When the material was placed it created a new slope within an open space lot adjacent to his property. This fill has also covered existing landscaping and irrigation lines on the slope within the open space. It is my RECOMMENDATION: That the City Council approve the subject encroachment permit with the conditions stated in the body of this report and authorize the City Engineer to issue the permit. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: On October 14, 1980, it was brought to our attention that fill material had been brought into the subject proprty and dumped upon the existing slope at the rear of the lot. It was noted that in the process of dumping, the existing landscaping and irrigation lines which lie within the City's Open Space Lot 117 of Bonita Ridge Estates, Unit No.. 2 were buried. The top of the originally graded slope did not coincide with the property line on this lot. The owner reported that erosion of the existing slope was undermining the corner of his patio and he was fearful of the consequences. Mr. Kim brought in dirt and extended the top of the slope to bring it closer to the property line to protect the patio and improve the landscaping. A field inspection by this department and the City's Landscape Architect indicated that an Encroachment Permit could be issued with the following conditions included and not be detrimental to the City's interests: 1. Permittee shall post a bond in the amount of $2,000.00 to guarantee the restoration of landscaping and irrigation. 2. Restoration operations shall be completed within 60 days of issuance of the permit. 3. Landscaping and irrigation shall be done in accordance with the approved plans for Bonita Ridge ~states, Unit No.2. 4. No further .fill '.,shall be placed. by Mr,. '" .~ '. Page 2, Item 11 t1eeting Date 9-23-8D 5. No structures shall be placed upon the added fill without first obtaining a building permit from the Chula Vista Department of Building & Housing. The $2,000.00 bond may be released upon completion of landscaping and irrigation and acceptance of the work by the City's Landscape Architect. Mr. Kim has paid the required $200.00 fee for the permit processing. The fill is at the top of a small canyon and presents no hazard to dwellings or human life. I believe the encroachment permit conditions stated will with the ensure restoration of landscaping and irrigation fac il i.ties. The City has not yet accepted the responsibility for maintenance of Open Space Lots within this subdivision. That responsibility is now being taken care of by the developer of Bonita Ridge Estates #2. We will accept responsibility after the restoration of this new slope is completed.
