RESOLUTION NO. 10314
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA DELETING CONDITION 1 FROM RESOLUTION NO. 10173
APPROVING TENTATIVE SUBDIVISION MAP FOR BONITA CENTRE
EAST
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, the City Council of the City of Chula Vista has
heretofore on July 8, 1980 approved a tentative subdivision map
for Bonita Centre East with the condition that the developer
devote a minimum of 11 units on or off site to sell at a price
affordable by moderate income families, and
WHEREAS, the developer of Bonita Centre East has
requested removal of said condition to Council Resolution No.
10173 approving said tentative subdivision map, and
WHEREAS, the Planning Commission of the City of Chula
Vista has heretofore by a vote of 6 to 1 recommended that the City
Council delete the condition for moderate income units by Planning
Commission Resolution No. PCS-80-21, a copy of which is attached
hereto and by this reference made a part hereof the same as though
fully set forth herein.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Chula Vista amends the tentative subdivision map for
Chula Vista Tract 80-21 Bonita Centre East by the deletion of
Condition 1 requiring that 11 units be made available for moderate
income families.
BE IT FURTHER RESOLVED that the City Council does adopt
the finding made by the Planning Commission that the tentative
subdivision map as amended is in conformance with the Housing
Element of the General Plan in that the applicant has addressed
the problem of providing housing for low and moderate income
families.

ADDENDUM TO RESOLUTION NO. PCS-80-2l
RESOLUTION OF THE CITY PLANNING COMMISSION RECOHMENDING TO THE
CITY COUNCIL THE DELETION OF CONDITION 1 FROM RESOLUTION PCS-80-2l
WHEREAS, Resolution PCS-80-2l, recommending approval of a tentative sub-
division map for Chula Vista Tract 80-21, Bonita Centre East, included as
condition NO.1 the requirement that the applicant provide 11 housing units at
pri ces afforda bl e by modera te income famil i es or pay a fee in 1 i eu of such
hous i ng, and
WHEREAS, on September 29, 1980, ADMA Co., Inc., developer of Bonita Centre
East, requested removal of condition 1 of Planning Commission Resolution PCS-80-2l
and City Council Resolution No. 10173, and
WHEREAS, the City Planning Commission set the time and place for a public
hearing to consider said request and notice of said hearing, with its purpose, was
given by publication in a newspaper of general circulation in the city at least ten
days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7:00 p.m.
October 22, 1980, in the Council Chambers, 276 Fourth Avenue. before the Planning
Commission and said hearing was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
From facts presented to the Planning C0mmission, the Commission recommends
the deletion of condition 1 from Resolution PCS-80-2l, and the revision of finding
3.c relative to conformance with the Housing Element to read as follows:
The applicant has addressed the problem of providing housing for low and
moderate income families.
The Planning Commission directs that this resolution be forwarded to the
City Council and a copy be sent to the applicant.
PASSED AND APPROVED BY THE CITY PLANNING COMMISSION OF CHULA VISTA, CALIFORNIA

Dear Honorable Commissioners
We have been informed by the City of Chula Vista Planning
Department that the above referenced residential project
might be subject to "inclusionary zoning." He have also
learned that the City of Chula Vista has no defined policy
in this area. wilile we question whether inclusionary zoning
is a viable method for achieving its stated goals, the
purpose of this letter is not to debate that point, rather,
we believe, with reference to our project, that inclusionary
zoning is neither appropriate nor desireable because of
the many unique factors present in our project.
After carefully considering all aspects of this matter,
including a review of the history of our development and
the numerous conversations we have had with ~rr. James Peterson,
Mr. Joe Sanseverino (Community Development Department), and
other officials of the Ci ty of Chula Vis ta, we reasonably and
sincerely believe that, to the extent inclusionary zoning
might otherwise be applicable to our project, a waiver of
such zoning should be granted for the following justifiable
reasons:

2. Existing homeowners' attitudes (open space)
3. Adma's high quality construction orientation
4. The Planning Department's encouragement of
the following: .
A. Low density unit orientation
B. Dense and detailed landscaping
C. Various Precise Plan restrictions (many
of which add to the cost of construction)
1. Stuccoed retaining walls
2. Dark window mullions
3. Automatic garage door openers
4. Concrete driveways
5. Enriched paving
5. The economic reality that requiring the sale of
some units at a below "market" price will only
force the price of the unregulated units higher,
and thus preclude another group of potential
purchasers from entering the home buying market.
There are also the related problems of preventing
homeowners' windfall profits and controlling future
sales of the inclusionary zoned units.
It is our considered judgement that an "inflexible" approach
to inclusionary zoning is not good policy, and that if inclusion-
ary zoning is concluded to be desireable, each potential project
should be carefully analyzed to determine if it is an appropri-
ate candidate for the implementation of such a social policy.

For approximately 18 months this company has been in close
communication with the City of Chula Vista. At every level
of planning, the City has meticulously analyzed our project,
and on every occasion that this project has been discussed,
the City has encouraged a high quality, low density, carefully
planned development. We believe that the honorable members
of the Planning Commission will agree with us that this project
is not, and should not be oriented toward low income housing.
As presently designed and land planned, the Bonita Centre
Townhomes project will represent excellence in property
development. Therefore, we respectfully request an uncon-
ditional waiver of inclusionary zoning as to our project.
We truly believe such a decision is justified by the facts and
would represent responsible government action.
