RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA ADOPTING CEQA FINDINGS AND STATEMMENT OF OVER-
RIDING CONSIDERATIONS FOR DEVELOPMENT OF CHULA VISTA
TRACT 80-10 LADERA VILLAS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the Environmental Review Committee of the City
of Chula Vista conducted an Initial Study, IS-80-5, of the pro-
posed development of Chula Vista Tract 80-10 Ladera Villas, com-
prising 10 acres at the eastern terminus of Paseo Entrada with 26
single family dwellings, and concluded that the project could
result in significant environmental effects and required a focused
Environmental Impact Report, and
WHEREAS, a public meeting was held on August 22, 1980 to
obtain comments from the public on the contents of the Environ-
mental Impact Report, and
WHEREAS, a draft EIR was issued by the Environmental
Review Committee for public agency review on September 22, 1980
and
WHEREAS, after legal notice was given, the Planning
Commission of the City of Chula Vista held a public hearing on the
adequacy of the draft EIR on October 22, 1980 and found that
EIR-81-1 had been prepared in accordance with the California
Environmental Quality Act of 1970, the California Administrative
Code and the Environmental Review Policy of the City of Chula
Vista, and
WHEREAS, at the above meeting, the Planning Commission
of the City of Chula Vista found as follows:
1. Subject to standard development regulations and the
conditions of approval, the project will not result
in significant environmental impacts in the
following areas:
a. Geology/soils
b. Archaeology
c. Schools
d. Biology
e. Those issues identified in Section 4.0 of
EIR-81-I.
2. Implementation of the project would result in a
significant land form alteration and it is econom-
ically infeasible to implement alternatives that
would significantly reduce this impact.
and
WHEREAS, the Planning Commission also found that there
were overriding considerations that warranted approval of the
project.

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista does hereby find that EIR-8l-l on the
proposed development of Ladera Villas has been prepared in
accordance with the California Environmental Quality Act of 1970,
the California Administrative Code and the Environmental Review
Policy of the City of Chula Vista, and hereby certifies that it
will consider the information in the Environmental Impact Report
as it makes a recommendation of the project.
BE IT FURTHER RESOLVED that the City Council finds that
subject to development regulations and the conditions of approval,
the project will not result in significant environmental impact in
the following areas:
a. Geology/soils
b. Archaeology
c. Schools
d. BiOlogy
e. Those issues identified in Section 4.0 of the EIR.
BE IT FURTHER RESOLVED that the implementation of the
project would result in a significant environmental impact in that
it calls for significant land form alter ation and finds that
specific considerations make measures to avoid said impact in-
feasible.
BE IT FURTHER RESOLVED that the City Council does adopt
the following statement of overriding considerations:

More significant canyons that the minor canyon near
the westerly edge of this tract have been filled in
conjunction with developments to the west.
2.
Council decided in its approval of the El Rancho del
Rey Specific Plan to preserve the major canyon areas
in El Rancho del Rey and in exchange therefor to
allow filling and alteration of many of the minor
canyons.
3.
A cluster development in order to minlmlze the
grading is not appropriate in this location at the
end of a cul-de-sac when the only access to the
cul-de-sac is through a single family area.
4.
A reduction in the number of units is not justified
as the adopted Specific Plan for the area allows 3-5
DU/acre and the proposal is for only 2.6 DU/acre.
5.
Because of the requirement for participation in the
cost of extending Paseo Ranchero, a lower density
probably would not be economically feasible.

RESOLUTION OF THE CITY PLANNING COMMISSION
CERTIFYING AN ENVIRONMENTAL H1PACT REPORT
WHEREAS, the Environmental Review Committee of the City of Chula Vista
conducted an Initial Study, IS-80-5, of the proposed development of Chula Vista
Tract 80-10, Ladera Villas, comprising 10 acres at the eastern terminus of
Paseo Entrada, with 26 single family dwellings, and
WHEREAS, the Committee concluded that the project could result in significant
environmental effects and required a focused environmental impact report, and
WHEREAS, a public meeting was held on August 22, 1980 to obtain comments from
the public on the content of the environmental impact report, and
WHEREAS, the Environmental Review Section of the Planning Department prepared
a draft environmental impact report based on technical reports submitted by the

WHEREAS, the draft environmental impact report was issued by the Environmental
Review Committee for public and agency review on September 22, 1980, and
WHEREAS, legal notice of the available of the draft environmental impact report
was given by publ ication in a newspaper of general circulation on September 25, 1980
and a notice of completion was filed with the Secretary of Resources of the State of
Ca 1 i forni a, and
WHEREAS, the Planning Corrmission of the City of Chula Vista held a public hearing
on the adequacy of the draft environmental impact report on October 22, 1980.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
From the facts presented to the Planning COllmission, the Commission finds that
EIR-81-1 has been pr'epared in accordance with the California Environmental Quality
Act of 1970, as amended, the California Administrative Code, and the Environmental
Review Policy of the City of Chula Vista, and hereby certifies that the Commission
will consider the information in the environmental impact report as it makes a
recommendation on the project.

RESOLUTION OF THE CITY PLANNING COMMISSION ADOPTING CEQA
FINDINGS PURSUANT TO CALIFORNIA PUBLIC RESOURCES CODE
SECTION 21081 AND ADOPTING FINDINGS OF OVERRIDING CONSIDERATION
WHEREAS,EIR-81-1 on the proposed Ladera Villas subdivision was certified by
the Planning Commission on October 22, 1980, and
WHEREAS, it is the policy of the State OF California and the City of Chula
Vista that no project shall be approved if the environmental review of the project
concludes there would be significant environmental effects unless it is infeasible
to avoid those impacts, and
WHEREAS, the Environmental Review Section of the Planning Department has
prepa red Ca nd i da te CEQA Ii ndi ngs of Fact pursuant to the Envi ronmenta 1 Qua 1 ity Ac t
of 1970, and
WHEREAS, the Planning Comnission of the City of Chula Vista held a public
hearing on the Candidate CEQA Findings on October 22, 1980.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission finds as follows:
1. Subject to standard development regulations and the conditions of approval,
the project will not result in significant environmental impacts in the following
a rea s :
a. Geology/soils
b. Archaeology
c. Schools
d. Biology
e. Those issued identified in Section 4.0 of EIR-81-1.
2. Implementation of the project would result in a significant land form
alteration and it is economically infeasible to implement alternatives that would
significantly reduce this impact.
BE IT FURTHER RESOLVED that the Planning Commission finds that the following
overriding considerations warrant approval of the project in light of adverse
environmental effects:
1. The project will include the participation by the developer in the imple-
mentation of a portion of the E1 Rancho del Rey circulation system which
wi 11 be henefi cia 1 to the cO:llmuni ty.
2. The design of the proposed subdivision provides good solar access to
the proposed dwelling units.
3. The project is located in an urbanizing area with most public services
available. Development in a remote area would likely have a greater
environmental impact.
