In addition, the owner is required to sign an agreement with the City agreeing to not protest the formation of an improvement district for Alvarado Street. It is my RECOMMENDATION: That Council adopt the resolution accepting the easements for street tree purposes and approving the agreement. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: On March 16, 19B1, the property owners, Henry Palacios and Yvonne Palacios, executed the necessary documents granting easements for street tree purposes to the City. Said easements provide for an 8 foot wide easement along Del Mar Court and a 10 foot wide easement along Alvarado Street. The owners have also signed an agreement to not protest the formation of an improvement district for Alvarado Street. The signing of this agreement was required to assure participation by the owners in an improvement district for said street should such a district be formed. At this time, the City has no plans to widen Alvarado Street. The owners were not required to widen the street as a condition of approval of their parcel map because such work is not presently considered feasible. A plat is available for Council viewing.
