HomeMy WebLinkAboutAgenda Statement 1981/04/07 Item 11 COUNCIL AGENDA STATEMENT Item 11 Meeting Date 4-7-81 ITEM TITLE: Resol ution /pJ/;.tJ Approving ~1aster Property Tax Transfer Agreement Assistant City Manager ~ (4/5ths Vote: Yes___ No~) SUBMITTED BY: On February 3, 1981, the City Council approved in concept the negotiated property tax dis- tribution formula as developed by a Mayors' Committee and accepted by the Board of Supervisors. The attached t'aster Property Tax Transfer Agreement has been developed by County staff, re" viewed by San Diego City staff, and reviewed by this office. The agreement incorporates the provisions as agreed. Therefore, it is my RECOMMENDATION: That the City Council adopt the resolution. BOARDS/COMMISSIONS RECOMMENDATION: N.A. DISCUSSION: The key provisions of the agreement provide: A. In the annexation of undeveloped land, there will be no transfer of base taxes to the annexing city. All base taxes will remain with the Special District, if one, and the County. Incremental growth occurring as a result of subsequent development of the property or increased value, even if the land remains undeveloped, will be divided between the City and County on a pro-rata basis with the same percentage distribution as property already within the City. In Chula Vista's case, the City will receive 41% of all pooled tax resources previously shared by Special Districts and the County. B. In the case of developed property, the City wi 11 recei ve 17 1/2% of the pooled taxes previously distributed between the County and Special Districts. Incremental growth occurring on developed property will be distributed .in the same manner as indicated above for the undeveloped property. Approval of the Master Property Tax Transfer Agreement will eliminate the need for the City Council to act separately upon any of the annexations currently held in abeyance and all future annexations that may occur. On the basis of the agreement, LAFCO and other agencies will process annexations routinely and the County Auditor will handle the details of making tax distribution in accordance with the agreement. FINANCIAL IMPACT: The City will receive property tax from annexed property in accordance with the formula provided in the agreement.
