SUMMARY
The San Diego Association of Governments (SANDAG) has notified local agencies that the San
Diego region may be eligible for the second round of American Recovery and Reinvestment Act
(AARA - II) funds. In order to be eligible for these funds, the projects must already be included
in the Regional Transportation Improvement Program (RTIP) and a contract must be awarded by
June 1,2010. Signed resolutions must be submitted to SANDAG by March 5, 2010. There are
two Chula Vista RTIP projects, CRV 35 & CHV48 that meet this criteria but a fund swap to
allow for the ARRA - II funds is necessary. Council is being asked to revise the project funding
from TransNet funds to ARRA - II funds, should the ARRA - II funds become available.

ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed actiVIty, consisting of a
proposed fund swap from TransNet funds to American Recovery and Reinvestment Funds
(AARA-II), for compliance with the California Environmental Quality Act (CEQA) and has
determined that the activity is not a "Project" as defined under Section 15378 (b)(4) of the State
CEQA Guidelines because the fiscal activity involves a request for a change in funding sources
only, from presently approved local TransNet funds to federal ARRA-II funds. Therefore,
pursuant to Section 15060 (c)(3) of the State CEQA Guidelines the activity is not subject to
CEQA. Should the solicited federal funds be obtained then, additional environmental review
may be necessary in order to comply with the National Environmental Policy Act (NEPA) at
which time the appropriate environmental determination will be made.
RECOMMENDATION
Council conduct the public hearing and adopt the resolutions.

DISCUSSION
Last year, the Federal Government authorized the American Recovery and Reinvestment Act as
a way to stimulate the economy. To the credit of SANDAG, the first round of ARRA funds was
obligated extremely quickly to four regional projects that were ready to go to construction. The
San Diego Association of Governments (SANDAG) was able to conduct a fund transfer and use
those funds on four Federally funded projects ready to go to construction and remove
approximately $50 million in TransNet funds from their project budgets and reallocated them to
the local agencies. Chula Vista received approximately $3.6 million in TransNet funds to use on
pavement rehabilitation and traffic signal projects.
At the February 11, 2010 San Diego Traffic Engineers Council meeting held at SANDAG, an
update on the second round of ARRA funds was provided. SANDAG believes that there is a 50-
50 probability at this point in time that the region will obtain additional ARRA funds. Those
regions that have completed the necessary actions for candidate projects have a greater
probability in obtaining the federal funds. For sake of ease, we are referring to this second
round of funds as ARRA - II.
The criteria for obtaining ARRA - II funds is:
· The region must have already obligated the initial ARRA funds that were provided to the
region last year.
· The candidate projects must already be included in the Regional Transportation
Improvement Program (RTIP).
· The CEQA & NEPA environmental approval must be completed before June 1, 2010.
· The local agency must federalize the project(s) through Caltrans Local Assistance Office.
· A contract must be awarded by June 1,2010.
In reviewing the requirements for ARRA - II, the City of Chula Vista has two candidate projects
that can meet this criteria thus freeing up approximately $12 million in TransNet funds to use for
additional pavement rehabilitation work. Our current pavement program deficit is estimated at

approximately $13 million for each of the next few years and with the economy reducing the
amount of TransNet funds to local agencies, the ARRA - II funding opportunity is one that the
City must consider. In order to meet the time1ine restrictions, the Council is being asked to
revise the funding on two City of Chula Vista projects in the RTIP in order to accept the up to
$12 million in ARRA - II funds should they be made available to the City of Chula Vista.
Signed resolutions must be submitted to SANDAG by March 5, 2010. SANDAG staff has
informed the local agencies that should a special Board of Directors meeting be necessary to
meet the tight timeline, one will be scheduled.
There are two Chula Vista RTIP projects, CHV 35 & CHV48 that meet this criteria but a fund
swap to allow for the ARRA - II funds is necessary. Council is being asked to revise the project
funding from TransNet only funds to up to 100% ARRA - II funds, should the ARRA - II funds
become available. Once the exact amount of ARRA - II funds become available, staff will come
back and create new CIP projects and use the TransNet funds as a match and/or cash flow until
reimbursement is processed through Caltrans on the federal funds.

