ITEM TITLE: Resolution /1J3~/ Approving repayment for sewer lateral construction at
27 and 35 Flower Street and 124 Hilltop Drive

In conjunction with the construction of improvements for the Morgan-Gardner Subdivision,
the developers built three sewer laterals to properties at 27 and 35 Flower Street and
124 Hilltop Drive. These properties are outside the Morgan-Gardner Subdivision. It is
my
RECOMMENDATION: That Council adopt a resolution approving repayment to Morgan-Gardner
Inc. for sewer lateral installation for the three properties outside that subdivision.

01 SCUSS ION:
On October 21, 1980, Council accepted the public improvements for Morgan-Gardner
Subdivision. Included in the improvements for that subdivision were three sewer laterals
to properties outside the subdivision. The laterals were built in advance of their
need to avoid cutting into the street pavement within a short time of the initial Flower
Street construction. The developers have now requested reimbursement for the cost of
sewer construction which does not benefit their project.
Upon application for connection to City sewer mains, the owners of 27 and 35 Flower
Street and 124 Hilltop Drive will be required to pay sewer connection fees. One portion
of that fee is ordinarily for lateral installation.
Section 13.16.030 of the Municipal Code allows the Council to appoint an agent to install
sewer laterals. Morgan-Gardner Inc. was in essence appointed the City's agent to install
the laterals for 27 and 35 Flower Street and 124 Hilltop Drive when the City approved
the improvement plans for their subdivision. Section 13.16.030 of the Municipal Code
also provides for Council to fix a fee for installation of a sewer lateral and to pay
said fee to such an agent.
Section 13.16.170 of the Chula Vista Municipal Code provides that the City Engineer shall
determine a proper sewer charge against those properties benefiting but not contributing
to the construction costs of the sewer facilities installed.
I recommend that Council set the fee to be paid and authorize)that said fee be paid to
Morgan-Gardner Inc. as repayment for the sewer lateral installation. I further recommend
that the fee be the same amount that the City would normally collect under Section
13.16.02(B) (Connection Charges) of the Master Fee Schedule. The total repayment will
be $1460.00 should all of these laterals be used. The individual amounts proposed for
reimbursement are $490.00 at 27 Flower Street, $490.00 at 35 Flower Street and $480.00
at 124 Hilltop Drive.
FISCAL IMPACT: A nominal cost to the City for the time required to process the repayment
wi 11 be experi enced . All other fees associ ated with- connecti on to the City sewer sys tem
will be collected.
