Home My WebLink AboutReso 1980-10372 1 00 J- ;4t~ RESOLUTION NO. 10372 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING ENCROACHMENT PE~T TO HENRY CONTRERAS TO BUILD ROOM ADDITION UPON THE CITY'S SEWER EASEMENT AT 1426 MELROSE AVENUE The City Council of the City of Chula Vista does hereby resolve as follows: ,iliEREAS, on November 3, 1980, Stephen Kirby, acting as agent for the owner at 1426 Melrose Avenue, submitted a letter of request to construct a single-story room addition to the existing residence upon a sewer easement on the north side of the property, and >mEREAS, the proposed configuration is the only feasible way of providing an addition with wheelchair access, which is a requisite for the owner, and WHEREAS, the proposed structure will lie over a sewer main serving approximately 250 homes to the north and east, with the possibility of further development to the east which would cause additional loading to this main thereby necessitating the enlargement of the sewer, and >mEREAS, further investigation reveals that the existing 8-inch main was constructed with an average grade of 5.7% which provides adequate capacity for the existing load and for any additional development within the foreseeable future and maintenance is facilitated by existing manholes located only 138 feet apart thereby posing no immediate problem with the proposed construction, and WHEREAS, the City Engineer recommends approval of this encroachment permit subject to the condition that the owner enter into an agreement providing that: 1. In the event that excavation to repair or replace the sewer main is necessary, the City will be held harmless from any liability for damage to the structure within the easement resulting from said excavation. 2. The owner shall be responsible for any added cost of sewer repair or replacement occasioned by the existence of the encroachment. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve the encroachment permit to Henry Contreras to build a room addition upon the City's sewer easement at 1426 Melrose Avenue subject to the condition listed hereinabove.