Proposed Amendment to 2008 RTIP
The proposed amendments to Chula Vista's portion of the 2008 RTIP are shown on the
attachments. Since the 2008 RTIP is a five-year program from FY08/09 to FYI2/13, the ARRA
- II fund swap is being considered for only the last four years, FY09/10 through the FYI2113.
Listed below is a description of the two projects that will be submitted for ARRA - II funding:
I. CHV35 Traffic Signing. Studies and Signal Upgrade: $250.000
This project will provide replacement signage, updated signage and repaint faded
pavement markings such as crosswalks and pavement legends around 36 of the Chula
Vista Elementary Schools. ProjectTrak shows that we have $240,000 budgeted in
FY09/10 and $55,000 in each of the FY 10111, FYll/12. Since CHV35 is used for other
purposes than the signage and striping, in order to meet the timeline for ARRA - II, only
the Elementary School, Signage and Striping project will be submitted for an amount up
to $250,000.
2. CHV 48 Pavement Maior Rehabilitation: $11.800.000
This includes the portion of the Pavement Rehabilitation Program that includes overlays
(one-inch and greater) and reconstruction. Compliance with the American with
Disabilities Act (ADA) is required.

Thus, the total amount available for the four FYs is $11,800,000. SANDAG guidelines require
the City to provide descriptions, locations and limits for all projects in the Congestion Relief
category, which includes this project. Since the exact number of locations in this program will
not be certain until the award of the contract, staff has provided SANDAG with a list of the

maximum number of locations that may be included. Attached is a list of streets that qualify for
the Federal funding. This will amend the list of streets that were presented to Council on May
12, 2009 with the last RTIP amendment. Federal funds cannot be used on local streets and the
attached list complies with the federal criteria. The streets have been selected in accordance with
the priorities established in the City's Pavement Management System for overlays. Federal
funds requested will be up to $11.8 million. This list of streets may also be used for Transnet-
funded projects related to Major Pavement Rehabilitation.
Pedestrian/ Bicvcle Accommodations
Since the list of streets included in CHV48 will become part of the RTIP and may be used for
Transnet projects, the list has been evaluated for pedestrian and bicyclists accommodation. The
new Transnet Ordinance states, "All new projects, or major reconstruction projects, funded by
revenues provided under this Ordinance shall accommodate travel by pedestrians and bicyclists,
except where pedestrians and bicyclists are prohibited by law from using a given facility or
where the cost of including bikeways and walkways would be excessively disproportionate to the
need or use." Rule 20 of SANDAG Board Policy 31 further elaborates on this requirement,
stating that evaluating pedestrian and bicycle accommodation is required for all major
reconstruction projects included under the Congestion Relief category. It further states that a
bicycle or pedestrian master plan approved within the past five years can be used to determine
the appropriate way of accommodating bicyclists and pedestrians in a given project. Staff feels
that the City's 2005 Bikeway Master Plan meets this requirement.
CHV35 is considered a maintenance proj ect, which does not fall under the requirement for
pedestrian! bicyclist accommodation. Staff has reviewed the street segments on the proposed
street list for CHV 48 for compliance with the Bikeway Master Plan. Some of the segments, such
as the ones on Broadway, are on the existing list and has previously been addressed with respect
to the RTIP. The following new segments have missing improvements which will be
constructed in conjunction with major pavement rehabilitation in the area

The City will need to obtain the approval of Caltrans in order to construct bike lanes on the
above segment of Telegraph Canyon Road. Staff will submit striping plans to Caltrans which
will include bike lanes. Bicycle and! or pedestrian facilities are currently under construction on
Fourth Avenue between L Street and Orange Avenue and on Otay Lakes Road between East H
Street and Gotham Street. These locations will be in compliance with the policy after the
facilities are completed.
The City will request an exclusion from the bicycle accommodations on Main Street between
Albany Avenue and Hilltop Drive. A cross-section of 100 to 104 feet of right-of-way is needed
in order to provide full pedestrian and bicycle facilities. The right-of -way is uneven in this area,
and for part of this segment, the right-of-way south of the center line is reduced from 51 feet to
40 feet. Installing bike lanes in this area would not only involve right-of-way acquisition, but
reconstruction of the sidewalk.

DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision
concerns repairs, replacement, or maintenance of existing streets or similar facilities and,
therefore, there is not a material financial effect of the decision on the property holdings of the
City Council Members pursuant to California Code of Regulations sections l8704.2(b)(2) and
18705.2(b)(1 ).
CURRENT FISCAL IMPACT
There will be no impact to the General Fund as the existing RTIP CIP projects currently show
these two candidate projects funded with TransNet funds. This action would allow for a fund
swap to bring in federal funds to augment TransNet funding.
ONGOING FISCAL IMPACT
None.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AN AMENDMENT TO
PROJECT CHV35, TRAFFIC SIGNING, STUDIES AND
SIGNAL, TO THE TRANSNET LOCAL STREET
IMPROVEMENT PROGRAM FOR SUBMITTAL TO THE SAN
DIEGO ASSOCIATION OF GOVERNMENTS FOR
INCLUSION IN THE REGIONAL TRANSPORTATION
IMPROVEMENT PROGRAM FOR FISCAL YEARS 2008/2009
THROUGH 2012/2013 AND PROVIDING CERTIFICATION
AND INDEMNITY STATEMENTS NECESSARY TO
CONDUCT A FUND SWAP FROM TRANSNET FUNDS TO
AMERICAN RECOVERY AND REINVESTMENT FUNDS
WHEREAS, on November 3, 1987, the voters of San Diego County approved the San
Diego Transportation Improvement Program Ordinance and Expenditure Plan (Ordinance); and
WHEREAS, on November 4, 2004, the voters of San Diego County approved the San
Diego County Transportation Improvement Program Ordinance and Expenditure Plan (Transnet
Extension Ordinance); and
WHEREAS, the Transnet Extension Ordinance provides that the San Diego Association
of Governments (SANDAG), acting as the Regional Transportation Commission, shall approve a
multi-year program of projects submitted by local jurisdictions identifying those transportation
projects eligible to uSe transportation sales tax (Transnet) funds; and
WHEREAS, in January 2009, the City of Chula Vista was provided with an estimate of
annual Transnet local street improvement reVenues for fiscal years 2009 through 2013; and
WHEREAS, on March 18, 2008, pursuant to Ordinance Nos. 3106 through 3110, the City
Council adopted the Western Chula Vista Transportation Development Fee (WTDIF) at a rate of
$3,243 per Equivalent Development Unit; and
WHEREAS, on January 25, 2005, pursuant to Resolution No. 2005-014, the City Council
adopted the City's Bikeway Master Plan; and
WHEREAS, in January 2008, SANDAG staff acknowledged this Plan as complete,
consistent with the 2030 Regional Transportation Plan, and coordinated with other jurisdictions;
and
WHEREAS, Section 4.E.3 of the Extension Ordinance states that all neW projects, or
major reconstruction projects, funded by revenues provided under this Ordinance shall
accommodate travel by pedestrians and bicyclists, except where pedestrians and bicyclists are

