Approvi ng Casa Del Rey Reimbursement Agreement and Final Allocation of Costs City Engineer -vfl~p~ (4/5ths Vote: Yes___ No~) SUBMITTED BY: On September 28, 1980, Council approved the formation of the Casa Del Rey Reimbursement District. Implementation of this District is dependent upon approval of the Reimbursement Agreement and Final Allocation of Costs. Such documents have been prepared and are submitted for Council approval. It is my RECOMMENDATION: That Council adopt a resolution approving the Casa Del Rey Reimbursement Agreement and Final Allocation of Costs and authorize the Mayor to execute said agreement for the City of Chula Vista. BOARD/COMMISSION RECOMMENDATION: N/A DISCUSSION At its meetings of August 19, 1980, and September 23, 1980, the City Council heard public testimony concerning the formation of the Casa Del Rey Reimbursement District. Following the Council meeting of August 19, staff met with representatives of the interested parties in an attempt to achieve a fully supported proposal for the District. Several modifications were incorporated into the proposal, and after additional public input and discussion at the meeting of September 23, the Council approved formation of the District. Staff was directed to return with the necessary resolution and related documents. Such a resolution has been prepared and is submitted for approval. The related documents include (a) the Casa Del Rey Reimbursement Agreement, (b) the Final Allocation of Costs for the Casa Del Rey Reimbursement District, and (c) Exhibits A, B-1 through B-6, C-l and C-2 which are pertinent to both items (a) and (b). These combined documen\s incorporate the basic agreement between the City, Pardee Construction Company and Dale Horton in which the manner of collecting and disbursing reimbursement charges is described, the manner in which the charges are calculated and the areas which are subject to payment of reimbursement charges are defined. . All of these items are in accordance with the proposal as approved by Council. The agreement provides that a credit shall be given to El Rancho Del Rey. This credit which amounts to $9,980 is for the estimated cost of completing Paseo Ladera across the open space between Telegraph Canyon Road and the City of San Diego right-of-way for the Dtay waterline. This credit is based on estimated quantities of work and unit prices which were paid by the Pardee Construction Company when the Casa Del Rey improvements were bui It. / () 3c{9 Form A-113 (Rev. 11/79) -.., - EXHIBITS Agreement Resolution X Ordinance Plat Notification List Agreement, Allocation -- Other of Costs ENVIRONMENTAL DOCUMENT: Attached Submitted on o 'l' Page 2, Item 7 Meeting Date 12-16-80 The Agreement and the Final Allocation of Costs incorporated therein also provides for credits to Pardee Construction Company. The manner in which the reimbursement charges will be calculated, collected and disbursed is stated. The land subject to reimburse- ment charges is described and shown on exhibits which are parts of the agreement. The reimbursement to be paid by El Rancho Del Rey #6 is approximately $57,590 in area charges. The credit of $9,980 may be deducted from this amount. No frontage charges appear appropriate since no lots obtain access from the streets from which frontage charges arise. Future development may involve additional area charges along with frontage charges. FISCAL IMPACT: The agreement provides for the City to retain 1% of the amounts collected. Should all of the indicated amounts be collected, the City would realize approximately $3,860.
