AN ORDINANCE OF THE CITY OF CHUIA VISTA AMENDING
CHAPTER 5.20 OF THE CHULA VISTA MUNICIPAL CODE BY
AMENDING SECTION 5.20.040 AND ADDING THERETO A NEW
SECTION 5.20.035, RESTRICTING INTERESTS OF CARDROOM
LICENSEHOLDERS TO ONE CARDROOM ONLY
The City Council of the City of Chula Vista does hereby
resolve as follows:
SECTION I: That Chapter 5.20 of the Chula Vista
Municipal Code be, and the same is hereby amended by adding
thereto a new Section 5.20.035 and amending Section 5.20.040 to
read as follows:
Sec. 5.20.035 License - Limitations on Interest.
No persons having an interest in or holding a
license to any cardroom in the City of Chula Vista may
make application for any available license in accor-
dance with the procedures set forth in this chapter;
provided, further, that no person having an interest in
a licensed cardroom in the City of Chula Vista may have
any financial interest or management interest regard-
less of the remoteness thereof in any other licensed
cardroom in the City of Chula Vista. Said prohibition
against any interlocking interest in cardroom opera-
tions shall include, but not be limited to, partner-
ships, corporations, marital or blood relationships.
Sec. 5.20.040 License - Initial Issuance Procedure.
Except for existing licensees as set forth in
Section 5.20.030, all applicants for available licenses
shall comply with the provisions of this chapter. Any
applicants requesting a license as permitted in Section
5.20.030 shall pay the sum as presently designated, or
as may in the future be amended, in the master fee
schedule to cover the cost of investigation and the
handling of applications, which sum shall be nonrefund-
able. No applicant requesting a license pursuant to
this section may have any financial or other interest
as set forth in Section 5.20.035 in any other applica-
tion being submitted to obtain a cardroom license.
Each application shall be totally independent and
unassociated with any other application being submitted
for the purpose of obtaining such a license. The

initial period for issuance of new cardroom licenses
shall be the month of May, 1977, and in the month of
May in subsequent years should there be additional
licenses available. After the termination of the open
period in May, no further licenses shall be issued
until the succeeding open period. In the event that
there are applications in excess of the number of
licenses available in accordance with the limitations
set forth in Section 5.20.030, based upon population,
the director of public safety shall conduct a public
lottery to select those applicants who shall be
investigated to determine if they are qualified to be
issued any available cardroom licenses as approved by
the director of public safety, subject to ratification
of the city council. Upon the issuance of available
cardroom licenses, the director of public safety shall
authorize the refund of any application fee to any
persons who were not subject to investigations.
SECTION II: This ordinance shall take effect and be in
full force on the thirty-first day from and after its adoption.

By a unanimous vote on December 21, 1982, the City Council
placed the ordinance on its second reading and adoption.
The ordinance prohibits any interlocking or joint interests in
two or more cardroom operations and stipulates that that each
cardroom licensed in the City of Chula Vista be totally independent
from any other cardroom in the City. It is believed that such a
process would insure that cardrooms remain low key and a small
scale recreational activity which would not become involved with
nor contribute to any potential criminal activities in the
community nor would they exercise any undue influence in the
community.
