RESOLUTION OF THE CHULA VISTA REDEVELOPMENT
CORPORATION APPROVING A DESIGN REVIEW PERMIT
(DRC-06-10), TO ALLOW THE CONSTRUCTION OF A 10,400
SQ. FT. AUTO REPAIR CENTER BUILDING ON THE SITE
LOCATED AT 2681 MAIN STREET IN THE SOUTHWEST
AREA OF THE CITY OF CHULA VISTA
WHEREAS, the parcel. which is the subject matter of this resolution, is represented in
Exhibit A attached hereto and incorporated herein by this reference, and for the purpose of
genera] description is located at 2681 Main Street. Chula Vista; and
WHEREAS, on July 29, 2005. duly verified applications for a Design Review Permit
(DRC-06-10) was filed with the City of Chula Vista by Mr. Heriberto Gutierrez, owner of the
subject property (`'Applicant"), to enable the demolition of the existing structures on site and
construction of a 10.400 sq. ft. auto rept.ir center building, parking spaces, landscaping and the
associated access and circulation elements at 2681 Main Street ("Projecf'); and
WHEREAS, the Environmental Review Coordinator has reviewed the proposed project
for compliance with the California Environmental Quality Act (CEQA) and has determined that
the project qualifies for a Class 2 (b) categorical exemption (Replacement of existing structures)
pursuant to Section 15302 of the State CEQA Guidelines because the proposed project is
replacing the existing non-conforming structures with a new structure of substantially the same
size, purpose and capacity, improving the site and removing blighting influences. Thus. no
further environmental review is necessary: and
WHEREAS, a hearing time and place was set by the Chula Vista Redevelopment
Corporation ("CVRC") for consideration of the Project and notice of said heazing, together with
its purpose, was given by its publication in a newspaper of general circulation in the City, and its
mailing to property owners and residents within 500 feet of the earterior boundazies of the
property, at least ten (10) days prior to the hearing; and
WHEREAS, the Chula Vista Redevelopment Corporation held a duly noticed public
hearing to consider said application at the time and place as advertised, namely October 8, 2009
at 4:00 p.m. in the Council Chambers. 276 Fourth Avenue, before the Chula Vista
Redevelopment Corporation and said hearing was thereafter closed; and
WHEREAS, the Project is in conformance with the requirements of the City of Chula
Vista Zoning Ordinance. Design Manual, Landscape Manual and staff has developed Design
Review Conditions, provided as Exhibit B. to ensure the Project is developed and maintained
subject to certain criteria.
NOW, THEREFORE, BE IT RESOLVED that the Chula Vista Redevelopment
Corporation does hereby find, determine, and resolve as follows:

A. ENVIRONMENTAL DETERMINATION
The Environmental Review Coordinator has reviewed the proposed project for
compliance with the California Environmental Quality Act (CEQA) and has determined that the
project qualifies for a Class 2 (b) categorical exemption (Replacement of existing structures)
pursuant to Section 15302 of the State CEQA Guidelines because the proposed project is
replacing the existing non-conforming structures with a new structure of substantially the same
size, purpose and capacity, improving the site and removing blighting influences. Thus, no
further environmental review is necessary
B. CONFORMANCE WITH CITY DESIGN MANUAL
The Chula Vista Redevelopment Corporation does hereby find that the Project is in
conformance with the City of Chula Vista Zoning Ordinance, Design Manual, and Landscape
Manual and hereby approves the Design Review Permit (DRC-06-10), subject tp conditions of
Exhibit B, attached hereto and incorporated herein by this reference.

