'J COUNCIL AGENDA STATEMENT Item 8 Meeting Date 5-5-81 ITEM TITLE: Resolution /(J)f/~....3 Approving agreement to not protest the formation of an improvement district for Roosevelt Street widening , SUBMITTED BY: Ci ty Eng ineer ~ (4/5ths Vote: Yes_ NO-1L) In conjunction with the conditional approval by the Design Review Comm i t tee for development at 325 Roosevel t Street, the 0 wner is required to enter into an agreement with the City to not oppose the formation of a 1911 Act District or similar proceeding in the event that such an action for the 300 block of Roosevelt Street is initiated in the future. It is my RECOMMENDATION: That the Council approve subject agreement and authorize the Mayor to execute the agreement on behalf of the City. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: In June of last year, Mr. Robert Pruitt submitted a request to construct an 11 unit apartment house at 325 Roosevelt Street. The Design Review Committee considered and conditionally approved the proposal on July 17,1980. One of those conditions states that Mr. Pruitt enter into an agreement with the City to not oppose any 1911 Act or similar proceeding which may occur in the future to widen the 300 block of Roosevelt Street. Roosevelt Street is a fully improved street, however, the curb to curb width is only 30 feet while our standard width is 36 feet wide. This width has worked satisfactorily for many years, however, the area is in transition from R-l to R-3 devevelopment. We believe as more traffic is generated some solution to the problem will need to be made. Alternatives could be to: 1. Widen the street to 36 feet curb to curb. 2. Eliminate parking on one side. 3. Make the street one-way. Widening the street would be the most expensive by far and also requires removal of all the parkway trees. Until a final decision is made we recommend that new developments agree NOT to protest any future assessment districts. Item 8 Meeting Date 5-5-81 Mr. Pruitt has properly executed his portion of the agreement and has submitted it for approval by the City Council.
