RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
ACCEPTING GRANT OF EASEMENT FROM THE COUNTY OF SA~ DIEGO,
A POLITICAL SUBDIVISION
FOR SEWER PURPOSES
The City Council of the City of Chula Vista does hereby
resolve as follows:
NOW, THEREFORE, BE IT RESOLVED that that certain grant of
easement for sewer purposes
executed by Count of San Die 0, a olitical subdivision
dated the 10th day of March , 981, a copy 0 w lch
is attached hereto and by this reference made a part hereof, the same
as though fully set forth herein be, and the same is hereby accepted
by the City of Chula Vista for sewer purposes
BE IT FURTHER RESOLVED that the City Clerk of the City of
Chula Vista be, and she is hereby authorized and directed to record
the document in the office of the San Diego County Recorder.

COUNTY OF SAN DIEGO, a political subdivision
hereinafter designated Grantor(il), owner(~) of the hereinafter described lands, for a valuable consideration, do (es) here-
by GRANTand CONVEY to CITY OF CHULA VISTA, a municipal corporation
herein designated Grantee, a perpetual easement and right-of-way upon, through, under, over and across the hereinafter
described real property for the installation, construction, operation, maintenance, repair, replacement, and recon-
struction of SEWE R pipe lines and/or mains, manholes, sewer lateral pipe lines, and all structures incidental thereto,
together with the perpetual right to remove buildings, structures, trees, bushes, undergrowth, flowers, and any other
obstructions interfering with the use of said easement and right-of-way by Grantee, its successors or assigns and in
addition thereto, to remove soil and other materials within said right-of-way and to use the same in such manner and
at such locations as said Grantee may deem proper, needful or necessary in the construction, reconstruction and main-
tenance of said sewer lines or structures incidental thereto.
To have and to hold said easement and right-of-way unto itself and unto its successors and assigns forever, together
with the right to convey said easement, or any portion of said easement, to other public agencies.
The real property referred to herein and made subject to said easement and right-of way by this grant is situated in
the County of San Diego, State of California, and is particularly described as follows:
Parcel No. 81-0138Al
A strip of land 10 feet wide in Quarter Sections 98, 110, and 111, of
Rancho de la Nacion in the County of San Diego, State of California,
according to Map thereof No. 166, said strip being 5 feet on each side
of the following described centerline:
BEGINNING at a point on the centerline of Bonita Road, as shown on Road
Survey 1299-2 on file in the Office of the County Engineer of San Diego
County, and designated as Engineer's Station 6+02.71 B.C. on said Road
Survey; thence North 81019'16" West, 324.56 feet to the intersection of
the centerlines of Bonita Mesa Road and Bonita Road and the TRUE POINT
OF BEGINNING; thence leaving the centerline of Bonita Road
South 05019'23" West, 12.75 feet to a tangent 250 foot radius curve
concave Easterly; thence along said curve Southerly, a distance of
46.1 feet, more or less to the Easterly boundary line of the State of

California property known as Interstate 805 Freeway; thence retracing
the above described line to the TRUE POINT OF BEGINNING; thence
North 05024'18" East, along the centerline and the Northerly prolon-
gation of the centerline of Bonita Mesa Road, a distance of 5.00 feet;
thence North 07001 '40" West, 279.37 feet to a point lying 15 feet Northerly
of the Southerly right-of-way line of Plaza Bonita Road as shown on Drawing
No. CG 1808 on file in the County Engineer's Office of said County; thence
parallel to said right-of-way line North 70033'17" West, 1,287.30 feet to a
tangent 532 foot radius curve, concave Northerly; thence Westerly along said
curve through a central angle of 17035'06" a distance of 163.28 feet; thence
leaving said curve North 37001 '49" East (radial), 74.00 feet, to a point on a
concentric 458 foot radius curve, said point lying 5 feet Southerly of the
Northerly right-of-way line of said Plaza Bonita Road, thence Westerly along
said curve through a central angle of 36003'00", a distance of 288.17 feet,
thence North 16055'11" West, 178.41 feet to a point designated as Engineer's
Station 24 + 71 on sa id D,'awing CG 1808.
The sidelines of the above 10 foot strip of land shall be prolonged or
shortened so as to terminate at said boundary line of Interstate 805 Freeway
on the South and on the North at the southerly boundary of a 20-foot wide
sewer'easement described in deed to the Spring Valley Sanitation District.

-(h~e Grantor may, at his own risk, use the surbce o( the 'above described real property in a manner that will not inter-
fere with or be detrimental to the use of said easement and right-of-wa.y by Grantee, its successors and assigns, provided
nD trees shall be planted or grownthereon.
The Grantor hereby covenants and agrees for himself, his heirs, successors and assigns, that there shall not be constructed
or maintained upon the above described real property or within said easement and right-Df-way any building or structure
of any nature or kind that will interfere with the use of said easement and right-of-way by Grantee, its successors or
assigns, or that will interfere with the ingress or egress along said easement by said Grantee, its successors or assigns.
The Grantee hereby covenants and agrees for itself, its successors and assigns, not to prevent the Grantor, his successors
or assigns, from crossing over said real property and agrees that the Grantor, his heirs, successors and assigns, may enjoy
the continued use of the surface Df said real property herein described, subject to the conditions abDve stated; and the
Grantee hereby covenants and agrees that after the installation of any pipe line by it in any excavation made by it in
the above described easement and right-of-way it will backfill any such excavation made by it so as to fill said excava-
tion as nearly as practicable to the level of the surrounding ground, and will replace any oiled, asphalt or concrete sur-
face with like material and will replace any fence removed by it.
