Consideration of request for vacation of Open Space Maintenance Easement in Lots 44 through 56, Rancho Robinhood Subdivision A. BACKGROUND 1. No access is available to this open space easement and each adjacent homeowner maintains the portion of it adjacent to the rear of his lot. The owners were notified of the City's intent to vacate this easement over a year ago. 2. The request is categorically exempt from environmental review as a Class 5-c exemption. B. RECOb94ENDATION Based on the findings contained in Section D of this report, adopt a motion recommending that the City Council approve the vacation of the subject Open Space Maintenance Easement. C. ANALYSIS 1. The easement is not being used. Each homeowner maintains the portion of the easement at the rear of his lot on an individual basis. 2. No benefit accrues to the public because of this easement since there is no physical or visual access to it from public areas. 3. No irrigation facilities can be provided without acquisition of a suitable easement from Surrey Drive. D. FINDINGS The Engineering Division has reviewed the request for this proposed vacation and recommends approval based on the following findings. 1. Vacation of the easement will allow full utilization of the property. 2. No detriment to the public will result from the vacation of this easement. 3. Consideration of final EIR-79-6 for Bay Boulevard Redevelopment Project A. BACKGROUND The public hearing on the draft of this EIR was held on December 27, 1978. No public testimony requiring a response was presented, however, several letters of comment were received. Those comments and a response developed by Westec Services after consultation with the City staff have been incorporated into the final EIR. B. RECOMMENDATION Certify that the final EIR-79-6 has been completed in compliance with CEQA and the Environmental Review Policy of the City of Chula Vista. C. DISCUSSION OF M~qJOR ISSUES 1. Marsh Impact. Bay Boulevard along the western boundary of the most northern project and the former detour, which provided the offramp from I-5 to E Street, currently gives unauthorized access into the Sweetwater Marsh. The area immediately north of the project site is cut off from the larger Sweetwater Marsh by the fill for the former detour. This area is therefore a small brackish salt flat surrounded by introduced plant species. The light-footed clapper rail and California least tern habitats are located to the north and west of the project and they are not expected to utilize the area immediately adjacent to the project. With the implementation of the project, Bay Boulevard will be used for parking and circulation, and a barrier or fence will be placed along the northern boundary. The existing row of tamarisk trees along the northern boundary will be retained. These measures should significantly reduce human intrusion into the marsh. The barrier will also be designed to prevent access by domestic animals from the project into the marsh. 2. Sedimentation basins. The sedimentation basins shown on figure 3-1 are not part of the proposed project, and in any event would not be placed in the marsh but rather at a higher elevation to clean the runoff prior to discharge into the marsh. The suggestion in the draft EIR that additional basins would reduce the potential for siltation even further has been reexamined. It was found that due to the lack of any significant potential problem, additional permanent basins were not necessary. During and immediately after construction it would be beneficial to have temporary basins. 3. Traffic. During the Planning Commission hearing on the draft of this EIR there was some concern expressed about the ability of the street system to accommodate traffic generated by the eventual development in the bayfront area. The Bayfront Redevelopment Project EIR (EIR-77-~, figure 4-3) shows 15,200 ADT on E Street between I-5 and the S~&AE railway. Tidelands Avenue is shown with 15,300 ADT south of E Street and 14,200 ADT to the north. These roads are to be four lanes with a median, except Tidelands Avenue through the marsh which will not have a median. The design capacity of such a road is about 25,000 vehicles per day. Therefore, no significant congestion problem should result from the eventual development as currently envisioned. City Planning Commission Agenda Items for Meeting of Jan. 10, 1979 page 3 3. PUBLIC HEARING (cont.): Tentative subdivision map for Chula Vista Tract 79-14, residential development in Town Centre Project Area A. BACKGROUND 1. This item involves a tentative subdivision map for 6.34 acres of land lying between Fourth and Landis Avenues and between Center Street and Memorial Park. The subject property is located within the Chula Vista Town Centre No. 1 redevelopment project area. 2. On November 8, 1978 the Planning Commission certified EIR-79-3 on the residential component of the Town Centre Redevelopment Plan. No further action by the Commission is necessary. B. RECOMMENDATION Based on the findings contained in Section D of this report, adopt a motion recommending that the City Council approve the tentative subdivision map for Chula Vista Tract 79-14, subject to the following conditions: 1. The vacation of streets within and adjacent to the project site shall be completed prior to final map approval. 2. Temporary turnarounds shall be provided at the dead ends of all streets to be vacated in conjunction with this project. Details of such turn- arounds shall be subject to approval by the City Engineer. 