(4/5ths Vote: Yes Nom) The owner of property at 1426 Melrose Avenue has requested a permit to construct a room addition upon the City's sewer easement located on his property. At its meeting on December 23, the City Council continued this matter to its meeting of January 6, 1981, requesting more information on alternative measures. It is my RECOMMENDATION: That the City Co uncil approve subject encroachment permit with the condition stated in the body of this report and authorize the City Engineer to issue the permit. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: On November. 3, 1980, Stephen Kirby, acting as agent for Henry Contreras, owner of the property at 1426 Melrose Avenue requested an encroachment permit to extend an existing bedroom into a sewer easement on the north side of the property. The proposed configuration is said to be the only feasible way of providing an addition with wheelchair access, which is a requisite for the owner. The proposed addition will extend into the easement to a maximum of approximately 6-1/2 feet. According to the improvement plan fot'the sewer main, the room will be directly over the main. Due to the depth of the sewer. which ranges from 12 to 16 feet deep, this would pose a problem in the future if excavation to repair or replace the main is necessary. As stated in the previous report, this sewer main serves approximately 250 homes and could serve future developments to the east. An alternative solution to future problems would be to enlarge the existing sewer rerouting it to the northerly side of the easement (see Exhibit "A") prior to constructing the room addition. This, however, would mean incurring an estimated ex pense of approximately $5,000.00. Further investigation reveals that the existing 8-inch main was constructed with an average grade of 5.7$ which provides adequate capacity far the existing load and for any additional development within the foreseeable future. This, plus the fact that maintenance is facilitated by existing manholes located only 138 feet apart indicates that there would be no immediate problem with the proposed construction. In the event that excavation to repair or replace the sewer main is necessary, the City will be held harmless from any liability for damage to the structure within the easement resul ting from sa id excavation. 2. The owner shall be responsible for any added cost of sewer repair or replacement occasioned by the existence of the encroachment. To ensure that the owner and any future owners of this property are made aware of this possible problem, I recommend that the City Clerk be directed to forward the agreement to the County Recorder's office.
