HomeMy WebLinkAboutOrd 1982-2002 ORDINANCE NO. 2002 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING THE ZONING MAP OR MAPS ESTABLISHED BY SECTION 19.18.010 OF THE CHULA VISTA MUNICIPAL CODE, PREZONING THAT CERTAIN AREA DESIGNATED AS EASTLAKE I TO P-C ZONING AND ADOPTING GENERAL PLAN CONSISTENCY FINDINGS IN ACCORDANCE WITH GOVERNMENT CODE SECTION 65860 The City Council of the City of Chula Vista does hereby ordain as follows: SECTION I: That the Zoning Map or Maps established by Section 19.18.010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following prezoning of property: That that certain area designated as EastLake I and more particularly described in Exhibit B attached hereto and incorporated herein by reference as if set forth in full, be, and the same is hereby prezoned to P-C in accordance with the Planned Community District Regulations for EastLake I as contained in said Exhibit B, pursuant to the provisions of Section 19.12.020 of said Code authorizing the prezoning of unincorporated territory adjoining the City, and to the provisions of Section 19.48.070 pertaining to the establishment of a P-C zone, and said zoning shall become effective at and upon the date the subject property shall be annexed to the City of Chula Vista. SECTION II: The Council, pursuant to the requirements of Section 65860 of the Government Code, does hereby find as follows: WHEREAS, the City Council of the City of Chula Vista~has previously approved the General Plan Amendment for the 3,073~Sa~al Ranch pursuant to the Chula Vista General Plan EastLake Policy Plan dated June 25, 1982, and WHEREAS, the City Council of the City of Chula Vista wishes to approve the prezoning of a portion of said Janal Ranch property known as EastLake I to a Planned Community zoning designation with accompanying General Development Plan and Planned Community District Regulations, and -1- WHEREAS, the City of Chula Vista is required, pursuant to provisions of law, to determine that said EastLake I Planned Community prezoning is consistent with the applicable portions of the Chula Vista Municipal General Plan, as set forth in Government Code Section 65860, et seq. NOW, THEREFORE, the City Council of the City of Chula Vista determines upon the basis of the record of the project before it that the approved EastLake I Planned Community zone, together with its General Development Plan and District Regulations is consistent with the City's General Plan and its various applicable Elements, and finds in support of such determination that: 1. Land Use Element: The EastLake I Planned Community zone is consistent ~'~h the Land Use Element of the Chula Vista General Plan in that: a. The land uses and densities appropriate for EastLake I are included on the General Development Plan, a component of the Planned Community District Regulations pursuant to II.A. 3 of the Chula Vista General Plan EastLake Policy Plan, dated June 25, 1982, previously adopted. 2. Circulation Element: The EastLake I Planned Community zone is consistent with the Circulation Element of the Chula Vista General Plan in that: a. The Circulation Element has been amended to reflect the circulation shown on the General Development Plan for EastLake I as shown in the Planned Community District Regulations; b. Pursuant to the EastLake Policy Plan dated June 25, 1982, all applicable General Plan diagrams contained within the General Plan shall have approriate notations giving reference to the EastLake Policy Plan; c. The conditions of approval require that the extent and nature of street facilities to be built should be sufficient to provide safe and convenient access to the cumulative EastLake development. d. The transit requirements set forth in accordance with the EastLake I District Regulations are compatible with the goals, objectives, and policies set forth in the Circulation Element of the Chula Vista General Plan. 3. Housing Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Housing Element of the Chula Vista General Plan in that: a. It provides for well-planned neighborhoods of low- or~moderate-, middle- and upper-income families; b. It provides a private-sector approach to the provision of affordable housing by including 10% low- or moderate-income housing units within the Plan; c. It provides opportunities for the housing of the elderly and handi- capped; d. The various types of residential development allowed pursuant to the Planned Community Zone will provide for a balanced community concept in which ethnic, social, and economic enclaves are avoided; e. Adequate public facilities will be provided throughout the project pursuant to an approved Public Facilities and Financing Plan; and f. The approval of the EastLake I project will broaden local residents' choices of housing, housing types, and living environments. 4. Conservation Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Conservation Element of the Chula Vista General Plan in that: a. It provides for special study and treatment of lands adjacent to water resources: b. It allows the interim use of agricultural lands for continued agricultural uses until such time as development proceeds; c. It provides for various open space buffers to minimize the impact of development upon adjacent agricultural resources; and d. The Chula Vista General Plan'Conservation Element shall contain a notation giving reference to the policies set forth in the EastLake Policy Plan where appropriate. 5.0_~ Space Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Open Space Element of the Chula Vista General Plan in that: a. It provides for open space uses in areas necessary to protect public health, safety, and welfare, such as unstable areas or steep slope bank areas; -3- b. It provides for the interim use of natural resource areas such as farming areas pursuant to the terms of the Plan; c. It allocates 293 acres or 23~ of the project for open space uses such as outdoor recreational and educational activities, including public parks, trails, and developed outdoor private recreational facilities; and d. It intertwines open space corridors throughout the project to shape the urban form of the project in a manner compatible with adjacent land uses. 6. Seismic Saferv Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Seismic Safety Element of the Chula Vista General Plan in that: a. It, through the study programs established pursuant to the District Regulations for EastLake I, will identify those areas unsuitable for development for reasons of seismic instability; b. Only areas of geologic suitability for construction shall be the subject of construction activities; and c. Subsequent environmental review processes shall establish additional conditions or limitations upon building in unsuitable areas. 