prohibited by law from using a given facility or where the costs of including bikeways and
walkways would be excessively disproportionate to the need or probable use; and
WHEREAS, Rule 21 "Accommodation of Bicyclists and Pedestrians" was adopted by the
SANDAG Board on February 22, 2008, to provide a guide to appropriate accommodation
measures for various types of streets; and
WHEREAS, the Rule 21 Amendment states that a local jurisdiction may use a bicycle or
pedestrian master plan adopted by the city council and approved by SANDAG to determine the
appropriate means of accommodating bicyclists and pedestrians in a given project and at a
minimum provide the facilities called for in the plan; and
WHEREAS, staff has determined that no exclusions are required under Rule 21 for the
projects proposed to be added to the Regional Transportation Improvement Program (RTIP); and
WHEREAS, the San Diego region may be eligible for the second round of Federal
American Recovery and Reinvestment Act (ARRA ~ II) funds and project CHV35, Traffic
Signing, Studies and Signal, is currently funded with TransNet funds but a fund swap of up to an
estimated $250,000 in ARRA - II funds could be used on this project if made available and is
consistent with the City's RTIP project CHV35; and
WHEREAS, the City Council of the City of Chula Vista has held a noticed Public
Hearing on March 2, 20 I 0, with an agenda item that clearly identified the proposed list of
projects prior to approval of the projects in accordance with by Section 5(A) of the Extension
Ordinance and Rule 7 of SANDAG Board Policy 31; and
WHEREAS, though all of the Capital Improvement Projects in the July 2009
Amendment to be sent to SANDAG and the associated SANDAG allocations are identified in
Exhibit C, attached, only those listed on Exhibit A are to be addressed and approved through this
Resolution.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby:
1. Approve part A of the July 2009 Amendment to the Transnet Local Street
Improvement Program for submittal to the San Diego Association of
Govemments for inclusion in the Regional Transportation Improvement Program
for Fiscal Years 2008/2009 through 2012/2013. The specific projects and funding
are citywide at up to 36 Chula Vista Elementary School sites, depending on
available funding.
2. Certify pursuant to Section 2(C)(l) of the Transnet Extension Ordinance, no more
than 30 percent of its annual Transnet revenues shall be spent on maintenance-
related projects.

3. Certify pursuant to Section 4(E)(3) of the Transnet Extension Ordinance, all new
projects, or major reconstruction projects, funded by Transnet revenues shall
accommodate travel by pedestrians and bicyclists, and that any exception to the
requirement permitted under the Ordinance and proposed shall be clearly noticed
as part of the City ofChula Vista's public hearing process.
4. Certify pursuant to Section 8 of the Transnet Extension Ordinance, the required
minimum annual level of local discretionary funds to be expended for street and
road purposes will be met throughout the five-year period consistent with the
most recent Maintenance of Effort Requirements adopted by SANDAG.
5. CertifY pursuant to Section 9.A of the Extension Ordinance, the City will extract
at least $2,000 from the private sector for each newly constructed residential
housing unit to comply with the provisions of the Regional Transportation
Congestion Improvement Program (RTCIP).
6. CertifY pursuant to Section 13 of the Transnet Extension Ordinance, a separate
Transportation Improvement Account has been established for Transnet revenues,
with earned interest expended only for those purposes for which the funds were
allocated.
7. CertifY pursuant to Section 18 of the Transnet Extension Ordinance, each project
of $250,000 or more will be clearly designated during construction with Transnet
project funding identification signs.
8. Agree to indemnify, holds harmless and defend SANDAG, the San Diego County
Regional Transportation Commission, and all officers and employees thereof
against all causes of action or claims related to local Transnet funded projects.
9. Certify all applicable provisions of the Ordinance, the Extension Ordinance, and
SANDAG Board Policy 31 have been met.

