ITEM TITLE: Resolution Awarding new contract for the
construction of overhead trellis structure and restaurant
remodeling in Memorial Park

On February 24;\19~1. the Council accepted bids and awarded four
separate contrac;ts for the construction of improvements in
Memorial Park. Olle of the projects was for construction of an
overhead trellis st.ructure and restaurant remodeling. This work
involves the renovation and remodeling of existing restaurant
building structure. \installation of drinking fountains and
construction of overhead trellis structure to be util ized as a
senior's information and' .referral center.
Bids were received from s.ix contractors and the contract was r-
awarded to the lowest bidd~'r. Helton's Construction. Since the
award of the contractr Mr. Helton has had some financial problems
and does not believe he can accomplish the work. Please refer to
attached letter to me from Mr;,Helton discussing his financial
problem. Accordingly. it is my
RECOMMENDATION:
That Council:
1. Award the contract to the second low bidder. Rupe & Caster.
Inc.. Lakeside. CA in the amoun't of $29.939.00& foreclose on
the bidders bond for Helton's Construction.
BOARD/COMMISSION RECOMMENDATION: Not applicable.
DISCUSSION:
Bids for the overhead trellis structure and, restaurant remodeling
were received from six contractors as follows:
Helton's Construction - Chula Vista
Rupe & Caster Construction. Inc. - Lakeside
Vista Sierra Construction - Chula Vista
Center Construction - National City
M. Kevin O'Neill Construction Co.. Inc. -
Coronado
Soltek of San Diego - San Diego

The engineer's estimate for construction of this work was
$49.215.

Mr. Helton's bid bond for this project is $2,345.00. The
difference between his bid and the next bidder is $6,494.00 If
the City Council wishes to take action against the bond it will
still not make up the difference in the bids. Mr. Helton has
asked the City not to foreclose on his bid bond because he claims
it would put him out of business.
I believe it is my duty to protect the City's interest which is
to enforce the bidding procedures in the contract documents.
These procedures permit us to foreclose on the bidding bond in
the amount of $2,345.00. Mr.Hel ton indicated to me that he would
like to address the Council to express the circumstances which
made him unable to complete the contract.
Since Helton's Construction is unable to perform the work, we
recommend awarding the contract to the second low bidder, Rupe &
Caster Construction, Inc., Lakeside, CA. We have contacted this
company and they are looking forward to performing the work.
They also indicated they will have no problem in bonding this
project.
FINANCIAL STATEMENT: Adequate funds have already been authorized
for construction of this project by the previous Council's action
on February 24, 1981.

FISCAL IMPACT: The City will assume responsibility for
maintenance of Ithe facility upon completion of the work.
