SUMMARY
On March 24,2010, the Director of Public Works received sealed bids for the "Pavement Major
Rehabilitation (Overlay)" (STL345) project. The work consists of the removal and replacement
of failed asphalt concrete pavement (dig-outs), AC pavement overlay, and pedestrian ramp
improvements within various streets in the city. Work on this project also includes cold milling,
replacement of traffic signal loop detectors, traffic control, striping and marking, and other
miscellaneous items of work necessary for the project. The proposed action would award the
contract to Frank and Son Paving, Incorporated.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class l(c) categorical exemption pursuant to Section 15301, Existing Facilities, of the State
CEQA Guidelines. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
The Public Works Department, through implementation of the Pavement Management System
(PMS), has developed a priority list of streets requiring rehabilitation. When properly
implemented, the program will extend the roadway life and serviceability through the removal
and replacement of deteriorated sections of pavement (dig-outs) and the application of various
types of surface treatments, including asphalt concrete overlays, chip seals, and rubberized slurry
seals.
This project will dig-out deteriorated pavement and then overlay the pavement surface, resulting
in a significant increase in pavement service life. Attachment 1 shows the list of streets to
receive the AC overlay surface treatment.
On March 24,2010, the Director of Public Works received eleven (11) bids for the "Pavement
Major Rehabilitation (Overlay)" (STL345) project. The following bids were received:

PAL General Engineering Incorporated ("PAL") of San Diego, California, submitted the
apparent low bid proposal in the amount of $968,496.50. However, during the review of the bid
proposal, staff determined that PAL's bid package was incomplete in that they had

acknowledged receiving Addendum #1, but did not submit a Traffic Control Form as required by
the addendum. Therefore, PAL's bid proposal is deemed to be non-responsive; PAL also had a
minor $550 mathematical error in their bid proposal. Staff recommends that PAL's bid be
rejected. Staff then reviewed the apparent second low bid proposal in the amount of
$981,643.25, submitted by Frank & Son Paving, Incorporated of Chula Vista, California and
determined that Frank & Son had satisfied all requirements.
The bid submitted by Frank and Son Paving, Incorporated of Chula Vista, CA is below the
Engineer's estimate of $1,182,670.35 by $201,027.10 (or approximately 17% below the
Engineer's estimate); much of this difference can be attributed to high degree of competition
currently within the construction market. Design staff has verified the references provided by
the contractor and has found their work to be satisfactory; in addition, the contractor has
performed satisfactorily on previous City contracts. The Contractor's License No. 612545 is
current and active.
If approved, the proposed resolution would increase the Director of Public Works' cumulative
change order authority specified in City Council Policy No. 574-01 and authorize the Director of
Public Works to expend all available funds, as necessary and without further City Council action,
in order to complete all work required in accordance with City standards and to account for
increases or decreases in unit quantities.

Wage Statement
The source of funding for this project is TransNet. Contractors bidding this project are not
required to pay prevailing wages to persons employed by them for the work under this project.
Disadvantaged businesses were encouraged to bid through the sending of the Notice to
Contractors to various trade publications.
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision
concerns repairs, replacement, or maintenance of existing streets or similar facilities and,
therefore, there is not a material financial effect of the decision on the property holdings of the
City Council Members pursuant to California Code of Regulations sections 18704.2(b)(2) and
18705.2(b)(1).

WHEREAS, City staff prepared specifications for the "Pavement Major Rehabilitation
(Overlay) (STL345)"and advertised the project on March 5, 2010; and
WHEREAS, on March 24, 2010, the Director of Public Works Engineering received
eleven (11) sealed bids for the project as follows:

WHEREAS, the apparent low bid submitted by PAL General Engineering Incorporated
of San Diego, CA in the amount of $968,496.50 was deemed to be an incomplete upon review of

the bid proposal; specifically, a Traffic Control Form as required in Addendum #1 was not
submitted and a minor mathematical error was noted; and
WHEREAS, staff reviewed the second low bid proposal in the amount of $981,643.25
submitted by Frank & Son Paving, Incorporated of Chula Vista, CA; and
WHEREAS, the bid submitted by Frank & Son Paving, Incorporated is below the
Engineer's estimate of $1,182,670.35 by $201,027.10 (17%). Staff has verified the references
provided by the contractor and determined them to be satisfactory; in addition, the contractor has
performed satisfactorily on previous City contracts.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids and award contract for the "Pavement Major Rehabilitation
(Overlay) (STL345)" project to the second lowest bidder, Frank & Son Paving, Incorporated, in
the amount of$981,643.25.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby authorize the Director of Public Works to spend all available funds, as necessary, in order
to complete all work required in accordance with City standards and to account for increases or
decreases in unit quantities.
