COUNCIL AGENDA STATEMENT Item 8 ITEM TITLE: Meeting Date Resolution I033(J - Ordering the "L" Street/Church of Christ Reorganization. 11/25/80 SUBMITTED BY: Director of Planning,~ (4/5ths Vote: Yes No~) On April 9, 1979 the City received an appl ication from the Chula Vista Church of Christ, 470 "L" Street, for a reorganization to the City of Chula Vista of 3.53 acres of property located on the south side of "L" Street 'between Fourth and Fifth Avenues. Council has not yet initiated proceedings because of the pending agreement with the County 6n the transfer of property tax pursuant to AB-8. In accordance with the Government Code this proposal will be abandoned unless Council completes proceedings before April 7, 1981. Therefore, it is my RECOMMENDATION: That Council: Adopt a resolution ordering the "L" Street/Church of Christ Reorganization involving annexation to the City of Chula Vista and detachment from the Montgomery Sanitation District, the Montgomery Fire Protection District and the San Diego County Flood Control District - Zone 3. BOARDS/COMMISSION RECOMMENDATION: Not Applicable DISCUSSION 1. The applicant is requesting annexation to the City in order to obtain a higher level of pOlice and fire protection, and comprehensive city services for the church property. In addition, the applicant proposes the future construction of a new church wing to accommodate a fellowship auditorium and six classrooms, and the upgrading of existing parking areas and landscaping. The proposal area is shown on Exhibit A. 2. Prezoning On October 26, 1976 the City Council adopted ordinance No. 1709 prezoning the territory from R-3-G-P to R-3-P-14. This zoning classification was found to be in substantial conformance with the General Plan designation of Medium Density Residential (4-12 Du/ac). 3. Environmental Review On August 26, 1976 the Environmental Review Committee conducted the Initial Study (IS-76-63) of possible adverse environmental impacts of the above mentioned prezoning project. The committee concluded that there would be no significant effects and made a draft Negative Declaration which was certified by the Planning Commission on September 13, 1976 and by the City Council on October 26, 1976 as part of Ordinance No. 1709. Although the subject reorganization was not considered under IS-76-63, the Environmental Review Committee at its meeting,of October 30, 1980, reviewed the previously adopted Negative Declaration and found it to be applicable to the proposed "L" Street/Church of Christ Reorganization. 4. Staff has not brought this item to Council earlier to i,nitiate proceedings because to date the City and the County Board of Supervisors have not reached an agreement on the transfer of property tax pursuant to AB-8. However, the amount of tax revenue generated by the subject property is very small and the matter has been pending for some time. The expansion of the city boundary which will result from the reorganization is a logical one. City services can readily be provided to the area. 5. Proposed Abandonment Section 54799.2 of the Government Code requires that a proposal for which proceedings are not compl eted within one year after LAFCO approval must be considered "abandoned", unless an extension of time has been requested and authorized by LAFCO. Accordingly, this proposal will be deemed abandoned after April 7, 1981 if proceedings have not been completed, or an extension of time'has not been granted. LAFCO has informed staff that if the only reason for non-completion is agreement on the property tax transfer, the City Council could adopt an ordering resolution which in effect would complete proceedings. The Executive Officer could then withhold issuing a certifi- cate of completion until the resolutions of agreement pursuant to AB-8 are received from the City and County. Section 54799.2 would then not apply and abandonment of this proposal would be avoided. FISCAL IMPACT This will be determined by the formula established for the exchange of property tax revenues post annexation. Any impact will be very small.
