HomeMy WebLinkAboutReso 1980-10329 Revised 12/4/80 RESOLUTION NO. 10329 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE MAP FOR CHULA VISTA TRACT 80-25, CASTLE PARK TOWNHOMES The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as CHULA VISTA TRACT 80-25, CASTLE PARK TOWNHOMES, and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-80-25, adopted on the 12th day of October, 1980, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein, and WHEREAS, the proposed project is exempt from environ- mental review as a class l(k) exemption. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative subdivision map in accordance with Planning Commission Resolution No. PCS-80-25 subject to the condition that the applicant is required to comply with the condominium regulations in effect at the time of approval of the final map and further that applicant agrees to provide an additional 100 cubic feet of storage in the parking area and to comply with the Design Review Committee requirements for building facades. ;:",'"' by ,~ A:~ D. DATED ( seal) City Clerk CC':'660 JD3~~ nC~VLUIIVI~ IlV. rLJ-OV-LJ RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION ~~P FOR CHULA VISTA TRACT 80-25, CASTLE PAI{K TOWNHO~1ES WHEREAS, a tentative subdivision map for Chula Vista Tract 80-25, Castle Park Townh~nes, was filed by T. L. Sheldon Corp. on May 29, 1980 for the conversion of a 39 unit apartment complex located on 2.26 acres at 1436 Hilltop Drive into a one lot condominium project, and WHEREAS, this action is exempt from environmental review as a class l(k) exemption, and WHEREAS, the City Planning Conmission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by publication in a newspaper of general circulation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 22, 1980 in the City Council Chambers, 276 Fourth Avenue, before the Planning Conmission and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: From facts presented to the Pl ann i ng Conmi ss i on concerni ng the development, the Commission finds as follows: a. The site is physically suitable for residential development and the proposed development conforms to all standards established by the City for such proj ect. b. The design of the subdivision will not affect the existing improvements-- streets, sewer, etc.--which have been designed to avoid any serious health problems. c. Approval of the project will not adversely affect the public service needs of residents of the city or available fiscal and environmental resources. d. The subdivision is consistent with the General Plan Elements as follows: 1) The conversion of apartment units into a condominium does not affect the following elements of the General Plan: Land Use, Circulation, Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes, Public Buildings, Conservation, Parks and Recreation, and Open Space. 2) Housing Element - While the conversion of apartment units into condo- miniums will reduce the inventory of rental housing, it will also permit an expanded <:boice of housing ownership by providing attached housing below prices established for new construction. ) 03~ '1 BE IT FURTHER RESOLVED: That the Planning Commission recommends that the City Council approve the tentative subdivision map for Chula Vista Tract 80-25, Castle Park Townhomes, subject to the following conditions: 1. The developer shall grant a 7.5 foot easement to the City for street tree planting and maintenance along Tobias Drive prior to approval of the final map. 2. The developer shall grant a 7 foot easement to the City for street tree planting and maintenance along Hilltop Drive prior to approval of the final map. 3. The developer shall construct wheelchair ramps as shown on the tentative map prior to approval of the final o~p. A construction permit shall be obtained for said improvement work. 4. Prior to approval of the final map, the developer shall reconstruct or al ter the curb outlet on Tobias Dy'ive to prevent water from standing in said outlet. A construction perroit must be obtained for this work. 5. The deve"\oper shall obtain the necessary pemits to do the work required for approval, incl udin<j condHions specified hy the Design Review Committee, within 120 days after approval of the final map. Such work shall proceed in an expeditious manner and shall be complete 90 days from the issuance of the permits. No units shall be occupied until final inspections have been made and all work requ"ired by this approval is complete. 6, The developer shall construct 15 additional carports adjacent to and similar in design to the existing "carports. 7. The gate controlling access at the \1est driveway of the project adjacent to Tobias Drive shall be reviewed by the Fire Department prior to City Council consideration of the final map. The Planning Conmission directs that this resolution be forwarded to the City Council and a copy be sent to the ,;pplicant.
