RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROVING SUPPLEMENTAL AGREEMENT NO. 2 TO
EXISTING LOCAL AGENCY-STATE AGREEMENT NO. 11-5203
COVERING FEDERAL-AID PROJECTS AND AUTHORIZING THE
MAYOR TO EXECUTE SAID SUPPLEMENTAL AGREEMENT NO. 2
The City Council of the City of Chula Vista does hereby
resolve as follows:
N~" THEREFORE, BE IT RESOLVED that that certain
Supplemental Agreement No. 2 to existing Local Agency-State
Agreement No. 11-5203, covering Federal-Aid Projects, between the
City of Chula Vista, a municipal corporation, and the State of
California, dated the 16th day of October, 1980, a copy of which
is attached hereto and incorporated herein, the same as thou~
fully set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of
Chula Vista be, and he is hereby authorized and directed to
execute said Supplemental Agreement No. 2 for and on behalf of the
City of Chula Vista.
BE IT FURTHER RESOLVED that the sum of $109,735 is
hereby authorized to be expended for deposit to State prior to
award of contract for Third Avenue by City.

IN THE
City of Chula Vista

Pursuant to the Federal Aid for Urban Systems Acts, the attached
"Program" of Federal Aid Urban System Projects marked "Exhibit B" is hereby
incorporated in that Master Agreement for the Federal-Aid Program, which
was entered into between the above-named LOCAL AGENCY and the STATE on
December 19, 1978 , and is subject to all of the terms and
conditions thereof.
The subject program is adopted in accordance with Paragraph 2 of
Article II of the aforementioned agreement under authority of City~~~
Resolution No. 10307 approved by the City Council~~>>X
~~on October 28, 1980 (see copy attached).

2. The Cicy will prepare PS&E, acquire R/W, advertise, award, and administer construction.
The State will pay the contractor by use of the Local Agency Automated Pay System.
3. The actual funds for the project will be set up on the basis of contract prices after
the bids for the work have been opened. In awarding, or agreeing to award the contract,
the local agency agrees that the payment of Federal funds will be limited to the detail
estimate amount approved by the Federal Highway Administration in the Federal-Aid
Project Agreement (PR-2), or its modification (PR-2A), and accepts any increases in
local agency funds.
4. The availability of Federal funds will be subject to 'meeting deadlines and/or other
conditions as may be im)osed by the Director upon the recommennation of the Federal-Aid
Urban Advisory Committee.
5. The use of Federal fund', for this project is subject to the preject being included in
the multiyear FAD Prog:7am for San Diego County.

6. The portion of the loca", agency funds, as contained herein in Exhibit B, required
to match Federal Highway Funds in this project will be provided by the State as
authorized by Item 169." of the Budget Act of 1979 and allocate,j by the California
Transportation Commission.
7. The local agency's share of matching funds will be 100% of the ','\illount remaining and
not covered by Federal participation and 169.1 funds.
8. The 169.1 funds in the ',.roject will be set up on the basis of t,1e preliminary estimate
as shc,vm on Exhibit B and may be increased, if funds are available, to the amount
required to match Feder?l funds as shown in the detail estimate and approved by the
FHHA in the Federal-Aid Froject Agreement (PR-2), or its modification (PR-2A).
9. In the event the 169.1 funds required are less than the amount shown in Exhibit B
or the detail estimate, the excess may revert to (1) the county allocation provided
the funds are released prior to June 30, 1980; (2) county projects provided the
funds are released prior to June 30, 1982 and providing project<s) containing Item
169.1 funds can utilize the released funds.

Unexpe,:lded Item 169.1 fvnds may revert to the 169.1 appropriation after June 30, 1982.
The City may be required to report to the California Transportation Commission con-
cerning use of Item 169.1 funds and that the use of any funds heed as a result of the
receip~ of Item 169.1 funds are identified.
12. Caltra':ls has granted approv21 to Chula Vista's request for the use of Caltrans Local
Agency Automated Pay Syetem.
A. ChClla Vista will abide by the requirements as :;et forth in the State of California
Department of Transportation's Policy and Procedure Hemorandum P80-10, dated Harch 20,
1980, and as revised Hay 30, 1980, regarding the use of Caltrans Local Agency Automated
Pay System.
B. Attention is directed to the follmving pertinent requiremen~:s for the use of the LAAPS.
1. The local agency's share of the construction cost is estimated to be $109,735.
This amount shall be deposited with the State prior to the award of the contract.
2. Subsequent to the bid opening, the Detail Estimate as bcsed on the bid of the
successful bidder will determine the local agency's share of the construction cost.

(a) Should the local agency's share of the constructior cost be greater than the
amount on deposit with the State for this purpose, a supplemental deposit of
the difference will be required prior to the alvard of the contract.
(b) Any local 2gency funds on deposit with the State net required for the agency's
share of the construction cost as determined by the Detail Estimate will be
returned to the agency.