7. Noise Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Noise Element of the Chula Vista General Plan in that at the Sectional Planning Area Plan level: a. An acoustical analysis, consistent with citywide practices, shall be prepared using ultimate traffic volumes to delineate appropriate noise contours in the project for development. Residential con- struction shall be undertaken in accordance with the policies estab- lished in conjunction with said noise contours unless otherwise exempted; and b. Additional levels of review in the EastLake development shall require review of potential noise impacts in the preparation of supplemental environmental review and suggest appropriate mitigating measures. 8. Scenic Highways Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Scenic Highways Element of the Chuta Vista General Plan in that: a. The District Regulations provide for the preservation and enhancement of the scenic qualities of all scenic routes within the project through a careful review of architectual design of structures within said route; b. It includes programs for the siting of structures along said route; c. It includes designs for creating new scenic vistas and provides for creating lake overviews together with quality landscaping pro- grams; and d. It provides for a specific signing program for the development in accordance with standards for Sectional Development Plans within the EastLake I District Regulations. 9. Safety Element: The EastLake I Planned Community 'zone, together with its District Regulations and General Development Plan, is consistent with the Safety Element of the Chula Vista General Plan in that: a. It provides for ample water supply for fire flow requirements; b. It provides for adequate road widths and clearances for fire access; c. It provides for an on-site fire station to ensure minimal fire alarm response time; and d. It provides for a program for identifying potential geological hazards and for adequate programs to eliminate or lessen said hazards to acceptable levels during the Specific Planning Area Plan stage. 10. Public Buildings Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Public Buildings Element of the Chula Vista General Plan in that: a. It provides for an on-site library facility; b. It provides for an on-site fire station; c. It provides the opportunity for an on-site medical-dental facility; d. It provides for other public or quasi-public uses, including religious facilities; and e. The EastLake I Planned Community zone designates one high school/junior high school site and two elementary school sites on the General DeVelopment Plan. Said designations, coupled with the provisions for adequate schools set forth in Sections VIIIoC. of the EastLake I District Regulations, assure the adequacy of school facilities as necessary to serve the development. 11. Bike Routes Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Bike Routes Element of the Chula Vista General Plan in that: a. The EastLake General Development Plan provides the opportunity through the preparation of a trails plan to maximize access for bicyclists to most destinations within the project; ~ b. It provides for direct access through said system to cultural facilities, ~ recreational areas, educational facilities, and major employment .~ centers; c. It encourages the provision of parking areas for bicycles at said facilities; and -5- d. It provides the opportunity to utilize such nonmotor vehicular transportation facilities in conjunction with interconnecting bicycle routes throughout the County of San Diego and region. 12. Parks and Recreation Element: The EastLake I Planned Community zone, together with its District Regulations and General Development Plan, is consistent with the Parks and Recreation Element of the Chula Vista General Plan in that: a. It establishes a system of parks and recreational facilities pursuant to the General Development Plan and District Regulations sufficiently diverse in design to serve the needs of the citizens of the area; b. The parks are located in combination with school facilities to increase the potential for multiple use of facilities; c. Parks are linked together pursuant to a system of trail and/or open space corridors giving nonmotor vehicular access to said facilities; d. Sufficient lands will be dedicated to comply with the provisions of Section !7 of the Chula Vista Municipal Code dealing with park land dedication; and e. The EastLake I park and recreational program shall provide for a wide opportunity of outdoor and open space activities for diverse age and interest groups serving the EastLake t population and that of adjacent areas. ORDINANCE NO. 2002 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING THE ZONING MAP OR MAPS ESTABLISHED BY SECTION 19.18.010 OF TH~ CHULA VISTA MUNICIPAL CODE, PREZONING THAT CERTAIN AREA DESIGNATED AS EASTLAKE I TO P-C ZONING AND ADOPTING GENERAL PLA~ CONSISTENCY FINDINGS IN ACCORDANCE WITH GOVERNMENT CODE SECTION 65860 By a unanimous vote of those present (Councilman Moore was absent), the Council placed the ordinance on its second reading and adoption. On June 25, 1982; the Council approved the General Plan Amendment for the 3,073~anal Ranch pursuant to the Chula Vista General Plan EastLake Policy Plan. The ordinance, therefore, approves the prezoning of a portion of said Janal Ranch known as EastLake I to a Planned Community zoning designation with the accompanying General Development Plan and Planned Community District Regulations. Further, the Council has determined that said EastLake I Planned Community prezoning is consistent with the applicable Fortions of the Chula Vista Municipal General Plan as set forth in Government Code Section 65860. The Council certified that Master EIR-81-3 on the proposed EastLake Planned Community has been prepared in accordance with the California Environmental Quality Act, the State EIR Guidelines and the Environmental Review Procedures of the City of Ch~la Vista and that they have reviewed the document and are considering the information in the final EIR as they reach' a decision on the project.