ASSOCIATION OF GOVERNMENTS FOR INCLUSION IN
THE REGIONAL TRANSPORTATION IMPROVEMENT
PROGRAM FOR FISCAL YEARS 2008/2009 THROUGH
2012/2013 AND PROVIDING CERTIFICATION AND

WHEREAS, on November 3, 1987, the voters of San Diego County approved the San
Diego Transportation Improvement Program Ordinance and Expenditure Plan (Ordinance); and
WHEREAS, on November 4, 2004, the voters of San Diego County approved the San
Diego County Transportation Improvement Program Ordinance and Expenditure Plan (Transnet
Extension Ordinance); and
WHEREAS, the Transnet Extension Ordinance provides that the San Diego Association
of Governments (SANDAG), acting as the Regional Transportation Commission, shall approve a
multi-year program of projects submitted by local jurisdictions identifying those transportation
projects eligible to use transportation sales tax (Transnet) funds; and
WHEREAS, in January 2009, the City of Chula Vista was provided with an estimate of
annual Transnet local street improvement revenues for fiscal years 2009 through 2013; and
WHEREAS, on March 18, 2008, pursuant to Ordinance Nos. 3106 through 3110, the City

SANDAG Board on February 22, 2008, to provide a guide to appropriate accommodation
measures for various types of streets; and
WHEREAS, the Rule 21 Amendment states that a local jurisdiction may use a bicycle or
pedestrian master plan adopted by the city council and approved by SANDAG to determine the
appropriate means of accommodating bicyclists and pedestrians in a given project and at a
minimum provide the facilities called for in the plan; and
WHEREAS, the Rule 21 Amendment states that an agency is not required to acquire
additional rights-of-way to improve bicycle and pedestrian access; and
WHEREAS, the Rule 21 Amendment states that the agency may consider context, cost,
probable use, and severe topographic or biologic constraints in its decision not to provide
provisions for bicyclists and pedestrians; and
WHEREAS, the Rule 21 Amendment states that the procedure for excluding
accommodations for pedestrians and bicyclists includes the agency notifying SANDAG that
bicycle and/or pedestrian facilities will not be included in the project along with justification for
that decision; and
WHEREAS, the Rule 21 Amendment states that the decision to exclude accommodations
for bicyclists and pedestrians must be made in the public hearing required by section 5.A of the
Extension Ordinance; and
WHEREAS, the San Diego region may be eligible for the second round of Federal
American Recovery and Reinvestment Act (ARRA - II) funds and project CHV 48, Pavement
Major Rehabilitation, is currently funded with TransNet funds but a fund swap of up to an
estimated $11.8 million in ARRA - II funds could be used on this project if made available and
is consistent with the City's RTIP project CHV48; and
WHEREAS, the City Council of the City of Chula Vista has held a noticed Public
Hearing on March 2, 2010, with an agenda item that clearly identified the proposed list of
projects prior to approval of the projects in accordance with by Section 5(A) of the Extension
Ordinance and Rule 7 of SANDAG Board Policy 31.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby:
I. Approve part B of the July 2009 Amendment to the Transnet Local Street
Improvement Program for submittal to the San Diego Association of
Goverrunents for inclusion in the Regional Transportation Improvement Program

for Fiscal Years 2008/2009 through 2012/2013. The City's proposed Major
Pavement Rehabilitation project list of streets is shown on Exhibit B.
2. Certify pursuant to Section 2(C)(1) of the Transnet Extension Ordinance, no more
than 30 percent of its annual Transnet revenues shall be spent on maintenance-
related projects.
3. Certify pursuant to Section 4(E)(3) of the Transnet Extension Ordinance, all new
projects, or major reconstruction projects, funded by Transnet revenues shall
accommodate travel by pedestrians and bicyclists with the following exception,
which has been clearly noticed as part of the City of Chula Vista's public hearing
process:
a. Because the overlay of Main Street between Albany Avenue and Hilltop
Drive will be greater than one-inch thick, it qualifies as a major rehabilitation
project under the Rule 21 Amendment. Staff intends to exclude bike lanes
along Main Street between Albany Avenue and Hilltop Drive because there is
insufficient right-of-way width along portions of the road. Construction of
bike lanes would require acquisition of additional right-of-way and the
demolition and reconstruction of a portion of the existing sidewalk.
4. Certify pursuant to Section 8 of the Transnet Extension Ordinance, the required
