Home My WebLink AboutReso 1980-10387 G Revis'ed 1/29/81 RESOLUTION NO. 10387 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE GENERAL PLAN TO CHANGE THE DESIGNATION OF 19 ACRES IN THE VICINITY OF OTAY VALLEY ROAD AND BRANDYWINE TO RESEARCH AND LIMITED INDUSTRIAL The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, EIR-80-7 on this project has been reviewed and the information considered, and it has been prepared in accordance with the California Environmental Quality Act of 1970, as amended, and the California Administrative Code and the Environmental Review Policy of the City of Chula Vista, and WHEREAS, the City Council of the City of Chula Vista has heretofore on February 3, 1981 held a public hearing to consider an amendment to the General Plan to change approximately 19 acres in the vicinity of Otay Valley Road and Brandywine from Medium Density Residential to Research and Limited Industrial, and MiEREAS, having heard testimony at such public hearing and received the recommendation of the Planning Commission as contained in their Resolution No. GPA-81-1, adopted on the 10th day of December, 1980, the City Council now desires to make said revision to the General Plan. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby amend the General Plan of the City of Chula Vista in accordance with Resolution No. GPA-81-1 as adopted and forwarded by the Planning Commission. GPA-81-1 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL A CHANGE IN THE GENERAL PLAN FOR APPROXIt1ATELY 19, ACRES LOCATED NORTH OF OTAY VALLEY ROAD, EAST AND WEST OF BRANDYWINE AVENUE FROM "MEDIUM DENSITY RESIDENTIAL" TO "RESEARCH AND LIMITED INDUSTRIAL " WHEREAS, the City of Chula Vista has an adopted General Plan, and WHEREAS, Richard Kau, acting as an agent for Jimmie H. Shinohara and Helen N. Cushman, requested consideration of a change in the General Plan as a' prerequisite to rezoning from R-l-H to I-L for approximately 19 acres located north of Otay Valley Road, both east and west of Brandywine Avenue, and WHEREAS, the City Planning Commission set the time and place for a hearing to consider said change in the General Plan, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of genera'J circu- lation in the city at least ten days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., November 12 and December 10, 1980, in the Council Chambers, before the Planning Commission, and said hearing was thereafter closed, and WHEREAS, the Planning Commission has certified EIR-80-7 on the proposed project. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From the facts presented to the Planning Commission, the Commission finds that public necessity, convenience, general welfare and good Rlanning practice require an amendment to the General Plan to change the designation of approximately 19 acres located north of Otay Valley Road, east and west of i:\randyvline Avenue, from "t1edium Density Residential" to "Research and Limited Industrial." 2. The Planning Commission recommends to the City Council that said amend- ment to the General Plan be adopted. 3. That this resolution be transmitted to the City Council and a copy be sent to the applicant. EIR-80-1 WHEREAS, Richard Kau, acting as an agent for Jimmie H. Shinohara and Helen N. Cushman, requested a General Plan amendment, rezoning and prezoning and annexation of property located easterly of 1-805 to the north and south of Otay Valley Road, and WHEREAS, the applicant requested eventual development of the property in accordance with the limited Industrial zone of the City of Chula Vista, and WHEREAS, the Environmental Review Committee, after reviewing proposals for the preparation of draft and final environmental impact reports for the project, selected PRC Toups Corporation to prepare the documents, and WHEREAS, on September 22, 1980 the Environmental Review Committee of the City of Chula Vista issued for public review the draft of EIR-80-1 on the Brandy- wine Industrial Park, and WHEREAS, legal notice of the availability of the draft environmental impact report was given through publication in a newspaper of general cir:ulation on September 29, 1980 and a notice of completion was filed with the Secretary for Resources of the State of California, and WHEREAS, the applicant gave notice to the City that the portion of the project area located south of Otay Valley Road would no longer be part of the Brandywine Industrial Park, and therefore no annexation was requested, and WHEREAS, on October 2, 1980 the Environmental Review Committee determined that the environmental impact report was valid on the smaller scale project as proposed by the applicant, and WHEREAS, a public hearing on the adequacy of the draft environmental impact report was held on November 12 and December 10, 1980, NOW, THEREFORE, BE IT RESOLVED AS FOllOWS: From the facts presented to the Planning Commission, the Commission certifies that EIR-80-7 for the Brandywine Industrial Park has been prepared in compliance with the Cal ifornia Environmental Qual ity Act of 1970 and the Environmental Review Procedures of the City of Chula Vista, and that the Commission will review the information in the environmental impact report as it reaches a decision on the proj ec t.