The Chula Vista Redevelopment Corporation does hereby approve Design Review Permit DRC-
06-1 Osubject to the following conditions:
The following shall be accomplished to the satisfaction of the City, prior to issuance of
building permits, unless otherwise specified.
DEVELOPMENT SERVICES DEPARTMENT CONDITIONS
1. The subject property shall be developed and maintained in substantial conformance with the
approved application, the conceptual plans, and colors and materials board on file in the
Development Services Department, the conditions contained herein, and Title 19, except as
modified herein.
2. Applicant shall submit all exterior lighting plans, landscape and irrigation plans prepared by
a licensed landscape architect, solid waste and recycling plans for review and approval prior
to the issuance of building permits.
3. Prior to, or in conjunction with the issuance of the first building permit, the Applicant shall
pay all applicable fees, including any unpaid balances of permit processing fees for deposit
account DQ-1246.
4. The proposed loading zone shall be modified to be in substantial conformance with the
requirements of Chula Vista Municipal Code Section 19.62.140.
5. The project shall conform to Sections 9.20.055 and 9.20.035 of the CVMC regarding graffiti
control.
6. All roof appurtenances, including air conditioners and other roof mounted equipment and/or
projections, shall be shielded from view and the sound buffered from adjacent properties and
streets as required by the Development Services Director. Such screening shall be
architecturally integrated with the building design and constructed to the satisfaction of the
Development Services Director.
7. All ground mounted utility appurtenances such as transformers, AC condensers; etc.. shall be
located out of public view and adequately screened through the use of a combination of
concrete or masonry walls, berming, and/or landscaping to the satisfaction of the
Development Services Director.
8. Identification signs shall be limited to those signs permitted by Section 19.60.400 and
Section 19.60.410 of the Chula Vista Municipal Code (CVMC) and shall comply with the
regulations stated therein. A sign permit shall be obtained by the Applicant prior to
construction and/or installation of any identification signs.
9. No outside storage is allowed on the site. All work shall be conducted inside the building.

] 0. Applicant shall provide grading plans with the submittal for building permits that shall
contain on and off-site spot elevations and grading/drainage information.
11. Landscape Plans shall show and provide landscape drainage within required planter areas
prior to the issuance of building permits.
12. Plans submitted for building permits shall contain a statement on the cover sheet indicating
that this project will comply with Title 24 (2005 Energy Conservation and 2001 ADA
Regulations).
13. The project shall comply with applicable codes and requirements. including but not limited to
2007 California Building Code, California Fire Code, California Mechanical Code, California
Plumbing Code, 2007 Califomia Energy Code, and the Americans with Disabilities Act.
14. Plans submitted for building permits shall specify Type of Construction, which shall be type
V 1 hour fully sprinkled. Plans shall also identify rated corridors.
15. Applicant shall indicate on the pans the type of occupane}' S-l or S-2/F-1 or F-2, and the
type of construction.
16. Applicant shall apply for and obtain separate permits for the trash enclosures, site lighting,
and private water and sewer.
17. The applicant/owner shall comply with all applicable federal, state, and local requirements,
and in any case where it does not comply, this permit is subject to modification or
revocation.
18. This permit shall become void and ineffective if not used or extended within one year from
the effective date thereof, in accordance with Section 19.14.600 of the Municipal Code.
19. The applicant shall and does hereby agree to indemnify, protect, defend, and hold harmless
the City, its Council members, officers, employees, agents, and representatives from and
against all liabilities, losses, damages, demands, claims, and costs, including court costs and
attorney's fees (collectively, liabilities) incurred by the City arising directly or indirectly
from a) City's approval and issuance of this permit, b) City's approval or issuance of any
other permit or action, whether discretionary or non discretionary, in connection with the use
contemplated herein, and without limitation, any and all liabilities arising from the operation
of the facility. Applicant shall acknowledge their agreement to this provision by executing a
copy of this permit where indicated below. The applicanPs compliance with this provision
is an express condition of this permit and this provision shall be binding on any and all of the
hcant's successors and assigns.

