Home My WebLink AboutReso 1980-10330 ".~ '8" ~ RESOLUTION NO. 10330 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDERING THE "L" STREET/CHURCH OF CHRIST REORGANIZATION INVOLVING ANNEXATION TO THE CITY OF CHULA VISTA AND THE DETACHMENT OF THE TERRITORY FROM THE SAN DIEGO COUNTY FLOOD CONTROL DISTRICT ZONE 3, THE MONTGOMERY SANITATION DISTRICT AND THE MONTGOMERY FIRE PROTECTION DISTRICT The City Council of the' City of Chula Vista does hereby resolve as follows: WHEREAS, pursuant to the District Reorganization Act of 1965, commencing with Section 56000 of the Government Code, the . City of Chula Vista received from the Chula Vista Church of Christ an application proposing a reorganization consisting of the following changes or organization: 1. Annexation of territory to the City of Chula Vista as shown on Exhibit A and more particularly described on Exhibit B. 2. Detachment of territory described in Exhibit B from the San Diego County Flood Control District Zone 3. 3. Detachment of territory described in Exhibit B from the Montgomery Sanitation District. 4. Detachment of territory described in Exhibit B from the Montgomery Fire Protection District. WHEREAS, the City approved the boundaries of said "L" Street/Church of Christ Reorganization and the staff filed the proposed reorganization with LAFCO, which by resolution dated April 7, 1980, in compliance with Government Code Section 56430 et seq., approved said reorganization without notice and hearing and without an election on the detachment of the territory from the San Diego County Flood Control District Zone 3, the Montgomery Sanitation District and the Montgomery Fire Protection District. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista hereby finds and determines and orders as provided in Government Code Section 56430 et seq. as follows: 1. The territory proposed for reorganization (here- inafter referred to as the Territory) is as described in Exhibit B attached hereto. 2. The description of the boundaries of the Territory conforms to lines of assessment and ownership. 3. The Council does hereby approve the proposed reor- ganization consisting of annexation of territory described in Exhibit B to the City of Chula Vista and detachment of territory described in Exhibit A from the San Diego County Flood Control District Zone 3. 4. Pursuant to Section 13952 of the Health and Safety Code of the State of California, the City of Chula Vista does hereby request that the governing board of the Montgomery Fire Protection District and the Montgomery Sanitation District withdraw said territory from their respective districts. -1- Presented by ~, --" .. 5. Pursuant to Government Code Section 56340 et seq. and the resolution of LAFCO, the City of Chula Vista does hereby order said reorganization without notice and hearing and without an election. 6. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to transmit a certified copy of this resolution in accordance with Section 56450 et seq. of the Government Code. 7. The City Clerk of the City of Chula Vista be, and she is hereby authorized and directed to file a certified copy of this resolution with the governing board of the Montgomergy Sanitation District and the Montgomery Fire Protection District and with the tax levying authorities of said districts. 8. The City Council hereby certifies that it has reviewed the Negative Declaration adopted on October 26, 1976 as a part of Ordinance No. 1709 and the Environmental Review Committee has again found it to be applicable to the proposed Church of Christ Reorganization as contained in Negative Declaration, IS-76-63, which was prepared in accordance with the California Environmental Quality Act of 1970, as amended.
