The work to be done consists of the removal and replacement of existing sewer pipe and sewer manholes, and other miscellaneous work to complete the project. The proposed action would award the contract to Cass Construction and authorize the expenditure of all available funds, if necessary, for completion of construction. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 2 (c) categorical exemption pursuant to Section 15302 (Replacement or Reconstruction) of the State CEQA Guidelines because the project consists of replacement of existing sewer lines with no expansion of sewer capacity. Thus, no further environmental review IS necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. 10-1 4/13/10, Item~ Page 2 of 3 DISCUSSION The G Street Sewer Improvement project involves the rehabilitation of approximately 2,600 lineal feet of deteriorated sewer pipes, sewer laterals connections, and removal and replacement of existing sewer manholes. On March 10, 2010, the Director of Public Works received twelve (12) bids for the "G Street Sewer Improvements, between Fourth Avenue and Second Avenue (SW251)" Project. Burtech Pipeline - Encinitas, CA $682,020.00 7. SC Valley Construction - EI Cajon, CA $696,185.00 8. Scheidel Contracting and Engineering - La Mesa, CA $779,436.00 9. Palm Engineering - San Diego, CA $795,970.00 10. Southland Paving - Escondido, CA $829,700.00 11. Young and Associates - Pasadena, CA $996,300.00 12. Schilling Paradise - EI Cajon, CA $1,057,710.00 The low bid submitted by Cass Construction is below the Engineer's estimate of $993,850 by $541,754, or approximately 54 'Yo; much of this difference can be attributed to the high degree of competition currently within the construction market; Cass Construction has satisfactorily completed previous City projects of a similar nature. The ContractQr's License No. 298336 is current and active. The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $34,647. Approval of tonight's resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $90,420, an increase of $55,773 over Policy No. 574-01. Increasing the contingency funds will allow staff to continue the proj ect without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Disclosure Statement Attached is a copy of the contractor's Disclosure Statement as Attachment 1. 10-2 4/13/10, Item ~ Page 3 of 3 Wage Statement The source of funding for this project is Sewer Facility Replacement Fee Fund. Contractors bidding this project are not required to pay prevailing wages to persons employed by them for the work under this project. Disadvantaged businessys were encouraged to bid by sending "Notice to Contractors" to various trade publications. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties, which are the subject of this action. CURRENT YEAR FISCAL IMPACT A breakdown ofthe project construction costs is as follows: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $ 452,096 B. Contingencies (20%) $ 90,420 C. Staff Cost (Construction Inspection, Survey, Design) $ 98,800 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $641,316 Sufficient funds are available in the SW25l project account to complete construction. ON-GOING FISCAL IMPACT Upon completion of the project, the improvements will require only routine City maintenance. ATTACHMENTS I. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award the contract for the "G Street Sewer Improvement Project, between Fourth Avenue and Second Avenue (SW251)" to Cass Construction in the amount of$452,096. 10-6 BE IT FURTHER RESOLVED, that the City Council of the City of Chula Vista does hereby waive Council Policy 574-01 and authorize the Director of Public Works to approve change orders, as necessary, up to the contingency amount of $90,420 and expend all available funds in the project.