3. All utilities within the Fourth Avenue frontage along the project and those within the project area shall be undergrounded. 4. All sewers, storm drains, water lines and other utilities affected by this project shall be relocated in a manner approved by the respective owners and the City Engineer. 5. The radius of the southwest curb return of the Center Street-Fourth Avenue intersection shall be 30 feet. 6. Details of the intersection of Garrett Avenue and Center Street shall be subject to review and approval by the City Engineer. C. DISCUSSION 1. Existing site characteristics. The subject 6.34 acres of land is relatively level with an existing natural drainage area along a portion of the southerly boundary. The property is vacant except for some miscellaneous storage sheds. 2. Tentative subdivision map. The subject property will be divided into three lots, each containing approxi- mately 2 acres. The boundaries of the lots include portions of Center Street, Landis Avenue and Madrona. Action to vacate these street segments will be addressed page 4 City Planning Commission Agenda Items for Meeting of January 10, 197§ at a later meeting. A 45 foot wide pedestrian easement linking Memorial Park and the Civic Center Complex is proposed between lots 1 and 2. The easterly 15 feet of lot 1 and the westerly 30 feet of lot 2 make up this easement. 3. Proposed development. On November 6, 1978 the Redevelopment Agency approved the Master Plan (Resolution No. 148) for the development of the Town Centre Focus Area. The Master plan designates this area for residential development. In April, 1978 the residential projects on the three lots were conceptually approved by the Town Centre Project Area Committee. On November 10, 1978 the Town Centre Design Review Board approved the actual development plans for lots 1 and 2. Lots 1 and 2 will each be developed with 30 one-story and 34 two-story condominium units with related parking. The development for lot 3 is still at the conceptual approval stage and proposes 75 residential units with related parking. Approval of this subdivision map will allow for the sale of individual condominium units which are subject to design approval by the Town Centre Design Review Board and the Redevelopment Agency. 4. Requirements. In addition to the conditions listed ~in the recommendation section, a revised Tentative Map shall be filed with the City prior to approval of the Final Map. Such revised tentative map shall incorporate the following: a. The minimum size of drainage pipes within the public right of way shall be 18" per Subdivision Manual (Section 2.05 F). b. A grading plan shall be submitted for approval. All slopes shall have slope ratios no steeper than 2:1, The water level in the Hemorial Park retention basin resulting from a 50 year story is at elevation 67.3. Any encroachment into the basin which decreases the retention volume shall be compensated for with increased elevation on the balance of the basin. c. The boundary of the area included within this tentative map shall be clearly identified by use of a distinctive border. d. The proposed public improvements within Fourth Avenue shall be clearly identified and shall be subject to approval by the City Engineer. e. In addition to Chula Vista Tract No. 79-14, the tentative subdivision shall be entitled, Town Centre-Townsite Tract No. 1. FINDINGS The project site is subject to the controls and limitations of the Town Centre Redevelopment Plan which is a more detailed refinement of a portion of the Chula Vista General Plan. The subdivision map is consistent with the General Plan based on the following: Land Use Element - The Town Centre Redevelopment Plan designates this site for "Residential" development, and encourages the establishment of multi-family, middle income residential units in and near the core area of Chula Vista. Circulation Element - The development of the site will not affect the ~jor or Collector road network depicted on the Chula Vista General Plan. The vacation and closure of several streets as indicated on the tentative map will eliminate an irregular lot and block configuration and poorly planned street layout, which is in conformance with the Town Centre Redevelopment Plan. Housing Element - The developer of the proposed residential townhouse units will address the need to provide for the needs of low and moderate income persons, and will participate in an Affirmative Fair Marketing Plan, such as the BCA/HUD program, in conformance with the Housing Element. Conservation, Open Space, and Parks and Recreation Elements - The Conserva- tion Element does not delineate any natural resources worthy of preservation or conservation within the subject property. The tentative map indicates the dedication of the Memorial Park extension as shown on the Town Centre Redevelop- ment Plan. Seismic Safety and Safety Elements - There is no indication of historic seismic activity within the site. Extension of public improvements will meet or exceed Safety Element standards. Noise Element - The Noise Element recognizes the need to continue to utilize the City's Environmental Review process to evaluate and ameliorate noise impact. Scenic Highways Element - The site does not abut a "Scenic Route" or "Gateway." Bicycle Routes Element - The project does not include a designated bicycle route. In planning any street improvement, however, the Bicycle Routes Element of the General Plan encourages consideration of the bicycle as a poten- tial part of the traffic mix.
