HomeMy WebLinkAboutOrd 1982-1991 ORDINANCE NO. 1991 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING TITLE 8 OF THE CHULA VISTA MUNICIPAL CODE BY ADDING THERETO A NEW CHAPTER 8.34 RELATING TO THE REGULATION OF HAZARDOUS MATERIALS WHEREAS, all communities not only in the State of California, but throughout the country, are confronted with increasing problems relative to the disposal of hazardous and extremely hazardous wastes primarily chemicals which must necessarily be disposed of by industrial users, and WHEREAS, the County of San Diego has recently adopted Ordinance No. 6293 providing a hazardous materials disclosure regulation and Ordinance No. 6376 establishing a hazardous waste surveillance program, and WHEREAS, the Department of Health Services of the County of San Diego has requested that the City of Chula Vista adopt said ordinances to insure countywide protection and continuity of services in the regulation of such hazardous wastes which have proven to be extremely dangerous to the interests of both persons and property throughout the county. NOW, THEREFORE, the City Council of the City of Chula Vista does ordain as follows: SECTION I: That Title 8 of the Chula Vista Municipal Code be, and the same is hereby amended by adding thereto a new Chapter 8.34 to be and to read as follows: CHAPTER 8.34 REGULATION OF HAZARDOUS MATERIALS Sec. 8.34.010 Purpose and Intent. It is the purpose of the City Council of the City of Chula Vista to adopt, in accordance with the request of the Depart- ment of Health Services of the County of San Diego, the regulatory ordinances heretofore adopted by the County of San Diego for the control and regulation of hazardous and extremely hazardous wastes. Said ordinances would require all persons handling hazardous materials to disclose such information to the Department of Health Services of the County of San Diego in a manner required by the Department. A second ordinance would establish a permit system using the fees generally therefrom to carry out an enforcement and sur- veillance program. -1- It is the intent of the City Council through the adoption of said ordinances by reference to assist in every way in carrying out the hazardous waste management program being conducted by the County of San Diego. Sec. 8.34.020 Adoption of San Diego County Hazardous Materials Disclosure Ordinance and Hazardous Waste Surveillance Program Ordinance by Reference. The City Council of the City of Chula Vista does hereby adopt Ordinance No. 6293 and Ordinance No. 6376 of the County of San Diego by reference and does hereby incorporate said ordinances into the Chula Vista Municipal Code as if set forth in full. Both ordinances are on file in the office of the City Clerk of the City of Chula Vista. Sec. 8.34.030 Schedule of Fees for Enforcement and Implementation of Disclosure Ordinance and Surveillance Ordinance. Any person, association, partnership or corporation required to obtain a permit under the provisions of this chapter shall make an application to the County of San Diego, Department of Health Services. An annual nonrefundable fee, the exact amount of which shall be determined by the County Board of Supervisors and kept on record by the County Department of Health Services, shall accompany the submission of each application to the Department of Health Services to defray the cost to the County for administering and providing services pursuant to this chapter. SECTION II: This ordinance shall take effect and be in full force on the thirty-first day from and after its adoption. Presented and Approved as to form by George D. The ordinance adopts, by reference and incorpora~on in the Chula Vista Municipal Code, the ordinances of the County of San Diego for the regulation, enforcement and surveillance of hazardous materials. The ordinance is available for inspection at the office of the City Clerk, City Hall, 276 Fourth Avenue, Chula Vista. Dated: July 27, 1982
