: Caroline Young reported that the proposal is to change the property from Multi-Family Residential (R-3) to Commercial Office (CO) zone in order to be consistent with the change in designation that occurred with the General Plan Update in December 2005. The requested rezone requires City Couneil approval following a recommendation by the Planning Commission. A Variance application has also been filed to allow a setback encroachment of a proposed office building into the required rear setback. The project proposes the demolition of existing buildings to construct aone-story 1,857 sf office building, including on and off-site improvements, paved parking lot, lighting, and landscaped treatment. The Design Review Board approved the project on March 16, 2009 and the Environmental Review Coordinator determined that the rezone was covered under the General Plan Update EIR 05-01 Staff Recommendation: That the Planning Commission: 1.) adopt Resolution PCZ 09-01 recommending that the City Council approve the zone change from Multi-Family Residential (R3) to a Commercial Office (CO) zone; and 2.) adopt Resolution ZAV 09-03 allowing the office building to encroach into the rear setback, based on the findings and subject to the conditions contained in the Planning Commission Resolution . Public Hearing Opened and Closed. 6:43:34 PM MSC (Spethman/Felber)(5-0-0-2) that the Planning Commission adopt Resolution PCZ 09-01 recommending that the City Council approve the zone change from Multi-Family Residential to a Commercial Office zone. Motion carried. MSC (Felber/Thompson) (5-0-0-2) that the Planning Commission adopt Resolution ZAV 09-03 allowing the office building to encroach into the rear setback, based on the findings and subject to the conditions contained in the Planning Commission Resolution . Motion carried. Minutes of the Planning Commission -3- April 8, 2009 Director's Report: Director Halbert updated the Commission on the No Right Turn On Red sign at the corner of Bonita Road and Otay Lakes Road and stated that it was installed because of pedestrian accidents that have occurred. To make this a safer crosswalk, the advance walk indicator goes on before the green traffic light goes on for parallel vehicular traffic. Commission Comments: Cmr. Vinson announced that the Chamber of Commerce Economic Development Committee will be meeting with developers, business people and staff to begin round-table discussions on ways to improve and streamline the development entitlement process. 6:50:29 PM Cmr. Felber stated that the Olympic Training Center banners on light poles along Olympic Parkway are tattered and weather-beaten. He recommended that if they can't be replaced because of budget constraints, they should at least be brought down because it gives the City a bad image. 6:55:20 PM Mike Shirey cautioned that a majority of 4 or more commissioners in attendance at the Chamber of Commerce meeting could potentially be in violation of the Brown Act. 6:58:37 PM Adjourned to a Regular Planning Commission meeting on April 22, 2009.
