HomeMy WebLinkAboutOrd 1982-1986 ORDINANCE NO. 1986 AN URGENCY INTERIM ORDINANCE ESTABLISHING A MORATORIUM ON THE CONDUCT OF A LOTTERY FOR THE ISSUANCE OF A CARDROOM LICENSE AND DECLARING THAT NO LICENSES SHALL BE ISSUED FOR A PERIOD OF NINETY DAYS WHEREAS, the City Council is required by Section 5.20,040 of the Chula Vista Municipal Code to conduct a lottery in the month of May in the event that a cardroom license should become available, and WHEREAS, at the present time, there are only three cardrooms operating in the City of Chula Vista and Chapter 5.20 of the Municipal Code authorizes, based upon current population, the operation of four cardrooms, and WHEREAS, the Director of Public Safety has recommended that the City Council conduct a study of the existing ordinance to determine whether the number of licenses for cardrooms should be limited or should be maintained at the current authorized level, and WHEREAS, during the period of study, it is desired that no lottery be conducted and no further licenses be issued. NOW, THEREFORE, the City Council of the City of Chula Vista does ordain as follows: SECTION I: That the lottery provisions of Chapter 5.20 be, and the same are hereby suspended for a period of ninety (90) days from the effective date of this ordinance and that no further licenses be issued for cardrooms in the City of Chula Vista to and until August 20, 1982. SECTION II: This ordinance shall take effect upon its first reading if adopted by at least four affirmative votes of the City Council as an interim ordinance and an emergency measure. The ordinance suspends the provisions of Chapter 5.20 of the Municipal Code from the date of its adoption to and until August 20, 1982 declaring that no lottery may be conducted and no cardroom licenses issued during a period of study to determine whether the number of cardroom licenses should be limited or maintained at the currently authorized level.
