lights on Third and Fourth Avenues until .May 1, 1981

The installation of the strerr'li9hts on Third Avenue (between "H" and "I" Streets) and on
Fourth Avenue (between "F" and "G" Streets) was supposed to be complete by December 1, 1980
(in accordance with contract extension - resolution 10307). However, SDG&E has informed
the City that the underground electrical service for the street lights on Third Avenue
will not be energized until April 15, 1981. Therefore it is necessary to extend this
contract to allow the contractor time to make the electrical connections after the service
points are energized. It is my
RECOMMENDATION: That Council approve an extension of this contract until May 1, 1981.

DISCUSSION:
The contract for installation of City owned street lights on Third and Fourth Avenues was
awarded to Perry Electric in July 1980. The lights are being installed in conjunction
with utility undergrounding on those streets. The original SDG&E underground conversion
project schedule called for energizing of the underground service points in October 1980.
The contract completion date, including a time extension requested by Perry Electric due
to a delay in receipt of material, ran through December 1, 1980.
SDG&E has recently informed the City that the underground service points on Third Avenue
next to the County Court facility will not be energized until April 15,1981. This delay
is due to problems associated with Court construction and reorganization efforts at
SDG&E.
Perry Electric has completed the installation of all conduit, poles, and luminaires. The
only work remaining is to connect the system to the new power source to be provided by
SDG&E. I believe there is adequate justification to extend the contract time limit. The
contractor has virtually completed his work and now must wait several months for SDG&E
to provide the power source.
The normal contract procedure is to withhold 10 percent of the contract amount until 35
days after acceptance of the work by City Council. To follow the normal procedure in this
case, I believe, would be unfair and may place the City in a position of owing the
contractor extra funds. The contractor and I agree that the best solution would be to
pay the contractor his entire amount due less $500 which is the estimated cost of move-in
to make the electrical connection. The Council would not accept the contract until May
1981 after the lights have been tested and are operating.
The City is. adequately protected since we will not release the bonds for performance and
material and labor until 35 days after the work is officially accepted by City Council.
FINANCIAL IMPACT: The City will hold $500 of the contract cost of $32,647 until the
project has been completed. There will be no additional cost to the City due to this
contract extension.
