PUBLIC HEARING: PCZ-83-C - Request to rezone approximately one acre on the south side of Kearney Street between Third and Church Avenues from C-C and R-3-D to C-O - Califo,'nia Health Plan, Inc. A. BACKGROUND 1. The applicant is requesting a change of zone for approximately one acre of property located on the south side of Kearney Street between Third Avenue and Church Avenue from C-C and R-3-D to C-O. 2. An Initial Study IS-83-12 of possible adverse environmental impacts of the project was conducted by the Environmental Review Committee on November 24, 1982. The Committee concluded that there would be no significant environmental effects and recommended that the Negative Declaration be adopted. B. RECOMMENDATION 1. Find that this project will have no significant environmental impacts and adopt the Negative Declaration issued on IS-83-12. 2. Adopt a motion recommending that the City Council adopt an ordinance amending the Building Line Map establishing a 10-foot setback along Third Avenue and Kearney Street frontages of the subject properties. 3. Based on the findings of Section E of this report, adopt a motion recommending that the City Council approve a change of zone for the subject property from C-C and R-3-D to C-O-P subject to the following development standards. a. The six parcels shall be consolidated into one lot by either an adjustment plat or parcel map prior to the issuance of a building permit. b. The building setback from Church Avenue shall be as follows: l) One story (16 feet maximum) - 20 feet 2) Two stories (25 feet maximum) - 30 feet 3) Three or more stories (45 feet maximum) - lO0 feet c. Access shall be limited to Third Avenue and Kearney Street unless otherwise approved by the City Traffic Engineer. d. DISCUSSION 1. Adjacent zoning and land use North C-O & R-1 Beauty salon and duplex South C-C & R-3 Restaurant on Third Avenue and single family dwellings on Church Avenue East R-1 Single family dwellings West C-C Post Office 2. General Plan designation The subject property is designated on the General Plan as Professional and Administrative Commercial. The adjacent designations are as follows: North Professional & administrative commercial South Professional & administrative commercial and retail commercial East Medium density residential, 4-12 DU's per acre West Retail commercial 3. Existing site characteristics a. The project site consists of 6 parcels containing approximately one acre of level property located on the south side of Kearney Street between Third and Church Avenues. The three parcels along Third Avenue are zoned C-C and the three parcels on Church Avenue are zoned R-3-D. b. The commercially zoned properties are developed as follows: Southerly lot - Dental office within a converted single family dwelling. There is a driveway located at the southwesterly corner. Center lot - Medical clinic (single story). Northerly lot - Former drive-through restaurant which has been used recently as a campaign office. There are two driveways on Third Avenue and one on Kearney Street at the east end. c. The three parcels along Church Avenue have been utilized as parking lot for the medical clinic on Third Avenue for a number of years. There are two existing driveways on Church Avenue and one on Kearney Street. 4. Proposed development The applicant has submitted a schematic development plan which proposes a new 4,280 sq. ft. single story medical office on the northerly parcel on Third Avenue. The parking lot will be restriped and landscaped to City Planning Commiss. Agenda Items for Meeting of December 8, 1982 Page 3 provide parking for approximately 45 spaces. The existing driveways serving the parking lot on Church Avenue are to be widened. All other driveways are proposed to be closed. The proposed revisions do not include the two southerly commercial lots on Third Avenue. D. ANALYSIS 1. General Plan consistency The proposed C-O zoning is consistent with the professional and administrative commercial land use designation of the General Plan. Therefore, the change of zone is appropriate. 2. Precise Plan modifying district a. Even though the applicant has submitted a schematic development plan showing a new one-story medical office to be located on the northwest corner of the property, the basic underlying zone {C-O proposed) would allow a structure up to 45' in height to be located adjacent to Church Avenue unless the precise plan modifying district is attached and development standards established regulating setbacks and height. b. Because the proposed rezoning will result in commercial uses abutting a residential area, it is recommended that the precise plan district be attached to the C-O zoning to ensure that the future development of the property will not adversely affect and impact the single family area by the adoption of appropriate development standards. The standards should be limited to building setbacks, access, and building heights. 3. Front setbacks Except for the frontage along Kearney Street of the parcel located at the southeast corner of Third Avenue and Kearney Street, the front setbacks are governed by the Chula Vista Building Line Map and can only be changed by adopting an ordinance amending the Building Line Map. The established setbacks are; l) along Third Avenue - 5 feet; 2) along Church Avenue - 20 feet; and 3) along Kearney Street {easterly 135.21 feet) - 15 feet. E. FINDINGS The 'P' Precise Plan modifying district may be applied to areas within the City when one or more of the following circumstances are evident. 