RESOLUTION' ,OF THE' CITY' COUNCIL' OF,-"'THEc-CITY' OF CHULA
VISTA, APPROVING AGREEMENT BETWEEN THE CITY OF CHULA
VISTA AND JOSEPH S. \vARBURTON FOR OPERATION OF THE
HALFWAY HOUSE/SNACK SHOP ON THE CHULA VISTA MUNICIPAL
GOLF COURSE
AND AUTHORIZING THE MAYOR-TO 'EXECUTE SAID AGREEMENT
The City Council of the City of Chula Vista does hereby
resolve as follows:

NOW, THEREFORE, BE IT RESOLVED that that certain agr~ement
between THE CITY OF CHULA VISTA, a municipal corporation, and'
JOSEPH S. WARBURTON, for operation of the Halfway House/Snack Shop
on the Chula Vista Municipal Golf Course
dated the 13th day of January , 19 81
which is attached hereto and incorporated herein,
fully set forth herein be, and the same is hereby
, a copy of
the same as though
approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of the City of Chula Vista.

LEASE AGREEMENT FOR OPERATION OF THE HALFWAY
HOUSE/SNACK SHOP ON THE CHULA VISTA MUNICIPAL
GOLF COURSE
THIS LEASE is made and entered into this 14th day of
January, 1981, by and between THE CITY OF CHULA VISTA, a municipal
corporation, hereinafter referred to as "Les sor" and JOSEPH S.
WARBURTON, hereinafter referred to as "Lessee".
Lessor hereby agrees to lease to Lessee the Halfway
House/Snack Shop on the Chula Vista Municipal Golf Course in
consideration for Lessee's promise to operate the snack shop
during the period of this lease for the purpose of providing food
and beverages to patrons of the golf course.
NOW,
upon the terms
as follows:
THEREFORE, in consideration of the premises and
and conditions herein contained, the parties agree

TERM
The term of this lease shall be for thirty (30) days,
commencing on January 14, 1981 Lessor may terminate
this lease by giving seven (7) days notice of its intention to
terminate it prior to the date of expiration. If the Lessor does
not given seven (7) days notice, the lease shall continue, at the
option of the Lessee, on a month to month basis. The Lessee may
terminate the lease by giving a notice seven (7) days prior to the
expiration of anyone of these thirty (30) day periods. Lessee
agrees that this seven (7) days notice is sufficient and that he
will surrender the lease at the end of the thirty (30) day period
after seven (7) days notice is given.
2. WORKMENS COMPENSATION AND GENERAL
LIABILITY INSURANCE
Lessee agrees that he will maintain all Workmens Compen-
sation insurance and all general liability insurance to cover any
liability involved in the operation of the Halfway House/Snack
Shop. Lessee further agrees that he will obtain a comprehensive
insurance policy with the Lessor named as an additional insured
with limits of $1 million combined single limitation, and he
further agrees to indemnify and hold harmless the Lessor and its
agents from any claims arising from the use or supervision of the
Halfway House/Snack Shop.
3. CARE AND REPAIR OF PREMISES
Lessee shall commit no act of waste and shall take good
care of the premises throughout the period of this lease.
4. UTILITIES
Lessor agrees to provide all utilities necessary for the
operation of the Halfway House/Snack Shop.

5. ASSIGNMENT OR SUBLEASE
Lessee shall not, without first obtaining the written
consent of Lessor, assign or encumber or sublet the premises or
any part thereof.
IN WITNESS WHEREOF, the parties hereto have caused this
Lease to be executed the day and year first hereinabove set forth.
