HomeMy WebLinkAboutOrd 1982-1996 Revised 8/24/82 ORDINANCE NO. 1996 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 8.08, SECTION 8.08.070A AND ADDING A NEW SECTION C TO SECTION 8.08.070 OF THE CHULA VISTA MUNICIPAL CODE ALL RELATING TO ANNUAL INSPECTION FEES FOR SERVICES PROVIDED BY THE SAN DIEGO COUNTY HEALTH DEPARTMENT The City Council of the City of Chula Vista does ordain as follows: SECTION I: That Chapter 8.08 of the Chula Vista Municipal is hereby revised by amending Section 8.08.070A and adding a new subsection C to said Section 8.08.070, to read as follows: Section 8.08.070 Annual Inspection Fees. A. Every person applying for a permit under the provisions of this chapter shall at the time of making application for the permit pay the following annual inspection fees: 1. For each establishment, other than a vehicle or vending machine, a fee based on the average number of employees during the preceding year or, if in the opinion of the health officer the average number of employees during the year for which the permit is sought with reasonable accuracy, the estimated average number of employees: a. For establishments governed by the California State Restaurant Act: 1 to 10 employees ........... $ 85.00 11 to 25 employees .......... 165.00 26 to 100 employees ......... 185.00 101 or more employees ....... 305.00 b. For establishments governed by the California State Retail Food Production and Marketing Establishment Law: 1 to 10 employees ........... $ 60.00 11 or more employees ........ 90.00 c. For establishments governed by the Bakery Sanitation Law: 1 or more employees ......... $ 85.00 -1- d. For establishments governed by the Chula Vista Municipal Code: 1 or more employees .......... $ 80.00 e. For food establishments vending pre-packaged non-refrigerated non-perishable foods: ............................. $ 20.00 f. For seasonal concession stands: 1 or more employees .......... $ 30.00 g. For temporary food concessions: 1 or more employees .......... $ 30.00 2. For each vehicle, other than mobile food preparation units, under the same ownership and operating out of the same establishment: ................................. $ 3o.oo 3. For each mobile food preparation unit under the same ownership and operating out of the same establishment .................... $100.00 4. For each vending machine dispensing milk, ice cream or milk products or other kinds of perishable foods or beverages, or dispensing unbottled or uncanned liquid foods or beverages, except rending machines which dispense unwrapped non-perishable, non-liquid food products ................................. $ 3.00 5. For mobile food preparations units at special events ........................... $ 30.00 6. Pet shops as governed by the California State Retail Food Production and Marketing Establishment Law ......................... $ 50.00 7. For each duplicate permit, license or registration ..................... $ 3.00 -2- Revised 8/24/82 C. Establishment Plan Review. Every applicant for a permit or license required by this chapter shall, prior to obtaining a building permit, opening a new establishment, or upon remodeling an old establish- ment, submit to the Health Officer a plan of the proposed establishment detailing all equipment, materials and facilities necessary to comply with the California Restaurant Act or Retail Marketing Act, whichever applies, and all applicable city ordinances or regulations, accompanied by a fee as set forth herein to cover the cost of said review. The Health Officer shall review said plans and specifications and shall determine whether they are in accordance with the requirements of law. In the event that the plans and specifications do not comply with applicable provisions of law, amended plans and specifications may be submitted to the Health Officer for rereview and approval, and the fee for such rereview shall be as set forth herein. Said fees are as follows: Establishment Plan Review ............ $ 35.00 Establishment Plan Rereview .......... $ 15.00 SECTION II: This ordinance shall take effect and be in full force on the thirty-first day from and after its adoption. DATED (seal) City Clerk CC-660 ORDINANCE NO. 1996 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 8, SECTION 8.08.070A OF THE CHULA VISTA MUNICIPAL CODE ALL RELATING TO ANNUAL INSPECTION FEES FOR SERVICES PROVIDED BY THE SAN DIEGO COUNTY HEALTH DEPARTMENT By a unanimous vote of those present (Councilwoman McCandliss was absent), the City Council placed the ordinance on its second reading and adoption. The County Health Department provides certain services for the City of Chula Vista in the way of health inspections for which they are paid a fee in accordance with the schedule adopted by the County. The City pays for these services within the incor- porated area and in order to recoup the full cost, it was necessary to amend the Municipal Code to adopt the same health permit fees as those in the County.
