HomeMy WebLinkAboutReso 1980-10328 Revised 12/8/80 RESOLUTION NO. 10328 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING TENTATIVE MAP FOR CHULA VISTA TRACT 80-30, OAKLAWN TOWNHOUSES follows: The City Council of the City of Chula Vista finds as That in accordance with the attached Negative Declaration, IS-78-35 and the findings therein, the proposed tentative map for Chula Vista Tract 80-30, Oaklawn Townhouses, will not have a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as amended. The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the Planning Commission of the City of Chula Vista has heretofore approved that certain tentative map of a subdivision to be known as CHULA VISTA TRACT 80-30, OAKLAvm TOWNHOUSES, and has recommended that the City Council approve said tentative map subject to the conditions contained in Planning Commission Resolution No. PCS-80-30, adopted on the 12th day of October, 1980, a copy of which is attached hereto and by this reference made a part hereof, the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby approve said tentative subdivision map in accordance with Planning Commission Resolution No. PCS-80-30 subject to the condition that the applicant is required to provide relocation assistance to the tenant of the single family home in accordance with the ordinance in effect at the time of filing the final map, and the further condition that landscaping as approved by the Planning Department be provided in order to screen the two parking spaces in the front area. PLANNING COMMISSION RECOt1MENDING TO THE CITY COUNCIL THE APPROVAL OF THE TENTATIVE SUBDIVISION MAP FOR CHULA VISTA TRACT BO-24, OAKlAWN TOWNHOUSES WHEREAS, a tentative subdivision map for Chula Vista Tract 80-30, Oaklawn, Townhouses, was filed by Palm Homes, Inc. on August 4, 1980 to develop a 9 unit condominium project at 35 Oaklawn Avenue in the R-3 zone, and WHEREAS, the Planning Commission set the time and place for a public hearing to consider said tentative map, and notice of said hearing, with its purpose, was given by publication in a newspaper of general ci'rculation in the city at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said time and place,'namely 7:00 p.m., October 22, 1980 ,in the City Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that this project will have no significant environmental impact and adopted the Negative Declaration on IS-78-35. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: From facts presented to the Planning Commission concerning the development, the Commission finds as follows: a. The site is physically suitable for residential development and the proposed development conforms to all standards established by the City for such project. b. The design of the subdivision will not affect the existing improvements-- streets, sewer, etc.--which have been designed to avoid any serious health ,problems. c. Approval of the project will not adversely affect the public service needs of residents of the city or available fiscal and environmental resources. d. The subdivision is consistent with the General Plan Elements as follows: 1) The construction of condominiums within the R-3 zone in an area which is essentially improved does not affect the following elements of the General Plan: land Use, Circulation, Seismic Safety, Safety, Noise, Scenic Highways, Bicycle Routes, Public Buildings, Conservation, Parks and Recreation, and Open Space. 2) Housing Element - The construction of condominium units will provide additional housing for the residents of the conmunity. BE IT FURTHER RESOLVED: That the Planning Commission recommends that the City Council approve the tentative subdivision map for Chula Vista Tract 80-30, Oaklawn Townhouses, subject to the following conditions: ~~ _~ (d3Ji - I.' The aeveloper shall grant to the city a 7 foot easement for street tree purposes along Oaklawn Avenue prior to approval of the final map. 2. The developer ,shall reconstruct the southern driveway to minimum city standards (CVCS-l, 18 foot width, 24 foot curb opening). 3. The driveway across the front shall be paved and have two parking spaces marked on the easterly edge to assure 'that parking is back of the required front setback. The Planning Commission directs that this resolution be forwarded to the City Council and a copy be'sent to the applicant. Tract 80-30 R-3 zone, Palm Homes, that this site, containing approximately 15,000 east side of Oaklawn Avenue in the R-J lone. It Principal Planner Lee reported square feet, is located on the is the developer's intent to remodel the existing house and COnstruct 8 new units on the rear portion of the lot. Seven carports would be located under a portion of the structure. Storage and open space in the development will comply with the standat'ds for condominiums and the project has been approved by the Design Review Committee. It;s recommended that the tentative map be approved subject to two conditions relating to dedication for street trees and the recon- struction of the southern driveway to city standards. Commissioner Smith asked if the two parking spaces in front of the house would be within the required front setback. Mr. Lee advised that the circular driveway is an existing condition therefore the area can be used for parking. There is adequate room to provide landscaping between the two parking spaces and the sidewalk thus the Design Review Committee felt that it would be preferable to establish two parking spaces in that driveway rather than delete landscaping in order to accommodate one of the spaces in the interior of the lot. This being the time and place as advertised, the public hearing was opened. Mr. Pearson, 481 Orset Street, owner of properties at 44 and 46 Oaklawn, expressed concern about parking in the area and asked how many parking spaces are being provided in this project. Mr. Lee explained that under the code one parking space is required for the existing dwelling, plus 1~ spaces for each of the eight new units in addition to 3 on site guest spaces or a total of 16; the plan shows 16 parking spaces. Lloyd Neeley, 1044 Broadway, owner of the project, advised that concurrent with the construction of the eight new units, the house in front will be renovated to give it an attractive appearance, which it does not presently have. As no one else wished to speak, the public hearing was closed. MSUC (Stevenson-G. The motion failed to carry by the following vote: AYES, NOES: ABSENT, Commissioners Stevenson and G. Johnson Commissioners Williams, R. Johnson, Smith, Pressutti and O'Neill None Commissioner Williams suggested that the project be referred back to the Design Review Committee with the Commission's concerns over the compatibility of the design of the existing house and the architecture of the proposed new development, also to consider revising the site plan to eliminate parking at the front setback. It was noted that such referral would delay consideration of the tentative map beyond the time limit required by State Law and unless the developer concurs with such delay, the map would automatically be approved. MS (Smith-O'Neill) Based on the findings contained in the report, the Planning Commission recommends that the City Council approve the tentative subdivision map for Oaklawn Townhouses, subject to the two conditions stated in the report and an added condition to require that the present driveway across the front be paved and marked with two parking spaces on the easterly edge so that parking will be adequately set back from the sidewalk. The motion carried by the following vote: AYES, NOES, ABSENT, Commissioners Smith, O'Neill. Williams and Pressutti Commissioners Stevenson. G. Johnson and R. Johnson None