ENGINEERING AND PUBLIC WORKS DEPARTMENT CONDITIONS
20. Plans shall incorporate, prior to the issuance of building permits, features that will meet
NPDES Standards. These features shall maximize infiltration and minimize impervious land
coverage while conveying storm water runoff. Examples of such design features include
increased landscaping, grass swales, parking lot runoff into landscaped areas, roof runoff
flowing into landscaped areas, etc.
21. The following fees shall be required based on the final building plans submitted:
a) Sewer Connection and Capacity Fees
b) Development Impact Fees
c) Traffic Signal Fees
22. Additional deposits and fees in accordance with the City Subdivision Manual shall be
required for the submittal of Grading Plans and Improvement Plans.
23. Grading plans in conformance with the City's Subdivision Manual and a grading permit will
be required prior to issuance of any building permits. The grading plans shall be submitted to
the Engineering Deparhnent upon the approval of the Design Review Permit; as follows:
a) The grading plans shall be prepazed by a registered civil engineer and approved by the
City Engineer.
b) A drainage study and geotechnical/soils study are required with the first submittal of
grading plans. The drainage study shall calculate the pre-developed and post-developed
flows and show how downstream properties and storm drain facilities are impacted. The
design plans shall incorporate detention of storm water runoff.
c) The grading plans shall conform to the City Storm Water Management requirements.
d) Any offsite work will require letters of permission from the affected property owners.
24. Applicant/property owner shall dedicate 7 feet ofright-of--way in front of the subject property
along 27th Street to meet the required street standards, according to the specifications
designated for the segment of 27th Street between Main Street and Faivre Street.
25. Applicant shall build the required street improvements of the segment of 27th Street in front
of the subject property, which include all curb, gutter, sidewalk. street widening and
transitions to existing improvements along the project frontage of 27`h Street and replace any
existing driveways or sidewalks that are not ADA compliant.
26. The applicant shall obtain construction permits from the Engineering Department to perform
the following work in City's right-of-way. An approved construction permit is required prior
to Engineering releasing the building permit:

a. Sewer lateral connections to existing public utilities. The Public Works Operations Sewer
Section will need to inspect any existing sewer laterals that are to remain to determine if
they require replacement.
b. Construction of the required sidewalks, curbs and gutters with proper transitions to
existing conditions.
c. Installation of driveways meeting design standards as shown in Chula Vista standard
detail CVCS-IA.
d. All utilities serving the proposed project shall be underground.
e. Installation of pedestrian ramps meeting ADA standards.
27. Any onsite sewer and storm drain system shall be private. Al] sewer laterals and storm drains
shall be privately maintained from each building to the City maintained public facilities.
28. The applicant shall complete the applicable Storm Water Compliance Forms and comply
with the City of Chula Vista's Storm Water Management Standards Requirements Manual.
These forms shall be submitted with the grading plans. All projects falling under the Priority
Development Project Categories are required to comply with the Standazd Urban Storm
Water Mitigation Plans (SUSMP) and Numeric Sizing Criteria. Based on the Completion of
the Storm Water Compliance Forms, the project may be required to submit a SWPPP and
Water Quality Technical Report (WQTR) with the submittal of the grading plans.
FIRE DEPARTMENT CONDITIONS
29. Applicant shall provide a fire flow of 2,700 gallons per minute fora 2-hour duration (at 20
psi).
30. Applicant shall provide a water flow letter from the applicable water agency having
jurisdiction indicating that the above-mentioned fire flow is available to serve this project.
31. Fire Hydrants shall be located no greater than 300 feet apart (for commercial and multi-
family properties).
32. The building(s) shall be addressed in accordance with the following criteria:
• 0 - 50 ft. from the building to the Face of the curb = 16-inches in height with a f -
inch stroke.
• 51 - 150 ft. from the building to the face of the curb = 16-inches in height with a
11 /2-inch stroke.
• 151 ft. from the building to the face of the curb = 16-inches in height with a 2-
inch stroke.
33. Applicant shall provide fire extinguishers azound the building in every tenant space and in
the Motor Vehicle Repair Garage.

34. Applicant shall obtain a permit from the Fire Department for Motor Vehicles Repair and hot
work, depending on the scope of work.
GENERAE SERVICES DEPARTMENT CONDITIONS
35. The applicant shall develop and submit a Recycling and Solid Waste Management Plan to the
Environmental Services Program Manager for review and approval prior to the issuance of
building permits. The Plan shall demonstrate those steps the Applicant will take to comply
with the Chula Vista Municipal Code Sections 8.24, 8.25 and 19.58.340 and meet the State
mandate to reduce or divert at least 50% of the waste generated by all residential, commercial
and industrial developments (including demolition and construction phases).
36. The applicant shall contract with the Citys franchise hauler throughout the construction and
occupancy phases of the project.
OTHER CONDITIONS
Sweetwater Authority
37. Applicant/property owner shall contact the Sweetwater Authority and comply with the
Authority's requirements to serve the site and project with the required water services.
Chula Vista School Districts
38. Applicant shall comply with the conditions and requirements of the Chula Vista Elementary
School District and the Sweetwater Union High School District.
