" ioN< (J RESOLUTION NO. 10438 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING DEVELOFMENT PLAN FOR PORTION OF NORTH COLLEGE SECTIONAL PLANNING AREA The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, Ordinance No. 1824, adopted by the City Council on August 15, 1978, adopted a new Specific Plan/General Development Plan for the P-C zone of El Rancho del Rey, which established Sectional Planning Areas, and WHEREAS, a development plan for four acres located at the southeast corner of the North College Sectional Planning Area was filed with the Planning Department by Ray Huffman Construction Co., and WHEREAS, a hearing was held before the Planning Commission on March 25, 1981 to consider said development plan and the Commission recommended that the City Council approve the development plan subject to the conditions set forth in their Resolution No. PCM-81-8. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the development plan for a portion of the North College Sectional Planning Area of the El Rancho del Rey Specific Plan in accordance with Planning Commission Resolution No. PCM-81-8. PCS-BI-5 " Kt.;)ULUI1UI'i l"lU. t'L.rl-OI-O RESOLUTION OF THE CITY PLANNING COM~ISSION RECOMMENDING TO THE CITY ,COUNCIL THE APPROVAL OF DEVELOPMENT PLANS FOR FOUR ACRES LOCATED IN THE NORTH COLLEGE SECTIONAL PLANNING AREA OF THE EL RANCHO DEL REY SPECIFIC PLAN WHEREAS, Ordinance No. 1824, adopted by the City Council on August 15, 1978, adopted a new Specific Plan/General Development Plan for the P-C zone of El Rancho del Rey, which established Sectional Planning Areas, and ImEREAS, a development plan for four acres located at the southeast corner of the North College Sectional Planning'Area was filed with the Planning Department by Ray Huffman Construction Co., and WHEREAS, the City Planning Commission set the time and place for a public ~earing to consider said development plan and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., March 25, 1981, in the Council Chambers, Public Service Building, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and ~IHEREAS, the Planning Commission found that the project will have no significant 'environmental impact and adopted the Negative Declaration on IS-81-27. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds: a. The proposed sectional planning area plan is in conformity with the general development plan of the P-C zone, any adopted specific plans, and the Chula Vista general plan and its several elements: The 60 units on the four acres falls within the density range of 11 to 18 dwelling units per acre as designated on the El Rancho del Rey Specific Plan. The split level construction will minimize the amount of grading and is in keeping with the goals and objectives of the El Rancho del Rey plan. b. The proposed sectional planning area plan would promote the orderly, sequentialized development of the involved sectional planning area: The subject property is located at the easterly edge of the sectional planning area and will not interfere with the orderly development of the remainder of the sectional planning area. c. ,The proposed sectional planning area plan would not adversely affect adjacent land use, residential enjoyment, circulation, or environ- menta 1 qual i ty: I Cf{) t " . The Plannin~ Commission recommends to the City Council that the development plan for four acres located at the southeast corner of the North College Sectional Planning Area of El Rancho del Rey be approved, subject to the following conditions: a. The development shall be subject to the regulations of Chapter 19.27 of the Municipal Code governing the R-3 zone. b. The type, color and location of the textured paving shall be shown on the landscape plan and any other plans for the installa- tion of paving and shall be subject to the approval of the City Landscape Architect. c. The developer shall use wood stains which are "color fast" and will not run when exposed to the elements. .d. The developer shall comply with those mitigation measures outlined in the Negative Declaration on IS-81-27 pertaining to the develop- ment. 3. That this resolution be transmitted, along with the proposed development plan to the City Council, and a copy of this resolution be transmitted to the applicant. PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA, this 25th day of March, 1981 by the following vote, to-wit: AYES: Commissioners Stevenson, O'.Neill, G.
