AN ORDINANCE OF THE CITY OF CHULA VISTA DECLARING
THAT THERE IS A NEED FOR AN INDUSTRIAL DEVELOPMENT
AUTHORITY AND THAT SUCH AUTHORITY SHALL FUNCTION
IN THE CITY OF CHULA VISTA
RESOLVED, by the City Council of the City of Chula Vista,
that
WHEREAS, the City Council of the City of Chula Vista has
heretofore adopted Ordinance No. 1970 making necessary findings
and determinations, setting forth definitions, and establishing
requisite authorizations and powers relating to the financing of
industrial and commercial development within said City in the
interests of the public health, safety and welfare, and
WHEREAS, the California Industrial Development Financing
Act (being Title 10, commencing with Section 91500 of the Govern-
ment Code of the State of California) creates in the City of Chula
Vista a public corporate instrumentality of the State of Cali-
fornia known as the industrial development authority of the City
for the purpose of exercising the powers granted by the California
Industrial Development Financing Act, and
WHEREAS, Section 91520(b) of the California Industrial
Development Financing Act provides that said industrial develop-
ment authority shall not transact any business or exercise any
powers unless by ordinance the City Council of the City of Chula
Vista declares that there is a need for the authority and that the
authority shall function.
NOW, THEREFORE, the City Council of the City of Chula
Vista does ordain as follows:
SECTION I: It is hereby found, determined and declared
that there is a need for an industrial development authority in
the City of Chula Vista and that an industrial development
authority shall function in the City of Chula Vista in accordance
with the provisions of the California Industrial Development
Financing Act.
SECTION II: Said industrial development authority is
hereby established pursuant to the California Industrial
Development Financing Act to be known as the Chula Vista
Industrial Development Authority. Said industrial development
authority is hereby authorized to transact business and exercise
its powers under provisions of the California Industrial
Development Financing Act.
SECTION III: This ordinance shall take effect and be in
full force on the thirty-first day from and after its adoption.
