The City owns fee of an earlier eminent domain action. The Subdivision Map Act requires that all parties having record title interest in the real property contained within the boundaries of a Parcel Map consent to the preparation and recordation of such Parcel Map. Such consent is indicated by appropriate signed statements on the map. It is my RECOMMENDATION: That Council adopt a resolution authorizing the Mayor and the City Clerk to sign Parcel Map 81-3 for and on behalf of the City of Chula Vista. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: ,The City Attorney requested the owners to process Parcel Map 81-3 in ~rder to clearly establish the boundaries of parcels adjacent to land (Crest Drive) obtained by the City through a condemnation action. Eminent domain procedures have been used in obtaining right-of-way for Crest Drive and Paseo del Rey through this parent property (which extends from Halecrest Drive to just east of pasel del Rey). Crest Drive was acquired in fee simple absolute through condemnation proceedings associated with the development of Princess Crest Subdivision (Map 5293). paseo del Rey was condemned as an easement for roadway purposes. The City does not have fee title interest for the Paseo del Rey right-of-way. Since Crest Drive was condemned in fee simple this right-of-way represents a separate parcel in which the City has record title interest. Section 66445 (f) of the Subdivision Map Act requires all parties having such an interest to consent to the preparation and recordation of said Parcel Map. No right-of-way or other City property will be adversely affected by the proposed Parcel Map. Therefore, it is appropriate for Council to adopt the resolution authorizina the Mayor and City Clerk to sign Parcel Map 81-3. FISCAL IMPACT: N/A J D3f?f. .
