Deputizing the Firm of McDonald, Hecht & Worley as Deputy City Attorneys to Conduct the Condemnation Proceedings /uf'l-t SUBMITTED BY: City Attorney (4/5th Vote: Yes X No The Specific Plan of El Rancho del Rey contains two elements known as the South College Specific Planning Area and the East College Specific Planning Area. The development of these two SPAs will require the widening and improvement of Telegraph Canyon Road between Casa del Rey and Otay Lakes Road. The present property owner, Pacific Scene, Inc., nON desires to go forward with that development and to initiate necessary proceedings for acquisition either through negotiation or condemnation of the necessary right of way and to construction the widening of Telegraph Canyon Road in that area. RECOMMENDATION: It is recommended that the City Council adopt: a. A Resolution declaring the public necessity to acquire right of way for Telegraph Canyon Road b. A Resolution approving an agreement with Pacific Scene to cover the full costs of the acquisition of Telegraph Canyon Road right of way, and c. A Resolution deputizing the firm of McDonald, Hecht & Worley to conduct the condemnation proceedings. Agenda Item 7 Page Two Meeting of 4/21/81 determining the necessity for such acquisition through either negotiation or condemnation. A hearing has been set for April 21, 1981 to hear any objections from the several property owners owning such right of way areas. If the City Council authorizes the condemnation for the widening of Telegraph Canyon Road, it is then necessary to approve the agreement with Pacific Scene providing for the full payment of the costs of acquisition by that developer and, secondly, to approve the resolution deputizing the attorneys whom they have selected to carry out the legal work for such condemnation. ~ by the City Council of Chula Vista, CC\iiiornia Dated ~-~L-~/ .~..-:... /oC(c;/ -.