1. The property or area to which the 'P' modifying district is applied is an area adjacent and contiguous to a zone allowing different land uses, and the development of a precise plan will allow the area so designated to coexist between land usages which might otherwise prove incompatible. The proposed rezoning represents encroachment of commercial uses into a residential area which requires the attachment of the 'P' district to ensure that the different land uses can coexist and be compatible with the neighborhood. The underlying zone regulations do not allow the property owner and/or the City appropriate control or flexibility needed to achieve an efficient and proper relationship among the uses allowed in the adjacent zones. The attachment of the 'P' district is needed to establish development standards relating to setbacks, building heights and circulation. PROJECT LOCATION: Southeast corner Third Avenue and Kearney Street PROJECT APPLICANT: California Healthplan, Inc. 3180 University Avenue San Diego, CA 92104 CASE NO. IS-83-12 DATE: November 24, 1982 A. Project Setting The project site consists of approximately 1.04 acres located on the south side of Kearney Street between Third Avenue and Church Avenue. The project site contains a structure currently being used as an office and formerly used as a fast food restaurant at. the corner of Third Avenue and Kearney Street, a medical office and a dental office. A parking lot exists on the remainder of the lot oriented to Kearney Street and Church Avenue. Adjacent land uses include single family dwellings located to the east and to the south on Church Avenue, residential uses and a beauty salon to the north. The post office is located to the west across Third Avenue and a card room and restaurant are to the south. There are no significant natural resources on the site, nor are there any historical or prehistorical resources known to be present. No geologic hazards are known to exist within the project vicinity. B. Project Description The applicant proposes to construct a 4,280 sq. ft., one story medical office building at the southeast corner of Third Avenue and Kearney Street. Twenty-four parking spaces are existing to the east of the proposed structure site for adjacent medical offices. The applicant proposes improving this area to provide an additional 21 parking spaces for proposed offices. In addition, the applicant proposes to rezone the property fronting on Church Avenue from B-3-D (multiple family subject to design control) to C-O (commercial office) and the property fronting on Third Avenue from C-C (central commercial) to C-O. C. Compatibility with Zoning and Plans The proposed structure is compatible with both the present zoning (C-C) and proposed zoning (C-O) and the parking area would require approval of a conditional use permit or rezoning in order to accommodate the additional parking spaces as required. The project is compatible with the General Plan and associated elements. D. Identification of Environmental Effects The City's Traffic Engineer has indicated that while it is undesirable to promote commercial traffic on a residential street, the traffic impact from the city of chula vista planning department l~l~ · environmental review lectlon proposed project will not result in a significant adverse environmental impact on any of the surrounding residential or commercial streets. E. Findings of Insignificant Impact l. The project area is generally void of any significant wildlife or vegetation and there are no geologic hazards known to exist in the i~ediate area. 2. The proposed rezoning and medical offices are in conformance with the General Plan and associated elements. The project will not achieve short term gains to the disadvantage of long term and environmental goals. 3. There are no impacts anticipated to interact and cause any substantial cumulative effect on the environment. 4. The project will not create any source of significant noise nor will any hazards to human beings result. F. Review of conditional use permit PCC-82-12 for a cardroom (Xanadu Clubs, Inc.) at 4088 Bonita Road A. BACKGROUND 1. In February 1982 the Planning Commission approved a conditional use permit, PCC-82-12, for the establishment of a ladies gaming parlor offering card games (Xanadu Clubs, Inc.) within the Bonita Village shopping center at 4088 Bonita Road. The approval was based on the condition that the business be reviewed in six months to determine if the use was compatible with the adjacent uses and if any additional conditions should be placed on the permit. 2. Since the opening of the gamin§ parlor in March, the City has not received any complaints and the Police Department has reported no problems. Although the building spaces on either side of the club are vacant, the Department contacted nearby business operators who indicated that the gaming parlor is a very quiet operation and does not affect their business environment. Discussion of Land Use Chart A. BACKGROUND 1. On November 17, 1982 the Planning Commission conducted a workshop on the proposed revisions to the adopted Land Use Chart. At the workshop a number of changes were suggested by the Commission, including the expansion of approximately 52 additional commercial uses in the C-N (Neighborhood Commercial) zone for the purpose of providing additional services to the residents in the immediate area. 2. The concerns expressed by the Commission have been incorporated into the revised Land Use Chart. The purpose of this meeting is to determine if there are any additional concerns or suggestions on the part of the Planning Commission before bringing the revised Land Use Chart forward for adoption. 3. The Planning Department will continue to assess the land uses added to the C-N zone to determine if they should be limited in scope and size as well as any other restrictions which should be placed on the land use. B. RECOMMENDATION Review the proposed revisions to the Land Use Chart and direct the Planning Department to schedule the Land Use Chart for adoption after incorporating any suggested changes.
