SUMMARY
On February 10, 2010, the Director of Public Works received six (6) sealed bids for the "Upgrade of
Traffic Signal Intersections (TF360A) Federal Project No. HSIPL 5203 (025)" Project. This project
is included in the FY200SIFY2009 Capital Improvement Program budget to provide upgrade and
repair to existing traffic signal equipment at approximately 31 major intersections. Project TF360A,
Phase 1 will upgrade IS of these 31 traffic signal intersections. The proposed resolution rejects the
first and second apparent low bidders as non-responsive due to bid irregularities and awards the
contract to the third lowest bidder, PTM General Engineering Services, Inc., in the amount of
$261,261 and authorizes an inter-project transfer from project TF366, 'Traffic Signal and
Streetlight Systems Upgrade and Maintenance Program," to TF360. The transfer is necessary to
perform maintenance work (i.e., replacement of existing LED indications) not authorized under the
Federal grant. All other work on both phases of the project is Federally reimbursed at a rate of 90%,
up to a maximum of$900,000.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1 categorical exemption pursuant to Section 15301 (Existing Facilities) of the State
CEQA Guidelines because the proposed traffic signal modification work and pedestrian ramp

construction involves negligible or no expansion of an eXisting use. In addition, the
Environmental Review Coordinator has reviewed the proposed project in conjunction with the
California Department of Transportation (Caltrans), the State department designated as lead
environmental agency by the U.S. Department of Transportation, Federal Highway
Administration for Federally funded street projects. It was determined that the project qualifies
for a categorical exclusion pursuant to 23 CFR 771.1 j 7(d); activity:(d)(2) [Highway Safety or
Traffic Operation Improvements]. Thus, no further environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
This is a Federally assisted project under the Safe Accountable Flexible Efficient Transportation
(SAFETEA-LU) - Highway Safety Improvement Program (HSIP) Program. Staff submitted an
application for authorization and received preliminary engineering authorization in year 2007.
There are 31 High-Priority Intersections citywide included in this project and listed in the
Caltrans 2006/2007 Highway Safety Improvement Program (HSIP). The work, as listed,
includes upgrade oftraffic signals, pavement markings, pavement delineation, and improvements
to bicycle and pedestrian facilities citywide. Out of the 31 intersections, there are 10
intersections that need major traffic signal modifications, including new pedestrian ramps and
will be constructed in Phase 2 of the TF360 project. The remaining 21 intersections originally
identified in the grant application involve minor traffic signal modification work, which is
included in this phase of the project. However, Phase 1 consists of signal modification work at
only 18 of the 21 intersections because three intersections have already been completed either by
City forces or were included in other City projects.
Project Design staff prepared specifications and advertised the project on January 22,2010. On
February 10, 2010, the Director of Public Works received six (6) bids. All proposals were
contingent upon a base bid submittal and proper completion and submittal of required Federal,
State, and local documents. Staff carefully analyzed the six (6) bids submitted. The bids ITom

Due to the need to strictly adhere to Federal Government and the State of California guidelines in
order to avoid the potential for loss of funding, several contractors must be declared non-
responsive. Any errors (due to accounting or incorrect documentation) can jeopardize the
integrity of the City agreement with mentioned entities, particularly since, in this case, one of the
bidders was completely responsive to the bid request. Thus, the submitted bid package by PTM
General Engineering Services, Inc. of Riverside, California meets all of the requirements
identified within the contract documents and Addendum 1. The bid submitted by PTM General
Engineering Services, Inc. of$261,261 is below the Engineer's estimate of $277,795 by $16,534,
or approximately 6%. This contractor has not previously worked for the City; however, staff
conducted a detailed reference check and all references were deemed to be satisfactory. Staff has
reviewed the contractor's bid package and recommends awarding the contract to PTM General
Engineering Services, Inc. Riverside, CA in the amount of $261 ,261.

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the properties, which are the subject of this action.
CURRENT YEAR FISCAL IMPACT
Breakdown of the budget and cost is as follows:

With the inter-project transfer of $62,090 for the replacement of existing LED indications from
the TF366 traffic signal upgrade and maintenance project, sufficient funds would be available in
the TF360 project account to complete construction of this phase of the Project. The contractors
who bid on this project are required to pay prevailing wages to persons employed by them for the
work performed under this project.

ON-GOING FISCAL IMPACT
Upon completion of the project, the improvements will reqUIre only routine traffic signal
maintenance.

WHEREAS, staff rejects the first and second apparent low bidders as non-responsive due
to bid irregularities and awards the contract to the third lowest bidder, PTM General Engineering
Services, Inc., in the amount of $261 ,261; and
WHEREAS, the bid submitted by PTM General Engineering Service, Inc. of $261,261 is
below the Engineer's estimate of $277,795 by $16,534, or approximately 6%; and
WHEREAS, staff has contacted the Project Engineer for the last three construction
projects that this contractor has performed for local agencies and has found that PTM General
Engineering Services, Inc. has performed the work satisfactorily; and
WHEREAS, staff has reviewed the low bid and recommends awarding the contract to
PTM General Engineering Services, Inc. of Riverside, California.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby reject the bids of the first and second apparent low bidders as non-responsive
and award the contract to the third lowest bidder for the "Upgrade of Traffic Signal Intersections
in the City of Chula Vista, California, (TFf360A) Federal Project No. HSIPL 5203 (025)"
Project to PTM General Engineering Services, Inc. in the amount of$261,261, and authorize an
inter-project transfer in the amount of $62,090 from the TF366 Project to TF360.
