HomeMy WebLinkAboutReso 1980-10313 - p..... ~ RESOLUTION NO. 10313 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DELETING CONDITION 2 FROM RESOLUTION NO. 10103 APPROVING TENTATIVE SUBDIVISION MAP FOR El RANCHO DEL REY UNIT 6 The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Council of the City of Chula Vista has heretofore on May 27, 1980 approved a tentative subdivision map for El Rancho del Rey Unit 6 with the condition that the developer devote a minimum of 37 units to be made available at rents affordable by low or moderate income families, and WHEREAS, the developer of El Rancho del Rey Unit 6 has requested removal of said condition to Council Resolution No. 10103 approving said tentative subdivision map, and WHEREAS, the Planning Commission of the City of Chula Vista has heretofore by a vote of 6 to 1 recommended that the City Council delete the condition for low and moderate income units by Planning Commission Addendum to Resolution No. PCS-80-5, a copy of which is attached hereto and by this reference made a part hereof the same as though fully set forth herein. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista amends the tentative subdivision map for Chula Vista Tract 80-5 El Rancho del Rey Unit 6 by the deletion of Condition 2 requiring that 37 units be made available for rent by low and moderate income families. BE IT FURTHER RESOLVED that the City Council does adopt the finding made by the Planning Commission that the tentative subdivision map as amended is in conformance with the Housing Element of the General Plan in that the applicant has addressed the problem of providing housing for low and moderate income families. DATED {seall City Clerk CC':'660 [0'3(3 r~lJ""""'''IJV'1 IV n.......'.J1_VI...VI1 I1V. . v"'-VV-,J RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE DELETION OF CONDITION 2 FROM RESOLUTION PCS-SO-5 AND CITY COUNCIL RESOLUTION NO. 10103 WHEREAS, Resolution No. PCS-SO-5, recommending approval of a tentative subdivision map for Chula Vista Tract 80-5, El Rancho del Rey Unit 6, included as condition 2 the applicant's provision of 10 per cent of his housing units at a price affordable by low or moderate income families either on the subject site or in an alternative location acceptable to the City Council, and WHEREAS, on October 2, 19S0 El Rancho del Rey, developer of Chula Vista Tract SO-5, requested deletion of condition 2 of Planning Commission Resolution No. PCS-SO-5 and City Council Resolution No. 10103, and WHEREAS, the City Planning Commission set the time and place for a public hearing to consider said request and notice of said hearing, with its purpose, was given by the publication in a newspaper of general circulation in the city at least ten days pri or to the da te of sa i d hea ri ng, and WHEREAS, a hearing was held at said time and place, namely 7:00 p.m., October 22, 1980 in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: From facts presented to the Planning Commission, the Commission recommends the deletion of condition 2 from Resolution PCS-80-5 and from City Council Resolution No. 10103, and the revision of finding c relative to conformance with the Housing Element to read as follows: The project proposes three housing types, single family detached, zero lot line, and couplets, which provides a varied choice of units within the subdivision." Additionally, the applicant has determined that subsidy programs are not available to allow units to be rented at prices affordable by median income famil i es. The Planning Commission directs that this resolution be forwarded to the City Council and a copy be sent to the applicant. This condition requires provision for 10% of the housing units as rental units affordable to low or moderate income families. We have worked diligently with the City Community Development and Planning departments and other appropriate governmental agencies seeking a solution to this requirement. We have explored approximately 10 different alternatives to provide the required housing, none of which were both accept- able and feasible within the rental rate or selling price constraints set down by the City. Your early attention to this matter will be greatly appreciated.
